Land set apart for State Forest Purposes in the Land District of Auckland.

A PROCLAMATION.

BY virtue and in exercise of the powers and authorities vested in me by “The New Zealand State Forests Act, 1885,” and of every other power and authority enabling me in that behalf, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, do hereby set apart the land described in the Schedule hereto, forming part of the Crown lands in New Zealand, as and for a State forest within the provisions of the said Act.


SCHEDULE.

AUCKLAND.

All that area in the Auckland Land District, being Sections Nos. 2 and 9 of Block XV., Wairere Survey District, and Section No. 4 of Block IV., Tapapa Survey District, containing by admeasurement 1,436 acres, more or less. Bounded towards the north by the Wairere Stream; towards the north-east by the Okauia No. 1 Block (A portion), 1043, 1671, 6947, and 23019 links; towards the south by the Okauia No. IV. Block, 7430 links; and towards the west generally by Section No. 1 of Block IV., Tapapa Survey District, 10277 links, by a public road, 183, 641, 24, and 498 links, by Section No. 6 of Block XV., Tapapa Survey District, 1580 and 5455 links, by Section No. 4 of the same block, 5549, 768, and 1146 links, by the abutment of a road and Section No. 3 of the same block, 301 links, by said Section No. 3, 5173 and 6792 links, and by the northern boundary of said Section No. 3, and its production in a westerly direction to the Wairere Stream, 2609 links, to the point of commencement: be all the aforesaid linkages more or less.

Proclaiming the Pelorus River, in the Land District of Marlborough, and the Okari River, in the Land District of Nelson, together with their Tributaries, to be Watercourses.

A PROCLAMATION.

WHEREAS by the one-hundred-and-fifty-second section of “The Mining Act, 1891” (hereinafter termed “the said Act”), it is enacted that the Governor in Council may from time to time, by Proclamation published in the Gazette, proclaim and declare that any watercourse shall be a watercourse into which tailings, mining débris, and waste water of any kind used in, upon, or discharged from any claim or licensed holding shall be suffered to flow or be discharged:

And whereas not less than ninety days’ notice has been published, in the manner provided by the said section, that application has been made to the Governor to proclaim the watercourses hereinafter mentioned, and their tributaries, to be watercourses for the purposes of the said section mentioned:

And whereas His Excellency the Governor has decided to exercise the powers conferred upon him by the said Act:

Now, therefore, His Excellency Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in exercise of the powers conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby proclaim and declare that the following rivers and all their tributaries, in the Land Districts of Marlborough and Nelson, shall be watercourses into which tailings, mining débris, and waste water of every kind used in, upon, or discharged from any claim or licensed holding adjacent to such watercourses shall be suffered to flow or be discharged; and, with the like advice and consent, His Excellency doth hereby prescribe that this Proclamation shall take effect on and after the eighteenth day of January, one thousand eight hundred and ninety-nine.

MARLBOROUGH LAND DISTRICT.

That river known as the Pelorus River, which flows easterly from its source near Slaty Peak for a distance of about thirty-six miles to Pelorus Sound, together with the tributaries thereof.

NELSON LAND DISTRICT.

That river known as the Okari River, which rises in the spurs of Buckland Peaks, and flows into the Tasman Sea at the outlet of what is known as the Totara Lagoon, on the Nine-mile Beach; together with the tributaries thereof.

Terms and Conditions of Lease of Village-homestead Allotments in Wellington.

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this tenth day of October, 1898.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the one-hundred-and-sixty-ninth section of “The Land Act, 1892,” it is enacted that the Governor in Council may fix the terms and conditions upon which the lands in any village settlement shall be disposed of, subject as in the said section is provided: And whereas by a Proclamation made under the said Act on the nineteenth day of September, one thousand eight hundred and ninety-eight, and published in the New Zealand Gazette on the twenty-second day of September, one thousand eight hundred and ninety-eight, the lands described in the First Schedule hereto have been set apart under the said Act and declared open for lease as village-homestead allotments, and it is expedient to fix the terms and conditions upon which the said lands shall be disposed of:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities conferred by the said Act, and by and with the advice and consent of the Executive Council of the said colony, doth hereby fix the terms and conditions on which the lands mentioned in the First Schedule hereto shall be disposed of by way of lease in perpetuity, and which said terms and conditions are set forth in the Second Schedule hereto, and also doth direct that the lands shall be leased as village-homestead allotments only.
