And whereas it is desirable that the Waimea County Council, a local governing body within the meaning of the said Act, should be authorised to construct certain harbour-works for Motueka Harbour :
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise of the power and authority conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby authorise the Waimea County Council to construct protective works for Motueka Harbour in accordance with plans marked M.D. 2387, and deposited in the office of the Marine Department at Wellington, and to use and occupy such part of the foreshore, tidal land, or tidal water as may be necessary for the construction of the works in accordance with the said plan.

At the Government House, at Wellington, this fourteenth day of January, 1901.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
IN pursuance and exercise of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke certain Orders in Council, dated the thirty-first day of October, one thousand eight hundred and ninety-one, and the fourteenth day of June, one thousand eight hundred and ninety-two, making delegation of certain powers in manner as therein appears; and doth hereby, with the like advice and consent, and in respect of the land hereinafter mentioned, delegate all the powers conferred by the said Act, except the powers conferred by sections five and twelve thereof, for the period of ten years from the date hereof (unless previously altered or revoked under the said Act) to the under-mentioned persons, who shall be known as the Makotuku Domain Board, namely,—

WILLIAM PIKE,
JACOB NEILSON,
WILLIAM ROBINSON, and
JOHN FITZGERALD
(herein referred to as “the Board”); subject to the stipulations hereinafter contained, that is to say,—

The Board shall meet for the transaction of business on the first Saturday in each month, at seven o’clock p.m., at the Public School, Makotuku, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Saturday, the second day of February, one thousand nine hundred and one.

Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the first Saturday in February in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

The Board shall prepare and submit at each annual meeting a report of the proceedings of the Board for the previous year ending on the thirty-first day of December, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.

If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.

If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.

All questions shall be determined by the majority of votes of the members of the Board present at a meeting.
And with the like advice and consent as aforesaid doth hereby also order that this delegation shall take effect in respect of the parcels of Crown lands described in the Schedule hereto.
SCHEDULE.
ALL that parcel of land in the Hawke’s Bay Land District, containing by admeasurement 18 acres 3 roods 18 perches, more or less, being Section No. 66, Block IX., Takapau Survey District; subject to a right of road, 100 links wide, along its south-eastern boundary. Bounded on the north-west by Section No. 60, 2850 links; on the north-east by a road, 108·5 links; on the south-east by Section No. 119, 2662 links; and on the south-west by the Mangatewainui Stream: be all the aforesaid linkages more or less.
Also all that parcel of land in the Hawke’s Bay Land District, containing by admeasurement 5 acres, more or less, being Section No. 13, Block IX., Takapau Survey District. Bounded on the north-east by Section No. 12, 1001 links; on the south-east by Section No. 25, 499 links; on the south-west by Section No. 14, 1001 links; and on the north-west by a public road 1 chain wide, 499 links: be all the aforesaid linkages more or less.
As the same are delineated on the plan deposited in the District Lands and Survey Office, Napier.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by an Order in Council made under “The Land Drainage Act, 1893,” dated the twenty-seventh day of June, one thousand eight hundred and ninety-eight, and published in the New Zealand Gazette of the thirtieth day of June, one thousand eight hundred and ninety-eight, the area described in the Schedule to the said Order in Council was constituted a drainage district under the said Act, to be called the Hautapu Drainage District :
And whereas it is expedient to abolish the said Hautapu Drainage District :
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority contained in the said “Land Drainage Act, 1893,” and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby abolish the said Hautapu Drainage District as from the date of the publication hereof in the New Zealand Gazette.

Exchange of a Portion of a Reserve in Canterbury for other Land.

WHEREAS the land mentioned in the first column of the Schedule hereto was permanently set apart as a reserve for gravel: And whereas, in the opinion of the Governor, it is expedient to exchange the said land for that described in the second column of the Schedule hereto :
Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” and the third section of “The Public Reserves Act Amendment Act, 1889,” doth hereby declare that the portion of the said reserve described in the first column of the Schedule hereto may be exchanged for the lands described in the second column of the Schedule hereto.
