Closing Burial-grounds at Onehunga.

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this sixth day of February, 1899.

Present:

His Excellency the Governor in Council.

WHEREAS it having been made to appear to the Governor that the Council of the Borough of Onehunga has, in pursuance of the provisions of section four of “The Onehunga Cemetery Act, 1898” (hereinafter termed “the said Act”), declared the land described in the Second Schedule to the said Act to be opened as a public cemetery, it is now expedient to give effect to the provisions contained in the said section as hereinafter set forth:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the fourth section of the said Act, and by the seventy-third section of “The Cemeteries Act, 1882,” and by and with the advice and consent of the Executive Council of the said colony, doth hereby declare and direct that, from and after the eighth day of August now next ensuing, burials in the existing burial-grounds in Queen Street and Church Street, respectively described in the First Schedule to the said Act (and also in the Schedule to this Order in Council), shall be wholly discontinued, subject, however, to sections seventy-five to eighty-one of “The Cemeteries Act, 1882.”

SCHEDULE.

EXISTING BURIAL-GROUNDS.

  1. All that parcel of land fronting Church and Queen Streets, in the Town of Onehunga, in the Land District of Auckland, comprising 1 acre, more or less, being Allotment No. 9, Block XVIII., of the said town.

  2. All that parcel of land fronting Albert and Church Streets, in the Town of Onehunga, in the Land District of Auckland, comprising 1 acre, more or less, being Allotment No. 9, Block X., of the said town.

Appointing Day for closing under “The Shops and Shop-assistants Act, 1894.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this eighth day of February, 1899.

Present:

His Excellency the Governor in Council.

WHEREAS the local authority of the Borough of Feilding, being duly authorised by “The Shops and Shop-assistants Act, 1894,” to appoint by special resolution, in the month of January, one thousand eight hundred and ninety-nine, the day on which shops in the said borough are to be closed in accordance with the said Act, has failed so to appoint a day:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, acting by and with the consent of the Executive Council of the said colony, and in exercise of the powers in this behalf conferred upon me by section ten of the said Act, do hereby appoint Wednesday to be the day on which shops shall be closed in the said Borough of Feilding, in accordance with the said Act.

Native Land proposed to be taken for a Road in Whangara Block, County of Cook.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this eighteenth day of January, 1899.

Present:

The Honourable W. C. Walker presiding in Council.

WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work, to wit, the construction of a road in Whangara Block, County of Cook:

And whereas the said land is held or occupied by Native owners under a title which is not derived from the Crown:

And whereas a map in duplicate has been prepared of the said land by the Cook County Council, as required by the eighty-eighth section of “The Public Works Act, 1894”:

Now, therefore, in pursuance and exercise of the powers vested in him by the eighty-eighth section of the said Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby declare that the land shown upon such map, and described in the Schedule hereto, shall be deemed to be taken for the purpose of the said road, and the said land shall vest in the Cook County Council as from the fifteenth day of March, one thousand eight hundred and ninety-nine.

The Honourable A. J. Cadman presiding in Council.

WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work, to wit, for the purposes of a road in Kokohuia Block, Hokianga Survey District:

And whereas the said land is held or occupied by Native owners under a title which is not derived from the Crown:

And whereas a map in duplicate has been prepared of the said land by the Hokianga County Council, as required by the eighty-eighth section of “The Public Works Act, 1894”:

Now, therefore, in pursuance and exercise of the powers vested in him by the eighty-eighth section of the said Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby declare that the land shown upon such map, and described in the Schedule hereto, shall be deemed to be taken for the purposes of the said road, and the said land shall vest in the Hokianga County Council, as from the sixteenth day of March, one thousand eight hundred and ninety-nine.
