Allocating Land reserved and taken for a Railway to the Purposes of a Road in Waitaki County.

A PROCLAMATION.

WHEREAS the land mentioned in the Schedule hereto forms part of land taken for the purposes of the branch line of railway from the main line of the Waitaki-Bluff Railway to Ngapara, Livingston Branch, and it is considered desirable to allocate such land to the purposes of a road:

And whereas it has been certified by the Minister for Railways that such land is not required for railway purposes: And whereas such land is situated in Waitaki County, the local authority of which has consented to the issue of this Proclamation:

And whereas His Excellency the Governor is of opinion that the said local authority can conveniently construct and maintain the said road:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities in me vested by section one hundred and seventy-seven of “The Public Works Act, 1894,” and of every other power and authority in anywise enabling me in that behalf, do hereby proclaim and declare that the land described in the Schedule hereto shall, upon the publication hereof in the New Zealand Gazette, become a road, and that the said road shall be under the control of the Waitaki County Council, and shall be maintained by the said Council in like manner as other public highways are controlled and maintained by the said Council.

SCHEDULE.

ALL that area in the Otago Land District, in the Maru-wenua Survey District, containing 1 rood 38·8 perches, more or less, being a piece of railway land situate at Tokarahi Station, on the said Livingston Branch Railway, comprising part of Section 1, and of P.R. 5763, and of an old road, in Block VIII., in the said survey district, and being bounded as follows: Commencing at a point on the southern boundary of the Railway-station Reserve distant 536·7 links from the south-west corner thereof; thence southerly on a line bearing 193° 1′, a distance of 458·5 links, to a road; thence easterly along the northern side of the said road, a distance of 100·2 links; thence northerly on a line bearing 13° 1′, a distance of 465 links; and thence westerly on a line bearing 283° 1′, a distance of 100 links, to the commencing-point: as the said parcel of land is more particularly delineated on the plan marked 8034, deposited in the office of the Minister for Railways, at Wellington, and thereon coloured purple.

Given under the hand of His Excellency the Right Honourable Uchter John Mark, Earl of Ranfurly;

Knight Commander of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this sixth day of October, in the year of our Lord one thousand eight hundred and ninety-eight.

Revoking a Proclamation.

A PROCLAMATION.

IN pursuance and in exercise of the powers conferred by the one-hundred-and-sixty-second section of “The Land Act, 1892,” and of all other powers and authorities enabling me in this behalf, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, do by this notice hereby revoke that part of a Proclamation dated the second day of October, one thousand eight hundred and ninety-four, and published in the New Zealand Gazette No. 72, dated the fourth day of October, one thousand eight hundred and ninety-four, setting apart land for the Tongaporutu Improved-farm Settlement, as set forth in the Schedule hereto.
