Native Land proposed to be taken for a Road in Whangara Block, County of Cook.

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this eighteenth day of January, 1899.

Present:

THE HONOURABLE W. C. WALKER PRESIDING IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work, to wit, the construction of a road in Whangara Block, County of Cook:

And whereas the said land is held or occupied by Native owners under a title which is not derived from the Crown: And whereas a map in duplicate has been prepared of the said land by the Cook County Council, as required by the eighty-eighth section of “The Public Works Act, 1894”:

Now, therefore, in pursuance and exercise of the powers vested in him by the eighty-eighth section of the said Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby declare that the land shown upon such map, and described in the Schedule hereto, shall be deemed to be taken for the purpose of the said road, and the said land shall vest in the Cook County Council as from the fifteenth day of March, one thousand eight hundred and ninety-nine.

SCHEDULE.

The parcel of land mentioned hereunder:—

Dissolving the Existing Clutha River Board.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-sixth day of January, 1899.

Present:

THE HONOURABLE A. J. CADMAN PRESIDING IN COUNCIL.

WHEREAS by section five of “The Clutha River Board Empowering Act, 1898,” it is among other things provided that the Governor in Council may dissolve the now existing Board at any time after the passing of the said Act:

Now, therefore, in pursuance and exercise of the powers and authorities conferred by the hereinbefore recited provision of “The Clutha River Board Empowering Act, 1898,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby dissolve the now existing Clutha River Board mentioned in the said Act.

Sale of Land under “The Public Works Act, 1894.”

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-sixth day of January, 1899.

Present:

THE HONOURABLE A. J. CADMAN PRESIDING IN COUNCIL.

WHEREAS by the twenty-ninth section of “The Public Works Act, 1894” (hereinafter termed “the said Act”), it is enacted that, if it is found that any land held, taken, purchased, or acquired at any time under this or any other Act or provincial Ordinance, or otherwise however, for any public work, is not required for such public work, the Governor may, by Order in Council publicly notified and gazetted, cause the same to be sold under the conditions set forth in the said Act: And whereas a memorial has been laid before the Governor by the Dunedin City Council, accompanied by a map, setting forth that there is vested in the Corporation of the Mayor, Councillors, and Citizens of the City of Dunedin, for waterworks purposes, certain land, viz., Section 43, Block V., Dunedin and East Taieri District: And whereas the portion of said land described in the Schedule hereto is not now required by the said Corporation for waterworks purposes or otherwise, and the said Corporation desires to sell the same:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance of the powers and authority conferred upon him by the said Act, and by and with the advice and consent of the Executive Council of the said colony, doth hereby direct the sale of the land described in the Schedule hereto.

SCHEDULE.

All that area in the Otago Land District, containing by admeasurement 3 roods 18·5 perches, more or less, and being part of Section No. 43, Block V., Dunedin and East Taieri Survey District; as the same is delineated upon the plan marked S.G. 37350, deposited in the Head Office, Department of Lands and Survey, at Wellington, in the Wellington Land District, and thereon coloured red.

Exchange of Land in Canterbury.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-sixth day of January, 1899.

Present:

THE HONOURABLE A. J. CADMAN PRESIDING IN COUNCIL.

WHEREAS the land mentioned in the first column of the Schedule hereto was reserved for Provincial Government purposes: And whereas, in the opinion of the Governor, it is expedient to exchange the said land for that mentioned in the second column of the Schedule hereto:

Now, therefore, His Excellency the Earl of Ranfurly, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” and the third section of “The Public Reserves Act Amendment Act, 1889,” doth hereby declare that, from and after the day of the date hereof, the said reserve mentioned in the first column of the Schedule hereto may be exchanged for the land mentioned in the second column of the Schedule hereto.

SCHEDULE.

Description of Reserve intended to be exchanged. Description of Land to be obtained in Exchange therefor.
All that parcel of land in the Canterbury Land District, containing 83 acres 2 roods 24 perches, more or less, being that portion of Reserve 1774 bounded as follows: Towards the north-east by the road forming the north-eastern boundary of R.S. 25108, a distance of 1535·9 links; towards the north-west by the Main South Railway Reserve, a distance of 5411·8 links; towards the south-west by a line at right angles to said railway reserve, a distance of 1500 links; and towards the south-east by the northern boundary of R.S. 25108, a distance of 5742 links. All that parcel of land in the Canterbury Land District, containing 83 acres 2 roods 24 perches, more or less, being a strip of land 533·8 links wide following the south-western boundaries of Lots 3, 4, and 7 of deposited Plan 1018, subdivision of R.S. 25108, and forming portion of said lots, excepting therefrom two rights-of-way, each 1 chain wide, giving access to said Lots 4 and 7 from road on western boundary of the above-described land.
