THIRD SCHEDULE.

BOROUGH OF TIMARU (EXTENDED BOUNDARIES).

ALL that area in the Canterbury Land District, in the Arowhenua and Patiti Survey Districts, bounded towards the north by the northern side of Wai-iti Road; towards the south-west by the western side of the Old North Road from Wai-iti Road aforesaid to a point opposite the northern side of White Street; thence towards the north generally by a right line across the Old North Road to and along the northern side of White Street to the Main North Road, thence by a line across that road and along its north-eastern side to the road forming the north-western boundary of Native Reserve No. 884, thence by the western side of that road to a point at right angles to the south-easternmost corner of the said Reserve No. 884 (Te Raukauwaka), thence by a line across that road and along the southern boundary of that reserve to the sea; thence towards the east and north-east by the present high-water mark of the sea to a point in line with the south-eastern boundary-line of Sections Nos. 122 and 128, Town of Timaru; towards the south-east by a right line to and thence by the said boundary-line and its production in a south-westerly direction to Rural Section No. 1702; towards the south by the said Section No. 1702, by Rural Section No. 2367, a road, Rural Sections Nos. 1706 and 1607; towards the west by the last-mentioned section, a road, by Rural Section No. 1606, a road, and Rural Section No. 707, to the southern side of Robert Street; thence again towards the south by the south side of Robert Street and Hassel Street and the production of the south side of the last-mentioned street to the west side of Woodland Street; thence again towards the west by the western side of Woodland Street to North Street; again towards the south by the southern side of North Street to a point in line with the western boundary-line of Rural Section No. 2333; and thence again towards the west by a right line to and by that boundary-line and its continuation to the northern side of Wai-iti Road aforesaid.

Given under the hand of His Excellency the Right Honourable Uchter John Mark, Earl of Ranfurly; Knight Commander of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this twentieth day of July, in the year of our Lord one thousand eight hundred and ninety-eight.

A PROCLAMATION.

WHEREAS by “The Municipal Corporations Act, 1886,” the Governor is empowered by Proclamation to declare any portion of the Colony of New Zealand to be a borough under the said Act from and after a day to be named in such Proclamation:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities vested in me by the said Act, do hereby proclaim and declare that the district described in the Schedule hereto shall be and the same is hereby constituted, as from the first day of August, one thousand eight hundred and ninety-eight, a borough under the said Act; and I do further proclaim and declare that the name of such borough shall be the Borough of Stratford, and that the boundaries thereof shall be those described in the said Schedule.

SCHEDULE.

ALL that area in the Taranaki Land District, situated in Ngaiere Survey District, bounded towards the north generally by the northern side of Flint Road; towards the east generally by the east side of Esk Road to the Ohura Road; thence by a right line across that road to the north-eastern corner of Section No. 81, Block II., Ngaiere Survey District; thence by the eastern boundary-line of Sections Nos. 81, 83, and 84, Block II. aforesaid, and the eastern boundary-line of the last-mentioned section produced to the right bank of the Patea River; thence by the right bank of that river to Swansea Road; thence by the eastern side of that road to Warwick Road; thence by a right line across Warwick Road to the north-western corner of Section No. 34 of the said Block II., and by that section to the north-eastern corner of Section No. 33; thence towards the south-east by Sections Nos. 33 and 32,

Block II. aforesaid, and by a right line from the westernmost corner of the last-mentioned section, across the road and railway, to the north-eastern corner of Section No. 93A, Block I.; thence by that section to Brecken Road; thence across that road and towards the south-west by the western side of Brecken Road aforesaid to the north-eastern corner of Section No. 79A, Block I. aforesaid: thence towards the south by that section to the eastern boundary-line of Section No. 76A; thence towards the west by the said Section No. 76A to Opunake Road: thence again towards the south by the southern side of that road to a point in line with the eastern boundary-line of Section No. 64A; thence by a right line to the south-eastern corner of that section: thence again towards the west by Section No. 64A to the Patea River; thence by a right line in continuation of the last-mentioned boundary to the left bank of the Patea River: thence again towards the north by the left bank of that river to the eastern boundary-line of Section No. 123: thence again towards the west by Sections Nos. 123, 122, 119, and 118, to Pembroke Road; thence by a right line across that road, and again towards the north by the northern side of that road to the eastern boundary-line of Section No. 96: thence again towards the west by Sections Nos. 96 and 95, Block I. aforesaid, and the eastern boundary-line of the last-mentioned section produced to the northern side of Flint Road aforesaid.

Appointing Trustees for Native Lands, and exempting such Lands from Restrictions.

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fifth day of July, 1898.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section three of “The Native Land Laws Amendment Act, 1897,” it is enacted that “Any Native or Natives, whether incorporated or otherwise, owning land under title of any description, may convey the same or any defined part thereof, by way of trust, to the Surveyor-General or the Commissioner of Crown Lands for the district in which such land is situate, or to some other fit person appointed by the Governor in Council, upon such terms as to sale, leasing, managing, improving, and raising money upon the same as may be agreed upon between the parties, or as may be declared by the Governor in Council; and the Surveyor-General or Commissioner of Crown Lands, or other the person as aforesaid (hereinafter called ‘the trustee’), is hereby authorised to accept such trust”: And whereas Raumaewa te Rango, of Moawhango, Inland Patea, is the owner of the lands particulars whereof are set forth in the Schedule hereto: And whereas the said Raumaewa te Rango, being desirous of conveying the said lands by way of trust to Freeman Rayney Jackson and Frederic Augustus Krull, trading together in copartnership at Wanganui as “Freeman R. Jackson and Co.” has applied to His Excellency the Governor to appoint the said persons to undertake such trust: And whereas the terms of such trust as to sale, leasing, managing, improving, and raising money upon the said lands have been set forth in a deed bearing even date herewith, and made between the said Raumaewa te Rango of the one part and the said Freeman Rayney Jackson and Frederic Augustus Krull of the other part: And whereas by section five of the said “The Native Land Laws Amendment Act, 1897,” it is enacted that “for the purposes of giving effect to the provisions of this and the two last-preceding sections hereof the Governor in Council may from time to time make such regulations as he may deem necessary, and may also exempt any land from all or any of the restrictions, limitations, or provisions of ‘The Native Land Court Act, 1894,’ or any other Act affecting Native lands or lands owned or held by Natives”: And whereas it is expedient, for the purposes aforesaid, that the said lands be exempted from all the restrictions, limitations, or provisions of “The Native Land Court Act, 1894.”
