Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority conferred upon him by section three of “The Native Land Laws Amendment Act, 1897,” and of every other power or authority in anywise enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby appoint the said Freeman Rayney Jackson and Frederic Augustus Krull, and the survivor of them, and the executors and administrators of such survivor, to be the trustees and trustee under the said section for the said Raumaewa te Rango, upon the terms as to sale, leasing, managing, improving, and raising money upon the said lands which have been agreed upon between the said Raumaewa te Rango and Freeman Rayney Jackson and Frederic Augustus Krull, and have been embodied in the said deed of trust. And His Excellency the Governor, in pursuance and exercise of the power and authority conferred upon him by section five of “The Native Land Laws Amendment Act, 1897,” and of every other power or authority in anywise enabling him in that behalf, and by and with the like advice and consent, doth hereby exempt the said lands from all of the restrictions, limitations, and provisions of “The Native Land Court Act, 1894,” to the intent that the said lands may be conveyed to the said trustees and dealt with by them in accordance with the said deed of trust in the same manner and to the same extent as if the same were lands owned by a European and so conveyed in trust.

Appointing Trustees for Native Lands, and exempting such Lands from Restrictions.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-fifth day of July, 1898.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by section three of “The Native Land Laws Amendment Act, 1897,” it is enacted that “Any Native or Natives, whether incorporated or otherwise, owning land under title of any description, may convey the same, or any defined part thereof, by way of trust, to the Surveyor-General or the Commissioner of Crown Lands for the district in which such land is situate, or to some other fit person appointed by the Governor in Council, upon such terms as to sale, leasing, managing, improving, and raising money upon the same as may be agreed upon between the parties, or as may be declared by the Governor in Council; and the Surveyor-General or Commissioner of Crown Lands, or other the person as aforesaid (hereinafter called ‘the trustee’), is hereby authorised to accept such trust”: And whereas Ani Paki, of Moawhango, Inland Patea, is the owner of the lands particulars whereof are set forth in the Schedule hereto: And whereas the said Ani Paki, being desirous of conveying the said lands by way of trust to Freeman Rayney Jackson and Frederic Augustus Krull, trading together in copartnership at Wanganui as “Freeman R. Jackson and Co.,” has applied to His Excellency the Governor to appoint the said persons to undertake such trust: And whereas the terms of such trust as to sale, leasing, managing, improving, and raising money upon the said lands have been set forth in a deed bearing even date herewith, and made between the said Ani Paki of the one part and the said Freeman Rayney Jackson and Frederic Augustus Krull of the other part: And whereas by section five of the said “The Native Land Laws Amendment Act, 1897,” it is enacted that “for the purposes of giving effect to the provisions of this and the two last-preceding sections hereof the Governor in Council may from time to time make such regulations as he may deem necessary, and may also exempt any land from all or any of the restrictions, limitations, or provisions of ‘The Native Land Court Act, 1894,’ or any other Act affecting Native lands or lands owned or held by Natives”: And whereas it is expedient for the purposes aforesaid that the said lands be exempted from all the restrictions, limitations, or provisions of “The Native Land Court Act, 1894”:

“The Education Act, 1877.”—Payments to Education Boards.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-fifth day of July, 1898.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
IN exercise and pursuance of the powers and authorities vested in him by “The Education Act, 1877,” His Excellency the Governor, with the advice and consent of the Executive Council of the colony, doth hereby make the regulation hereto annexed regarding certain payments of capitation allowance to Education Boards; and, with the like advice and consent, doth hereby prescribe that this Order shall come into force on the date of the first publication thereof in the New Zealand Gazette.
REGULATION.
Notwithstanding anything to the contrary contained in an Order in Council made on the 5th day of January, 1888, under the provisions of “The Education Act, 1877,” relating (inter alia) to attendance registers and returns, the payment of capitation allowance to Education Boards for the quarter ending on the 30th day of September, 1898, shall be according to the working-average attendance of the quarter ending on the 30th day of June, 1898, as working average was defined by Order in Council dated the 5th day of July, 1887, and made under the provisions of the before-mentioned Act.
