Now, therefore, in pursuance of the powers vested in him by section one hundred and nine of “The Mining Act, 1898,” His Excellency the Governor hereby notifies that application has been made to him to constitute and set apart by Proclamation the watercourse the name, description, and locality whereof are set forth in the Second Schedule hereto to be a watercourse into which may be discharged any tailings, débris, and waste water produced by or resulting from mining operations carried on under the said Act.

Any person who objects to such Proclamation being made, or whose land, or riparian or other rights in respect of such land, will be damaged or injuriously affected by the operation thereof, is required to serve on the Minister of Mines, within the period of ninety days after the publication hereof in the Gazette, full particulars of such objection, and also a claim in the prescribed form setting forth full particulars of all compensation that will be claimed by him in the event of such Proclamation being made.

No person will be entitled to any compensation for damage or injury consequent on the operation of such Proclamation unless his claim is duly served in the manner and within the period aforesaid.

FIRST SCHEDULE.

THAT tributary of the Waikaka River known as Garden Gully, from its source in Section 6, Block I., Glenkenich Survey District, to its confluence with eastern branch of the Waikaka Stream; also tributaries of the said Garden Gully. Date of gazetting of notice of application to proclaim, 7th September, 1899.

SECOND SCHEDULE.

THAT tributary of the Waikaka River known as Garden Gully, which flows easterly from its source in Section No. 12, Block V., Chatton Survey District, for a distance of about five miles to its confluence with the Waikaka River; and also the several tributaries thereof.

Dated at Wellington, this tenth day of June, one thousand nine hundred and one.

Trustees for the Ashhurst Public Cemetery appointed.

RANFURLY, Governor.

IN pursuance and exercise of the powers and authorities vested in me by the sixth section of “The Cemeteries Act, 1882,” I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, do hereby appoint the several persons whose names are specified in the first column of the Schedule hereto to be Trustees to provide for the maintenance and care of the public cemetery specified in the second column of the said Schedule.

SCHEDULE.

Names of Trustees. Name of Public Cemetery, and Description of Land.
Thomas Lowes, George Staples Rumble, Jack Howard Vincent, George Searle, and John McCool. ASHHURST. All that parcel of land in the Wellington Land District, containing by admeasurement 3 acres 2 roods 24 perches, more or less, being Section No. 463b, Block III., Gorge Survey District. Bounded towards the north by Sections Nos. 463a and 463 (part); towards the east by Section No. 463c; towards the south by Section No. 463c; and towards the west by Section No. 463c and a public road; as the same is delineated on the plan deposited in the District Lands and Survey Office, Wellington.

As witness the hand of His Excellency the Governor, this tenth day of June, one thousand nine hundred and one.

Names of Trustees. Name of Public Cemetery, and Description of Land.
John Fisher, James Anderson, Joseph Gane, William Scott, and William Sturges. PUKEKURA. All that parcel of land in the Auckland Land District, County of Waipa, containing by admeasurement 5 acres 2 roods 38 perches, being part of Section No. 12, Parish of Pukekura. Bounded towards the south-west by the road forming the northern boundary of Sections Nos. 35 and 36, 1000·7 links and 155 links, to a point 357 links distant from the road forming the western boundary of said Section No. 12; thence towards the north-west by a wire fence bearing 41° 21′ magnetic, 637·4 links; towards the north-east by a right line bearing 94° 43′ magnetic, 751·7 links; towards the south-east by a right line bearing 184° 43′ magnetic, 600 links, to the aforesaid road: as the same is delineated on the plan deposited in the District Lands and Survey Office, Auckland.

As witness the hand of His Excellency the Governor, this fifteenth day of June, one thousand nine hundred and one.
