  1. All the provisions of the said Act, so far as applicable, shall extend and apply to the lands affected by these regulations, and to the applications and leases to be made and issued thereunder, and generally to the interests created, and the persons whose rights, liabilities, or interests are thereby affected; and the mention of any particular provision of the said Act shall not be deemed to exclude any other provision of the said Act applicable to the particular case.

Additional Regulations under “The Fisheries Conservation Act, 1884.”

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-third day of July, 1900.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the powers conferred upon him by “The Fisheries Conservation Act, 1884,” His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby make the following additional regulations under the said Act, and doth hereby order and declare that such regulations shall take effect on and after the date of the publication thereof in the New Zealand Gazette.

REGULATIONS.

  1. In order to effectuate a forfeiture under the provisions of “The Fisheries Conservation Act, 1884” (hereinafter termed “the said Act”), it shall be lawful for any officer appointed under the said Act to seize and take possession of all fish unlawfully taken, and also all baskets, nets, receptacles, gear, tackle, or other apparatus which are being used, or which in the opinion of such officer are intended to be used, in contravention of the provisions of the said Act or any regulations made thereunder; and the production by such officer of his appointment shall be a sufficient warrant for his so acting in any of the cases aforesaid.

  2. Any person assaulting or obstructing any such officer in the execution of his duty under the said Act or any regulations made thereunder shall be liable to a penalty not exceeding ten pounds.

  3. Nothing contained in the regulations made on the 10th day of January, 1888, and published in the New Zealand Gazette of the 12th day of January of the same year, or in any regulations made or to be made in substitution therefor, shall be held to alter or affect any regulations made under the said Act in relation to fishing for any trout or any of the salmonidæ, or for perch or tench.

Extending Time for Preparation of Burgess Roll, Borough of Pahiatua.

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-third day of July, 1900.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS it has been made to appear that certain things required to be done by “The Municipal Corporations Act, 1886,” and “The Municipal Franchise Reform Act, 1898,” in connection with the making and revision of the burgess lists or rolls of the Borough of Pahiatua cannot be done by or within the time required by the said Acts:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities vested in him by “The Municipal Corporations Act, 1886,” and its amendments, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby extend the times for the doing of the several acts and things set forth in the Schedule hereto, and required to be done in connection with the burgess lists or rolls of the said Borough of Pahiatua, and doth hereby declare that the times for the doing of such several acts and things shall be those which are specified in the said Schedule.

SCHEDULE.

  1. Burgess list to be made out on or before the 23rd July, 1900.

  2. Burgess and defaulters’ lists open for inspection, and delivery of objections thereto, until the 30th July, 1900.

  3. Inspection of lists of objections, from the 31st July, 1900, to the 8th August, 1900.

  4. Sitting of Council to determine claims and objections, between 10th August, 1900, and 17th August, 1900.

  5. Burgess roll to come into force on the 18th August, 1900.

Revoking Warrant appointing Trustees for the West Gore Public Cemetery.

RANFURLY, Governor.

IN pursuance and exercise of the powers and authorities vested in me by the forty-fifth section of “The Cemeteries Act, 1882,” I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, do hereby revoke the warrant of the thirteenth day of February, one thousand nine hundred, appointing the Gore Borough Council to be Trustees to provide for the maintenance and care of the West Gore Public Cemetery.

As witness the hand of His Excellency the Governor, this eleventh day of July, one thousand nine hundred.

Vaccination Districts constituted.

RANFURLY, Governor.

IN pursuance and exercise of the powers vested in the Governor by “The Public Health Act, 1876,” I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, do hereby abolish the existing vaccination district known as the Riverton District, and do declare that the territory heretofore comprised within the said district is hereby divided anew into two vaccination districts, the names whereof shall be the Orepuki and Riverton Districts, and the boundaries whereof shall be coterminous with the boundaries of the marriage districts bearing the same names, as are set forth in a Proclamation of even date herewith, made under the provisions of “The Marriage Act, 1880.”

As witness the hand of His Excellency the Governor, this seventeenth day of July, one thousand nine hundred.

Changing the Purpose of a Reserve in the Nelson Land District.

RANFURLY, Governor.

WHEREAS the land described in the Schedule hereto was heretofore duly reserved for public buildings, and other purposes of the General Government, and is a reserve in Class II. of “The Public Reserves Act, 1881,” and such land has not been vested in trust in any society, body corporate, or trustees: And whereas, in the opinion of the Governor, it is expedient that such reserve shall be appropriated for the purposes of a site for a public school:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in exercise of the powers and authorities vested in me by the second section of “The Public Reserves Act Amendment Act, 1889,” do by this notification hereby declare that the said reserve shall, from and after the thirty-first day of July instant, be appropriated for the purposes of a site for a public school, under Class III. of “The Public Reserves Act, 1881”; and I do hereby direct that this notification shall be published in the New Zealand Gazette.

SCHEDULE.

All that parcel of land in the Nelson Land District, containing by admeasurement 2 acres 3 roods, more or less, being Section No. 1025, Town of Westport. Bounded towards the north partly by Section No. 1024, Town of Westport, 250 links, and partly by Henley Street, 250 links; towards the east by Russell Street, 700 links; towards the south partly by Lyndhurst Street, 250 links, and partly by Section No. 1023, Town of Westport, 250 links; and towards the west partly by said Section No. 1023, 100 links, partly
