  1. Each driving-wheel of every traction-engine shall be of the widths following: Where the weight attached to or drawn by such engine is more than 10 tons (exclusive of the weight of the engine, trucks, and wagons), the width of each such driving-wheel shall be not less than 18 in. Where such weight attached or drawn as aforesaid is less than 10 tons (exclusive of the weight of the engine, trucks, and wagons), the width of each such driving-wheel shall be not less than 16 in.

  2. For the purposes of these by-laws ten sacks of wheat, eleven sacks of barley, thirteen sacks of oats, eleven sacks of potatoes, and twelve sacks of coal respectively shall each be deemed to weigh 1 ton; one cubic yard of bricks shall be deemed to weigh 1½ tons; one cubic yard of stone or metal shall be deemed to weigh 1 ton 5 cwt.; and six bales of wool shall be deemed to weigh 1 ton.

  3. It shall be lawful for any person acting under the authority of the Road Board at all times to examine, weigh, count, and measure any engine, vehicle, wagon, truck, or machine, or any load drawn or carried by any such engine, vehicle, wagon, truck, or machine, and to demand from the owner or other person in charge of any such vehicle, engine, wagon, truck, or machine the number of sacks or bales drawn or carried by any such engine, vehicle, wagon, truck, or machine, and satisfactory proof of the weight of any such engine, vehicle, wagon, truck, or machine, and of any load drawn or carried by any such engine, vehicle, wagon, truck, or machine. If any person so acting shall be dissatisfied with the proof so offered, he may require the owner or person so in charge as aforesaid to drive or convey such engine, vehicle, wagon, truck, machine, and its contents to the nearest public weighbridge, and there have the same weighed, and upon its being proved that an infringement of the by-law has been committed the owner or driver of any such engine, vehicle, wagon, truck, or machine so required to have the same weighed as aforesaid shall pay the cost of so doing in addition to any penalty he may have incurred owing to the infringement of the by-law.

  4. The person in charge of an engine shall give immediate notice to the Road Surveyor or Clerk of the district of any damage or injury done by the engine or other motive-power, or by any vehicle, wagon, truck, or machine drawn thereby or attached thereto, to any road, or to any fence, watercourse, drain, side ditch, or other thing appertaining to any such road; and if such damage has rendered the road or its appurtenances dangerous for ordinary traffic or to public safety the owner or person in charge of such engine shall, in addition to giving such notice as aforesaid, place and maintain in such position and for such time as the Road Surveyor or Clerk of the district shall direct such signals as shall be sufficient to give warning to all persons using such road by day or night of the existence of such danger.

  5. Any damage caused by the use of any horse, bullock, engine, vehicle, wagon, truck, or machine to any bridge or culvert, or any of the walls, rails, buttresses, or supports thereof, erected or carried across any river, stream, or water-race, or to any road or its appurtenances, shall be forthwith repaired and made good by or at the expense of the owner or person having charge of such horse, bullock, engine, vehicle, wagon, truck, or machine.

  6. Every owner of a traction-engine shall cause his name and address to be painted or marked on such engine, on the off side thereof, in letters of not less than 2 in. in height, and of proportionate breadth, and of such a colour or in such a manner as to be clearly distinguishable from the colour or nature of the ground whereon such letters are painted or marked; and when such owner possesses more than one engine, a separate number distinguishing each such engine shall in like manner be painted immediately below such name and address. The exact and true weight of every engine, and the maximum weight of coals and water necessary for its propulsion, and the number and exact and true weight of every wagon, truck, or vehicle drawn by any such engine, shall also be painted in like manner upon or affixed to some conspicuous part of such engine and wagon, truck, or vehicle respectively. Every person employed in driving or conducting an engine shall, while so employed, have in his possession a printed copy of these by-laws, and he shall exhibit the same on demand to any person in charge of a horse, or vehicle drawn by a horse.

  7. The haulage or transportation on the roads within the said district of any engine or machine coming under the definition of “heavy traffic” within the meaning of clause (a) of section 130 of “The Public Works Act, 1894,” during the months of June, July, August, and September in any year shall cease.

  8. If any person shall desire to draw or carry any broken metal or rubble through the district, or through, over, or along any road within the district, by steam, horse, or any other traction whatsoever, he shall, before doing so, pay to the Clerk of the district a tax of 6d. for every cubic yard of such broken metal or rubble.

  9. Nothing herein contained shall be held to relieve owners, or employers, or drivers of engines or vehicles from liability in respect of any injury done to or damage sustained by any road which arises from a breach by them of these by-laws, or any part thereof, or from the excessive weight of any engine, vehicle, wagon, truck, or machine, or of the contents thereof, belonging to or used or driven by such owner, employer, or driver respectively,

  10. Any person committing a breach of or failing to comply with these by-laws, or any part thereof, shall for every such offence be liable to a penalty not exceeding the sum of £5.

  11. These by-laws shall come into force within the district as soon as they shall have been gazetted.

PROCLAMATION

By His Excellency the Honourable Sir Walter Francis Hely-Hutchinson, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Governor and Commander-in-Chief in and over the Colony of Natal, Vice-Admiral of the same, and Supreme Chief over the Native Population.

WHEREAS by Proclamation No. 11, bearing date the 16th day of June, 1890, the Governor, acting with the advice of the Executive Council, did, in pursuance of the provisions of Law No. 15, 1881, prohibit the introduction into this colony of all plants or cuttings of the grape-vine, or portions of such plants or cuttings, from the Colony of the Cape of Good Hope:

And whereas it is expedient to revoke the said Proclamation, and to make rules for regulating the introduction of plants and of any parts of plants which may be diseased or likely to bring disease into this colony:

Now, therefore, in pursuance of the powers vested in me by Law No. 15 of 1881, I do hereby, with the advice of the Executive Council, proclaim and make known as follows:—

  1. The above-recited Proclamation No. 11 of 1890 is hereby revoked.

  2. The rules forming the Schedule of this Proclamation, and made under the provisions of section 2 of Law No. 15 of 1881, shall be in force from the date of the promulgation of this Proclamation in the Natal Government Gazette.

  3. Any person wilfully contravening any of the said rules shall be liable to a penalty not exceeding twenty pounds, and, in default of the payment thereof, to imprisonment with or without hard labour for any term not exceeding six weeks, unless such penalty be sooner paid.

RULES MADE UNDER SECTION 2 OF LAW NO. 15, 1881.

Conditions for the Importation of Grape-vines. Cuttings, and the like, and of other Trees, Plants, Fruits, and the like.

  1. The importation of all grape-vines, cuttings, grafts, or foliage thereof, is prohibited unless imported by the Department of Agriculture.

  2. All trees and plants other than vines, and all parts thereof, and all fruit of any description, and all tubers, roots, bulbs, or portions thereof, and all packages, cases, pots, or coverings whatsoever containing such, shall, before being introduced into this colony from places beyond the boundaries thereof, undergo a strict examination by a com-
