THE following notice, received from the Mayor of the Borough of Wanganui, is published in accordance with the provisions of “The Municipal Corporations Act, 1886.”

In the matter of “The Municipal Corporations Act, 1886,” Part IX.
To the Hon. the Colonial Secretary, Wellington.
I, ALEXANDER HATRICK, Mayor of the Borough of Wanganui, do hereby, in pursuance of the provisions of section 184 of the above Act, give you notice that on the 6th day of October, 1899, a poll of the burgesses of the said borough was taken under the provisions of the said Act on a proposal of the Council of the said borough to borrow the sum of £16,000 by way of special loan under the provisions of the said Act, a copy of which proposal is next hereinafter set out.
WANGANUI BOROUGH COUNCIL.
Proposed Special Loan of £16,000.
I hereby give notice that the Wanganui Borough Council proposes to borrow by way of special loan, under the provisions of “The Municipal Corporations Act, 1886,” the sum of £16,000, to be applied and appropriated as follows:—
(1.) As to £5,600, part of the said loan, for the purpose of constructing and forming streets.
(2.) As to £1,960, part of the said loan, for the purpose of constructing kerbing and channels for streets and footpaths.
(3.) As to £1,440, part of the said loan, for the purpose of constructing and forming footpaths.
(4.) As to £3,500, part of the said loan, for the purpose of providing an efficient system of drainage for such parts of the borough as are not now efficiently drained, and for extending the present system of drainage.
(5.) As to £3,500, part of the said loan, for the purpose of constructing waterworks, and extending waterworks hitherto acquired.
And I further give notice that the Council proposes to establish a sinking fund during the currency of the loan, for or towards payment of such loan at its maturity, of an amount representing 2 per cent. of the amount for the time being of the said loan actually borrowed, and also proposes, for the purposes of providing funds for the creation of such sinking fund, to permanently appropriate out of the general rates of the borough in each year, to be payable by equal half-yearly payments on the 1st day of November and May in each such year, an amount representing 2 per cent. of the amount of the said loan then actually borrowed.
And I further give notice that the Council proposes to pledge as a security for such loan the rents and profits from all freehold property vested in the Corporation of the Borough of Wanganui, excepting so much of the rents for the time being payable in respect of the land known as the Wanganui Town Belt as has been already pledged to provide for the payment of a special loan of £4,000 and the interest thereon authorised on the 11th day of August, 1898, by a poll of the burgesses of the Borough of Wanganui: Provided that the Council shall pledge as such security as aforesaid only so much of such rents and profits as shall for the time being be payable in respect of the said freehold property (except as before mentioned) as shall be sufficient from time to time to pay the interest payable in respect of such loan, and as shall be sufficient to pay the principal moneys when due, but so that such security shall rank as a floating charge only on the said rents and profits, and that accordingly no portion thereof shall be set aside, or be liable to be taken or set aside, unless and until default shall be made in the payment of any interest or principal money, and then only to such an extent as may be necessary to pay such interest or principal money as the case may be. And so that, until default shall be made in the payment of any interest or principal money, the Council may use and deal with all such rents and profits as they become payable as part of the borough fund and as if they were not pledged as security. And, further, that debentures be issued for such loan, each to be payable on the 1st day of November, 1914.

And I also give you notice that the following was the result of the said poll—Number of burgesses who voted in favour of the said proposal, 735; number of votes to which the said burgesses were entitled, 735: number of burgesses who voted against the said proposal, 17; number of votes to which the last-mentioned burgesses were entitled, 17: number of informal votes, 2—and that, the total number of burgesses upon the roll being 1,258, and the total number of votes to which they were entitled being 1,258, I declared the said proposal carried. And I hereby give you notice that the said proposal was carried.

In the matter of “The Municipal Corporations Act, 1886,” Part IX.
I, Alexander Hatrick, of the Town of Wanganui, Merchant, Mayor of the Borough of Wanganui, do solemnly and sincerely declare,—

That all proceedings required by the said Act to be taken in or towards obtaining the sanction of the burgesses of the Borough of Wanganui to a proposal of the Council of the said borough to borrow the sum of £16,000 by way of special loan under the provisions of the said Act (a copy of which proposal is contained in the voting-paper hereto annexed, and marked “A”)* have been duly taken.

That upon a poll of the said burgesses taken on the 6th day of October, 1899, the said proposal was duly carried.
And I make this solemn declaration conscientiously believing the same to be true, and by virtue of the provisions of an Act of the General Assembly of New Zealand intituled “The Justices of the Peace Act, 1882.”

Uruti Road Loan, £250.
Result of poll taken on the 14th day of October, 1899, upon the proposal to borrow £250, under “The Government Loans to Local Bodies Act, 1886,” to form a portion of the Uruti Road, from Section 3 to Section 13, Block II., Upper Waitara Survey District:—
Number of ratepayers on special roll, 6, exercising 6 votes: Number of votes recorded in favour of proposal, 4; number of votes recorded against proposal, 0; number of ratepayers who did not vote, 2, exercising 2 votes.
I therefore declare the above proposal to be carried.
