Exempting Lands under “The Native Land Laws Amendment Act, 1897.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this thirty-first day of July, 1899.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section five of “The Native Land Laws Amendment Act, 1897,” it is enacted that, for the purpose of giving full effect to sections three, four, and five of the said Act, the Governor in Council may exempt any land from all or any of the restrictions, limitations, or provisions of “The Native Land Court Act, 1894,” or any other Act affecting Native lands or lands owned or held by Natives: And whereas Wiremu Pere, Arapera Pere, Hetekia Pere, Moanaroa Pere, Riria Mauaranui, and Rerepeta Rangikohere, all of Gisborne, in the District of Poverty Bay, aboriginal natives, being entitled to the various lands and hereditaments described in the Schedule hereto by deed of conveyance upon trust dated the fourteenth day of April, one thousand eight hundred and ninety-nine, and expressed to be made between the said Wiremu Pere, Arapera Pere, Hetekia Pere, Moanaroa Pere, Riria Mauaranui, and Rerepeta Rangikohere, of the one part, and Walter George Foster, of the City of Wellington, gentleman, of the other part, and by various subsidiary conveyances, transfers, and other assurances intended to give full effect to the said conveyance upon trust, did convey and assure, transfer, and set over unto the said Walter George Foster the said lands and hereditaments described in the Schedule hereto upon terms as to sale, leasing, managing, improving, raising money upon the same, and otherwise, which have been agreed upon between the said Natives and the said Walter George Foster, and are set out at length in the said conveyance upon trust: And whereas, for the purpose of giving full effect to the provisions of the said deed of trust, it is desirable that the lands affected by the said deed of trust should be exempted from certain provisions of “The Native Land Court Act, 1894,” “The Native Land Laws Amendment Act, 1895,” “The Native Land Laws Amendment Act, 1896”:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the power and authority conferred on him by the said fifth section of “The Native Land Laws Amendment Act, 1897,” and of all other powers and authorities him thereunto enabling, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby exempt the lands described in the Schedule hereto from the following provisions of “The Native Land Court Act, 1894,” “The Native Land Laws Amendment Act, 1895,” and “The Native Land Laws Amendment Act, 1896”—that is to say, sections fifty-three, fifty-four, fifty-five, one hundred and seventeen, and one hundred and eighteen of “The Native Land Court Act, 1894”; sections three, five, six, nine, thirteen, and fourteen of “The Native Land Laws Amendment Act, 1895”; and section twenty-seven of “The Native Land Laws Amendment Act, 1896.”
