Fixing Sitting of Court of Appeal.

ORDER IN COUNCIL.
At the Government House, at Wellington, this eleventh day of September, 1899.

WHEREAS by “The Court of Appeal Act, 1882,” it is enacted that the Court shall hold its sittings at such times and places as shall from time to time be fixed by the Governor in Council, and proclaimed in the Government Gazette twenty-one days at least before the times so fixed respectively:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby fix that a sitting of the Court of Appeal of New Zealand shall be held within the Supreme Court House, in the City of Wellington, upon Monday, the ninth day of October, one thousand eight hundred and ninety-nine, at eleven o’clock in the forenoon.

Excepting Land from Operation of Section 117 of “The Native Land Court Act, 1894.”

ORDER IN COUNCIL.
At the Government House, at Wellington, this eleventh day of September, 1899.

WHEREAS by section four of “The Native Land Laws Amendment Act, 1895,” it is enacted that the Governor may, by Order in Council, except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894” (hereinafter called “the said Act”), for a limited period or otherwise, and either generally or for such purposes and subject to such restrictions as shall be in such Order specified, any land, wheresoever situate, which is for the time being subject to the operation of the said section, or any interest therein or right over the same, or may in like manner make such exception in favour exclusively of any lessee or other person who has been bona fide in occupation of and has made improvements on such land, or has paid money to Native owners for lease or purchase thereof, prior to the passing of the said Act: Provided that no Order in Council under the provisions of this section shall take effect until after the expiration of two months from the date of the publication thereof in the Gazette: Provided also that every alienation under the provisions of this section shall be confirmed by the Court in terms of section fifty-three of the said Act:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority conferred by section four of “The Native Land Laws Amendment Act, 1895,” and by and with the advice and consent of the Executive Council of the said colony, doth hereby except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of sale, all that block or parcel of land, situate in the District of Auckland, containing two acres three roods twenty-one perches, more or less, known as Waingunguru, and being the land comprised in an order of the Native Land Court dated the 24th September, 1898, in favour of Kepa Raharuhı and others.

Authorising Licensing Committee to grant a Publican’s License.

ORDER IN COUNCIL.
At the Government House, at Wellington, this eleventh day of September, 1899.

WHEREAS by the fifth section of “The Alcoholic Liquors Sale Control Act, 1893,” it is among other things enacted that when the population of any riding of a county wherein the whole of “The Counties Act, 1886,” is in force has suddenly increased in a large degree, and a petition signed by not less than one hundred residents thereof has been presented to the Governor, praying that power be granted to the Licensing Committee to issue a license or licenses therein, the Governor may, unless the determination of the electors has been previously made that no licenses shall be granted, by Order in Council grant such authority as in the said section mentioned: And whereas the population of the Waitekauri Riding of the County of Ohinemuri (being a county wherein the whole of “The Counties Act, 1886,” is in force) has suddenly increased in a large degree, and the said riding is situate in the Ohinemuri Licensing District as now constituted by law: And whereas a petition has been presented to the Governor, signed by not less than one hundred residents of the said riding, praying that power may be granted to the Licensing Committee of the Ohinemuri Licensing District to grant publicans’ licenses within the said riding: And whereas no determination of the electors in the said riding has been previously made that no licenses shall be granted in the said district:
Now, therefore, in pursuance and exercise of the power and authority conferred by “The Alcoholic Liquors Sale Control Act, 1893,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby authorise and empower the Committee of the Ohinemuri Licensing District, should it think fit so to do, to issue a publican’s license at Golden Cross, in the said Waitekauri Riding, in the manner prescribed by the said Act.

Amending Regulations for Trout-, Perch-, and Tench-fishing, Southern Acclimatisation District.

ORDER IN COUNCIL.
At the Government House, at Wellington, this eleventh day of September, 1899.

His Excellency the Governor in Council.
WHEREAS by an Order in Council dated the seventh day of September, one thousand eight hundred and ninety-two, and published in the New Zealand Gazette of the eighth day of September then instant, certain regulations were made under “The Fisheries Conservation Act, 1884” (hereinafter termed “the said Act”), providing for trout-, perch-, and tench-fishing within the Southern Acclimatisation District as therein defined: And whereas it is expedient to extend the time within which trout, perch, and tench may be caught in the said district:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise of the powers conferred by the said Act, and of all other powers enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that, notwithstanding anything contained in the said recited regulations, any holder of a license issued thereunder may fish with one rod and line for trout, perch, and tench within the Southern Acclimatisation District from the first day of October in any one year to the thirtieth day of April in the year following, subject in all other respects to the conditions prescribed by the said regulations.
