land, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the seventeenth day of April, one thousand eight hundred and seventy-nine, making delegation of certain powers in manner as therein appears; and doth hereby, with the like advice and consent, and in respect of the lands hereinafter mentioned, delegate all the powers conferred by the said Act, except the powers conferred by sections five and twelve thereof, for the period of ten years from the date hereof (unless previously altered or revoked under the said Act), to the under-mentioned persons, who shall be known as the Waikaiā Domain Board, namely,—

DUNCAN MATHESON, Jun.,
ROBERT THOMPSON STEWART,
JOHN WALKER STEWART,
COLIN ROBERTSON, and
THOMAS TAYLOR

(herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the first Saturday in every alternate month, at eight o’clock p.m., at the office of Mr. Duncan Matheson, jun., Waikaiā, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Saturday, the first day of December, one thousand nine hundred.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  3. Any three of the said Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the first Saturday in February in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  5. The Board shall prepare and submit at each annual meeting a report of the proceedings of the Board for the previous year ending on the thirty-first day of December, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.

  6. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.

  7. If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any ordinary or special meeting appoint a Chairman.

  8. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

And with the like advice and consent as aforesaid doth hereby also order that this delegation shall take effect in respect of the parcel of Crown lands described in the Schedule hereto.

SCHEDULE.

ALL that parcel of land in the Southland Land District, containing by admeasurement 5 acres 2 roods, more or less, being Block IV., Township of Waikaiā. Bounded towards the north-west by Blaydon Street, 500 links; towards the north-east by Ryton Street, 1100 links; towards the south-east by Scotswood Street, 500 links; and towards the south-west by Uyton Street, 1100 links: as the same is delineated on the plan deposited in the office of the Chief Surveyor, Invercargill.

Altering Previous Order in Council, and declaring Wanganui Harbour Board to be subject to “The Public Bodies’ Powers Act, 1887.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-ninth day of October, 1900.

Present:

His Excellency the Governor in Council.

WHEREAS by an Order in Council dated the second day of July, one thousand eight hundred and ninety-five, and published in the New Zealand Gazette of the fourth of that month, the Wanganui Harbour Board was declared to be subject to the provisions of “The Public Bodies’ Powers Act, 1887,” excepting those of sections five, six, and seven: And whereas the said Board has requested that the said Order in Council may be altered by declaring the said Board to be subject to the whole of the provisions of the said Act: Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the Wanganui Harbour Board shall, as from the date of the publication hereof in the New Zealand Gazette, be subject to all the provisions of “The Public Bodies’ Powers Act, 1887”; and, further, that the aforesaid Order in Council of the second day of July, one thousand eight hundred and ninety-five, is hereby revoked, but without prejudice to anything heretofore done thereunder.

Vesting a Reserve in the Geraldine County Council.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-ninth day of October, 1900.

Present:

His Excellency the Governor in Council.

WHEREAS the land mentioned in the Schedule hereto was permanently set aside as a gravel reserve on the eighth day of June, one thousand nine hundred:

And whereas, in the opinion of the Governor, it is expedient to vest the said land in the Geraldine County Council:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” doth hereby declare that, from and after the day of the date hereof, the reserve mentioned in the Schedule hereto shall become vested in “The Chairman, Councillors, and Inhabitants of the Geraldine County,” in trust, for river and bridge protection.

SCHEDULE.

ALL that parcel of land in the Canterbury Land District, containing 17 acres, more or less, being Reserve No. 3501, Block II., Arowhenua Survey District. Bounded towards the north by Reserve 881; towards the east by the bridge over the Opihi River on the main road; and towards the south-west by the River Opihi: as the same is delineated on the plan deposited in the office of the Chief Surveyor, Christchurch.

Declaring Roads in the Wellington District to be County Roads.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-ninth day of October, 1900.

Present:

His Excellency the Governor in Council.

IN pursuance and exercise of the powers vested in him by the one-hundred-and-second section of “The Public Works Act, 1894,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby order that the portions of the roads known as the Te Parapara, Mangawharariki, West Mangahua, Cross Road, Watershed Road, Mangarere Road, Peka Road, and Pemberton Farm-homestead Road, described in the Schedule below, and which have hitherto been Government roads, shall on and after the date of this Order in Council become county roads.

SCHEDULE.

Those roads or parts of roads in the Land District of Wellington described as follows:—

That part of Te Parapara from its junction with Mangawharariki Road to its junction with the Main Road, as shown on plan marked S.G. 44152D, hereinafter mentioned.
