Appointing the Cost of Maintenance, &c., Main Drain, Sluggish River Drainage District, County of Manawatu.

A PROCLAMATION.

WHEREAS under the provisions of “The Land Drainage Amendment Act, 1898” (hereinafter termed “the said Act”), a Commissioner was appointed and an inquiry was duly held with a view to determining what amount should be paid by the Horseshoe Drainage Board to the Sluggish River Drainage Board for or towards the cost of managing, maintaining, repairing, improving, or reconstructing certain drains or watercourses running through or situated within the Sluggish River Drainage District, and also of all drainage-works connected therewith or appertaining thereto: And whereas such Commissioner did report to the Governor, after due inquiry, his opinion as to the matters respecting which he was appointed to report: And whereas it is expedient to make provision under the said Act for the purposes and in the manner hereinafter set forth:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, Governor of the Colony of New Zealand, in pursuance and in exercise of the power and authority vested in me by the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do hereby proclaim and direct as follows—that is to say:—

  1. That the drain situated in the Sluggish River Drainage District usually known as the “Main Drain,” and hereinafter called “the said drain,” shall from and after the date of this Proclamation be under the exclusive care, control, and management of the Sluggish River Drainage Board.

  2. I fix and determine that the future cost of maintaining and repairing the said drain shall be provided and paid from time to time by the under-mentioned local authorities in the proportion set opposite the name of each local authority—that is to say:—

The Sluggish River Drainage Board in the proportion of one-half of such cost.

The Horseshoe Drainage Board in the proportion of one-half of such cost.

  1. I direct that any payment hereby required to be made as aforesaid by the said Horseshoe Drainage Board shall be paid from time to time in the proportions hereinbefore fixed and determined, out of the funds under the control of the said Horseshoe Drainage Board, in each case within a period of thirty days after demand in writing made by or on behalf of the Sluggish River Drainage Board; and all such payments shall be made from time to time to the Secretary of the said Drainage Board for and on account of such Drainage Board.

  2. And I further direct that half the costs, charges, and expenses of and incidental to the inquiry by the Commissioner aforesaid touching and concerning the premises shall be paid and borne by the said Sluggish River Drainage Board, and half such costs, charges, and expenses by the said Horseshoe Drainage Board.

A PROCLAMATION.

WHEREAS the lands mentioned in the Schedule hereto are required to be taken, under “The Public Works Act, 1894,” and its amendments, for certain works, to wit, the purpose of roads in Blocks I., II., IV., VI., and VII., Opaheke, and Block IV., Drury, Survey Districts, Hunua Road District:

And whereas the Hunua Road Board has laid before the Governor a memorial, accompanied by maps, and also the statutory declaration, required by the said Act:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities in me vested by “The Public Works Act, 1894,” and of every other power and authority in anywise enabling me in that behalf, do hereby proclaim and declare that, from and after the date of the publication hereof in the New Zealand Gazette, the lands mentioned in the Schedule hereto are hereby taken for the purpose of roads.
