Allocating Land reserved and taken for a Railway to the Purposes of a Road in Hawera County.

A PROCLAMATION.

WHEREAS the lands mentioned in the Schedule hereto form part of land taken for the purposes of the Foxton–New Plymouth Railway, and it is considered desirable to allocate such lands to the purposes of a road:

And whereas it has been certified by the Minister for Railways that such lands are not required for railway purposes: And whereas such lands are situated in Hawera County, the local authority of which has consented to the issue of this Proclamation, and to erect and maintain fences dividing such lands from the railway to the satisfaction of the Minister for Railways:

And whereas His Excellency the Governor is of opinion that the said local authority can conveniently construct and maintain the said road and fences:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities in me vested by section one hundred and seventy-seven of “The Public Works Act, 1894,” and of every other power and authority in anywise enabling me in that behalf, do hereby proclaim and declare that the lands described in the Schedule hereto shall, upon the publication hereof in the New Zealand Gazette, become a road, and that the said road shall be under the control of the Hawera County Council, and shall be maintained by the said Council in like manner as other public highways are controlled and maintained by the said Council.

SCHEDULE.

All that area in the Taranaki Land District, in the Ngaiere Survey District, containing 1 acre 5 perches, more or less, being a strip of land part of the railway reserve in the Town of Eltham. Bounded on the east by the eastern boundary of the said railway reserve, a distance of 2039·3 links; on the west by a line parallel to and 50 links distant from the said eastern boundary; on the north by Bridge Street; and on the south by Conway Street.

Also all that area in the Taranaki Land District, in the Ngaiere Survey District, containing 1 rood 10 perches, more or less, being a strip of land part of the railway reserve in the Town of Eltham. Bounded on the east by the eastern boundary of the said railway reserve, a distance of 650 links; on the west by a line parallel to and 50 links distant from the said eastern boundary; on the north by a line drawn at right angles to the said eastern boundary, a distance of 50 links; and on the south by Bridge Street.

As the said parcels of land are more particularly delineated on the plan marked 8471, deposited in the office of the Minister for Railways, at Wellington, and thereon coloured purple.

Given under the hand of His Excellency the Right Honourable Uchter John Mark, Earl of Ranfurly; Knight Commander of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this fourth day of May, in the year of our Lord one thousand nine hundred.

A PROCLAMATION.

IN pursuance and in exercise of the powers conferred by section thirteen of “The Land Act, 1892,” I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, with the consent of the owner and with the consent of the Patea County Council, being the local authority in whose district the said lands are situated, do by this notice hereby proclaim as a road the lands mentioned in the Schedule hereto.
