Excepting Lands from Operation of Section 117 of “The Native Land Court Act, 1894.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this first day of August, 1898.

Present:

His Excellency the Governor in Council.

WHEREAS by section four of “The Native Land Laws Amendment Act, 1895,” it is enacted that the Governor may by Order in Council except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894” (hereinafter called “the said Act”), for a limited period or otherwise, and either generally or for such purposes and subject to such restrictions as shall be in such Order specified, any land, wheresoever situate, which is for the time being subject to the operation of the said section, or any interest therein or right over the same, or may in like manner make such exceptions in favour exclusively of any lessee or other person who has been bonâ fide in occupation of and has made improvements on such land, or has paid money to Native owners for lease or purchase thereof prior to the passing of the said Act: Provided that no Order in Council under the provisions of this section shall take effect until after the expiration of two months from the date of the publication thereof in the Gazette: Provided also that every alienation under the provisions of this section shall be confirmed by the Court in terms of section fifty-three of the said Act:

And whereas Airini Donnelly, of Crissoge, in the Provincial District of Hawke’s Bay, in the Colony of New Zealand, being the registered proprietor of the several blocks or parcels of land mentioned and particularised in the Schedule hereto, has applied to be allowed to mortgage the said lands:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities conferred by the Act aforesaid, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of mortgage, the said several blocks of land set out in the Schedule hereto.

SCHEDULE.

FIRSTLY, all that piece or parcel of land, situate in the Provincial District of Wellington, containing 3,125 acres, more or less, known as Mangaohane No. 1o, and being the whole of the land comprised in certificate of title, Vol. lxxxi., folio 52.

Secondly, all that piece or parcel of land, situate in the Provincial District of Wellington, containing 81 acres, more or less, known as Mangaohane No. 1p, and being the whole of the land comprised in certificate of title, Vol. lxxxi., folio 53.

Thirdly, all that piece or parcel of land, situate in the said Provincial District of Wellington, containing 1,275 acres, more or less, known as Mangaohane No. 1n, and being the whole of the land comprised in certificate of title, Vol. lxxxi., folio 54.

Fourthly, all that piece or parcel of land, situate in the said Provincial District of Wellington and in the Provincial District of Hawke’s Bay, containing in the aggregate 11,891 acres, more or less, and being the whole of the land comprised in certificate of title, Vol. lxxxi., folio 56, Wellington Register, and certificate of title, Vol. xxxv., folio 35, Hawke’s Bay Register.

Extension of Time for Preparation of County Rolls, Selwyn.

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this first day of August, 1898.

Present:

His Excellency the Governor in Council.

WHEREAS it has been made to appear that owing to unavoidable circumstances the preparation of the rolls for the County of Selwyn, and the taking of certain steps consequent on such preparation, cannot be made and taken within the times limited by “The Counties Act, 1886,” and it is expedient to extend the said times respectively:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the powers conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the several dates mentioned in the Schedule hereto shall be the respective dates for taking the several steps set out in the said Schedule.

SCHEDULE.

  1. For preparing the rolls for ridings within the County of Selwyn: Until the 1st September, 1898.

  2. Time for which such rolls shall be open for inspection: From the 3rd September, 1898, to the 30th September, 1898.

  3. Time for appeals against the said rolls: Until the 30th September, 1898.

  4. Revision Courts may sit for hearing applications with reference to the said rolls, and adjourn: Until the 31st October, 1898.

  5. Time when the said rolls, having been duly corrected and signed, shall come into force: On the 1st November, 1898.

Rural Lands in the Southland Land District open for Selection on Lease in Perpetuity.

RANFURLY, Governor.

IN pursuance and exercise of the powers and authorities conferred upon me by “The Land for Settlements Act, 1894,” and the one-hundred-and-thirty-sixth section of “The Land Act, 1892,” I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, having received the report of the Surveyor-General in this behalf, as in the said one-hundred-and-thirty-sixth section is provided, do hereby declare that the rural lands enumerated in the Schedule hereto shall be open for selection on and after the eighth day of September, one thousand eight hundred and ninety-eight; and that the said lands may be selected on lease in perpetuity, subject to the provisions of “The Land Act, 1892”; and I do hereby declare that the rentals at which the said lands shall be leased shall be those mentioned in the said Schedule hereto opposite the description of such lands respectively.

Warrant vesting Control of a Portion of the Great South Road in the Papakura Road Board, and apportioning Cost of Constructing and Maintaining the Same.

RANFURLY, Governor.

WHEREAS by section one hundred and seven of “The Public Works Act, 1894,” it is provided that the Council of any county may by special order declare that all or any part of any district road shall, from and after a date to be fixed therein, be under the exclusive control of such local authority within the said county as shall be mentioned in such special order, and may by the same special order direct that the cost of constructing and maintaining any such road or part of a road shall be borne by the local authority to which the exclusive control thereof is given, or that a portion of such cost, to be fixed in and by such special order, shall be borne by any other local authority or authorities:
