Powers delegated to the Warea Domain Board under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this fifth day of June, 1901.

Present:

THE RIGHT HONOURABLE R. J. SEDDON PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the twenty-second day of August, one thousand eight hundred and ninety-three, in so far as it relates to the land mentioned in the Schedule hereto, making delegation of certain powers in manner as therein appears; and doth hereby, with the like advice and consent, and in respect of the land hereinafter mentioned, delegate all the powers conferred by the said Act, except the powers conferred by sections five and twelve thereof, for the period of ten years from the date hereof (unless previously altered or revoked under the said Act), to the under-mentioned persons, who shall be known as the Warea Domain Board, namely,—

Alfred Clothier, of Warea, Farmer;
Patrick Murphy, of Warea, Farmer;
Samuel Jones, of Warea, Farmer;
Fred. Binnie, of Warea, Farmer;
James Ducker, of Warea, Farmer;
Thomas Julian, of Warea, Farmer; and
James Jeken Elwin, of Warea, Farmer

(herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the first Monday in the months of July, October, January, and April, at the hour of seven o'clock p.m., at the office of the Warea Co-operative Dairy Factory Company, at Warea, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Monday, the first day of July, one thousand nine hundred and one.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days' notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  3. Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the first Monday in January in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  5. The Board shall prepare and submit at each annual meeting a report of the proceedings of the Board for the previous year ending on the thirty-first day of December, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.

  6. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.

  7. If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.

  8. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

And with the like advice and consent as aforesaid doth hereby also order that this delegation shall take effect in respect of the parcel of Crown land described in the Schedule hereto.

SCHEDULE.

All that parcel of land in the Taranaki Land District, containing by admeasurement 26 acres, more or less, being Section No. 71, Block VIII., Cape Survey District. Bounded towards the north by the Teikaparua Stream; towards the east by a road, 720 links; towards the south by Section No. 72, 2450 links; and towards the west by Section No. 72, 181 links: as the same is delineated on the plan deposited in the District Lands and Survey Office, New Plymouth.

Trout-fishing Regulations, Stratford District.

ORDER IN COUNCIL.

At the Government House, at Auckland, this tenth day of June, 1901.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance of the powers and authorities vested in him by “The Fisheries Conservation Act, 1884,” and the amendments thereof, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby make the following regulations for, and to have force and effect in, the County of Stratford and in the Borough of Stratford, and for and in all the lakes, ponds, rivers, streams, creeks, and other waters situated in the whole or in part in such County and [or] Borough of Stratford respectively; and doth hereby declare that these regulations shall, as from the date of the publication thereof in the New Zealand Gazette, supersede all regulations at variance therewith.

REGULATIONS.

  1. No person shall fish in any river, stream, creek, or other water situated in the whole or in part in the County of Stratford or Borough of Stratford without a license; and every person fishing in any such river, stream, creek, or other water shall, on demand of any Ranger, constable, member of the Stratford Acclimatisation Society, or person producing a license of such society to fish, produce and show to such Ranger, constable, member, or person, as the case may be, his license, the contents of his creel or bag, the fish then in his possession, and the bait used by him for taking, catching, or killing fish.

  2. Licenses to fish for trout in all the waters aforesaid shall be issued by the Stratford Acclimatisation Society under the hand of its Secretary for the time being. For every such license, except as hereinafter provided, a fee of ten shillings shall be charged: Provided that such licenses may be issued to boys not over sixteen years of age and to women and girls at a reduced fee of five shillings; and provided also that it shall not be obligatory on the said society to issue a license to any person in any case.
