  1. That the said drain shall from and after the date of this Proclamation be under the exclusive care, control, and management of the Borough Council of Invercargill.

  2. I fix and determine that the future cost of maintaining, repairing, improving, or reconstructing the said drain shall be provided and paid from time to time by the under-mentioned local authorities, in the proportion set opposite the name of each local authority, that is to say,—

The Borough Council of Invercargill, in the proportion of nine-twentieths of such cost.

The Borough Council of North Invercargill, in the proportion of five-twentieths of such cost.

The Borough Council of East Invercargill, in the proportion of three-twentieths of such cost.

The Borough Council of Avenal, in the proportion of two-twentieths of such cost.

The County Council of Southland, in the proportion of one-twentieth of such cost.

  1. I direct that any payment hereby required to be made as aforesaid by the several local authorities hereinbefore mentioned shall be paid from time to time, in the proportions hereinbefore fixed and determined, out of the funds under the control of the said Borough Councils and County Council respectively, in each case within a period of thirty days after demand in writing made by or on behalf of the Borough Council of Invercargill; and all such payments shall be made from time to time to the Town Clerk of the said Borough Council, for and on account of such Borough Council.

  2. And I further direct the costs, charges, and expenses of and incidental to the inquiry by the Commissioner aforesaid touching and concerning the premises shall be paid and borne by the said Borough of Invercargill.

Defining the Middle Line of a Portion of the Stratford-Wangamomona Branch of the Foxton-New Plymouth Railway, Toko Section.

A PROCLAMATION.

WHEREAS a branch of the Foxton-New Plymouth Railway—namely from Stratford to a point at or near Wangamomona (hereinafter termed “the said railway”)—is a railway the construction of which is authorised by “The Railways Authorisation Act, 1900”: And whereas it has been determined to construct and maintain a portion of the same—namely, the Toko Section:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities conferred by “The Public Works Act, 1894,” and in exercise of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the middle line of the said portion of the said railway shall be that defined and set forth in the Schedule hereto.


SCHEDULE.

COMMENCING at a point in the Borough of Stratford, the said point being situated on the line of the Foxton-New Plymouth Railway, distant about 5 chains north of the north side of Celia Street, in the said Borough of Stratford; proceeding thence generally in an easterly direction for a distance of about 6 miles 40 chains, and passing in, into, through, or over the following lands—viz., Railway land, Sections Nos. 723, 724, 725, and Celia Street, Suburban Sections Nos. 90 and 91, all in the Borough of Stratford; Sections Nos. 14, 15, 17, 18, 19, 20, 21, 118, 119, 121, 128, Block II., Ngaiire Survey District; Sections Nos. 2 and 3, Subdivisions Nos. 9, 10, 11, 12, and 13, of Section No. 1, Sections Nos. 40, 41, 34, 35, and 36, all in Block III., Ngaiire Survey District—and terminating at a point on the eastern boundary of said Section No. 36 distant about 8 chains in a northerly direction from the south-eastern corner thereof: including all adjoining and intervening places, lands, reserves, roads, rivers, streams, and watercourses: all in the Land District of Taranaki: in the manner delineated on the plan marked P.W.D. 19302, deposited in the office of the Minister for Public Works, at Wellington, in the Provincial District of Wellington.

Given under the hand of His Excellency the Right Honourable Uchter John Mark, Earl of Ranfurly; Knight Commander of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over His Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this thirtieth day of April, in the year of our Lord one thousand nine hundred and one.

Powers delegated to the Waiopehu Domain Board under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this seventeenth day of April, 1901.

Present:

THE HONOURABLE W. C. WALKER PRESIDING IN COUNCIL.

WHEREAS by the twelfth section of “The Public Domains Act, 1881,” it is, inter alia, enacted that the Governor, by Order in Council, may from time to time delegate all or any of the powers by the said Act conferred, save as is therein mentioned, to any person or persons, for any period, and subject to such stipulations as may be specified in such Order, and that every such delegation may from time to time in like manner be altered or revoked: And whereas, pursuant to “The Public Reserves Act, 1881,” by an Order in Council of even date herewith; the land described in the Schedule hereto, situate in the Wellington Land District, is declared to be brought under the operation of and to be subject to the provisions of the said “Public Domains Act, 1881”:

Now, therefore, His Excellency the Governor, by and with the advice and consent of the Executive Council of the Colony of New Zealand, doth hereby, and in respect of the land hereinafter mentioned, delegate all the powers conferred by the Act first above mentioned, except the powers under or conferred by sections five and twelve thereof, for the period of ten years from the date hereof (unless previously altered or revoked under the said Act), to

THE HOROWHENUA COUNTY COUNCIL,

which shall be known as the Waiopehu Domain Board (herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the second Saturday in each month, at half-past two o’clock p.m., at the Council Chambers, Levin, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Saturday, the eleventh day of May, one thousand nine hundred and one.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  3. Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The Chairman of the County Council shall be the Chairman of the Board. He may join in the discussion, and shall have an original as well as a casting vote.

  5. The Board shall prepare and submit at each annual meeting a report of the proceedings of the Board for the previous year ending on the thirty-first day of December, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.

  6. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.
