Unlawful to take Oysters in Southern Subdivision of Northern Oyster-fishery.

WHEREAS it is, amongst other things, enacted by section fifteen of “The Sea-fisheries Act, 1894,” that the Governor may from time to time declare any bay, estuary, or tidal waters in the colony to be an oyster-fishery, and prescribe the subdivisions thereof wherein it shall be lawful and unlawful to take oysters:

And whereas, by Warrant under the hand of the Governor dated the twenty-fourth day of March, one thousand eight hundred and ninety-eight, and published in the New Zealand Gazette of the thirty-first day of the same month, the Northern Oyster-fishery was constituted and divided into subdivisions:

And whereas, by Warrant dated the twelfth day of March, one thousand nine hundred and one, and published in the New Zealand Gazette of the twenty-first day of the same month, it was declared lawful to take oysters in the Southern Subdivision of the said oyster-fishery, and it is now desirable that it should be declared unlawful to take oysters in such subdivision:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the hereinbefore-recited power and authority, doth hereby declare and prescribe that it shall, on and after the first day of June, one thousand nine hundred and one, be unlawful to take oysters in the Southern Subdivision of the Northern Oyster-fishery.

As witness the hand of His Excellency the Governor, this twenty-third day of May, one thousand nine hundred and one.

NOTE.—The southern subdivision of the Northern Oyster-fishery extends from Ti Point, on the south side of the entrance to the River Waitangi, Bay of Islands, to a point on high-water mark of the sea due east of Trig. Station No. 29, on the south head of Whangaruru Harbour.


Further Extending Time of Commission to inquire and report generally in respect to the Constituting and Setting-apart of Watercourses in the Land Districts of Marlborough, Nelson, and Westland as Watercourses for the Discharge of Tailings and Waste Water produced by Mining Operations.

To all to whom these presents shall come, and to Charles William Adams, Esquire, Commissioner of Crown Lands for the Land District of Marlborough; Thomas Humphries, Esquire, Commissioner of Crown Lands for the Land District of Nelson; William George Murray, Esquire, Commissioner of Crown Lands for the Land District of Westland; Frederick Robert Flatman, Esquire, Member of the House of Representatives; and Henry Andrew Gordon, Esquire, of Auckland, Mining Engineer: Greeting.

WHEREAS by a Commission bearing date the seventh day of January last you, the said

FREDERICK ROBERT FLATMAN, and
HENRY ANDREW GORDON

were appointed to be a Commission for the purposes and with the powers in the said Commission more particularly mentioned: And whereas by the said Commission you were directed and required to report to me, on or before the thirty-first day of March then next ensuing, your proceedings and your opinion touching the matters mentioned therein:

And whereas by Order in Council dated the seventh day of March last the time within which the said Commission was to report was extended to the thirty-first day of May next ensuing:

And whereas it is expedient that the said period should be further extended as hereinafter provided:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, and in exercise of every power and authority enabling me in that behalf, do hereby extend the period within which you shall (using all diligence) report to me as by the said Commission provided, to the twenty-fifth day of June next ensuing; and with the like advice and consent, and in further pursuance and exercise of the said power and authority, I do hereby confirm the said Commission except as altered by these presents.

In witness whereof I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, acting by and with the advice of the Executive Council of the said colony, have hereunto set my hand and have caused these presents to be issued under the Seal of the said Colony, at Wellington, in the said colony, this twenty-seventh day of May, in the year of our Lord one thousand nine hundred and one.

Extra Aide-de-Camp to the Governor appointed.

to be His Excellency’s Extra Aide-de-Camp as from the 22nd May, 1901.

Whilst holding this appointment Lieutenant Osborne will be granted the rank of captain.
