Additional Regulation under “The Native Townships Act, 1895.”

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this tenth day of October, 1898.

Present:

His Excellency the Governor in Council.

WHEREAS by “The Native Townships Act, 1895” (hereinafter called “the said Act”), it is enacted that the Governor in Council may from time to time make such regulations as he thinks fit as to the mode in which shall be done anything by the said Act expressed to be prescribed, and, generally, for the purpose of giving full effect to the provisions thereof; and also that such regulations shall be laid before both Houses of Parliament forthwith, if sitting, and, if not sitting, within twenty-one days after the beginning of the session; and also that such regulations shall, if either House pass a resolution disapproving of them, cease to have any validity or force:

Now, therefore, in exercise of the powers in this behalf conferred upon me by the said Act, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, with the advice and consent of the Executive Council, do hereby make the regulation following for the purpose aforesaid, in addition to the regulations prescribed by the Order in Council issued on the fourth day of February, one thousand eight hundred and ninety-six:—

  1. Money to the credit of the Native Township Account of any Native township under the said Act which, in terms of section 20, is due to any Native owners whose proportionate shares have been determined by the Native Land Court may be paid to any such Native owner by the Commissioner of Crown Lands, at such place, and on the 31st day of March or 30th September in each year, as shall be notified one month beforehand in the Gazette and also in the Kahiti.

A copy of the order of the Native Land Court made in partition, signed by the Registrar, shall be sufficient evidence of the ownership of any Native owner named therein; and, in cases where the Native owner is not able to attend at the place and date notified, it is competent for the Commissioner to pay to any such owner, at any time thereafter, on his being satisfied of his identity, such rent as is due to him or her, or to pay to an agent who shall present an order in the following form:—

Croydon Bush Recreation-ground brought under “The Public Domains Act, 1881.”

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this tenth day of October, 1898.

Present:

His Excellency the Governor in Council.

BY virtue of the powers and authorities vested in me by the twenty-fourth section of “The Public Reserves Act, 1881,” I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, do hereby order and declare that the reserve made for public recreation in the Southland Land District, and described in the Schedule hereto, shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of “The Public Domains Act, 1881”; and such domain shall hereafter be managed, administered, and dealt with in manner directed by the said Act.

SCHEDULE.

All that parcel of land in the Southland Land District, containing by admeasurement 319 acres 2 roods, more or less, being Section No. 819, Hokonui Survey District. Bounded towards the north by Crown lands and a road-line, 2419, 652·5, 441, 320·5, 210·4, and 354·6 links respectively; towards the east and south-east by Sections Nos. 754, 757, 765, 764, 763, 768, 769, and road-line, Hokonui Survey District, 2944·9, 28·4, and 5833·6 links respectively; towards the south-west by Crown lands, 7088·2 links; and towards the north-west by Section No. 423, Hokonui Survey District, 3500 links: be all the aforesaid linkages more or less: as the same is delineated on the plan deposited in the office of the Chief Surveyor, Invercargill.

Powers delegated to the Croydon Bush Domain Board under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this tenth day of October, 1898.

Present:

His Excellency the Governor in Council.

WHEREAS by the twelfth section of “The Public Domains Act, 1881,” it is, inter alia, enacted that the Governor, by Order in Council, may from time to time delegate all or any of the powers by the said Act conferred, save as is therein mentioned, to any person or persons, for any period, and subject to such stipulations as may be specified in such Order, and that every such delegation may from time to time in like manner be altered or revoked: And whereas, pursuant to “The Public Reserves Act, 1881,” by an Order in Council of even date herewith, the land known as Section No. 819, Hokonui Survey District, and described in the Schedule thereto, is declared to be brought under the operation of and to be subject to the provisions of the said “Public Domains Act, 1881”:

Now, therefore, His Excellency the Governor, by and with the advice and consent of the Executive Council of the Colony of New Zealand, doth by this present Order delegate all the powers conferred by the Act first above mentioned, except the powers under or conferred by sections five and twelve thereof, to

The Gore Borough Council,

which shall be known as the Croydon Bush Domain Board (hereinafter referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business once in each month, at the Borough Council Office, Gore. The first meeting shall be held on Monday, the seventh day of November, one thousand eight hundred and ninety-eight. The annual meeting will be held on the third Monday in January in every year.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  3. Any three of the said Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The Mayor of the borough shall be Chairman of the Board. He may join in the discussion, and shall have an original as well as a casting vote.

  5. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.

  6. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.
