Notice to Mariners, No. 18 of 1898.

THE following Notice to Mariners, received from the
Master Attendant, Galle, Ceylon, is published for
general information.

CEYLON, SOUTH COAST.

Notice is hereby given that the bell-buoy marking the
Cadda Rocks, at the eastern entrance to Galle Harbour, will
on the 15th April next be shifted due south of its present
position as charted, a distance of 1½ cables, and moored in
12½ fathoms, distant 233 fathoms by measurement from the
Outer Cadda Rock in a south-half-east direction. Commanders of steamers approaching the port are requested to
note this, and keep a position clear of the buoy until the
pilot shows his flag (white, red, and white, horizontal),
when it is safe to steer for the pilot’s canoe. If under sail,
the canoe is distinguishable by the letter P on it, with the
pilot flag displayed above. Should the buoy be out of
position, the usual signals from the flagstaff will be hoisted
to that effect.

Arrest of British Seamen Deserters in Japan.

Hon. the Secretary of State for the Colonies, is
published for general information.

Sir,—I have the honour to transmit to you, for publication
in the colony under your government, copies of an Order of
the Queen in Council applying section 238 of “The Merchant
Shipping Act, 1894,” respecting the arrest of seamen deserters in the case of Japan.

At the Court at Osborne House, Isle of Wight, the 3rd day
of February, 1898.

Present:

THE QUEEN’S MOST EXCELLENT MAJESTY IN COUNCIL.

WHEREAS by subsection (1) of section 238 of “The Merchant
Shipping Act, 1894,” it is provided that, where it appears to
Her Majesty that due facilities are, or will be, given by the
Government of any foreign country for recovering and apprehending seamen who desert from British merchant-ships
in that country, Her Majesty may, by Order in Council,
stating that such facilities are or will be given, declare that
that section shall apply in the case of such foreign country,
subject to any limitations, conditions, and qualifications
contained in the Order:

And whereas it appears to Her Majesty that due facilities
are given by the Government of Japan for recovering and
apprehending seamen who desert from British merchant-ships in that country :

Now, therefore, Her Majesty, by virtue of the power
vested in her by the hereinbefore-recited subsection (1) of
section 238 of “The Merchant Shipping Act, 1894,” and by
and with the advice of her Privy Council, is pleased to order
and declare, and it is hereby ordered and declared, that the
said section 238 of “The Merchant Shipping Act, 1894,”
shall apply in the case of Japan.

And whereas the immediate operation of this Order is
urgent, this Order shall come into operation forthwith, and
shall be a provisional Order within the meaning of “The
Rules Publication Act, 1893.”

And the Secretary of State for the Home Department, the
Secretary of State for the Colonies, and the Secretary of
State for India in Council, are to give the necessary directions herein accordingly.

Approving and appointing a Bonding Warehouse.

CUSTOMS.—In exercise of the powers in me for this
purpose vested by “The Customs Laws Consolidation
Act, 1882,” I, the Commissioner of Trade and Customs, do
hereby approve and appoint the under-mentioned warehouse
to be a warehouse for the reception of goods under bond,
namely,—

Port of Invercargill.

The cellar of a brick building roofed with iron, and
situated on Section 7, Block 1, Leven Street, Town of
Invercargill, to be known as

MITCHELL’S BOND.

Given under my hand, at Wellington, this fourth day
of May, one thousand eight hundred and ninety-eight.

Notice by the Public Trustee under “The Unclaimed Lands
Act, 1894.”

To the owner or owners of a parcel of land, containing
by admeasurement 1 acre 2 roods, or thereabouts, statute
measure, being part of the section numbered 2355 in the
Mandeville District, of the Provincial District of Canterbury. Commencing at a point on the south-eastern
boundary of the section 5 chains 50 links or thereabouts
from the south-western corner thereof, and extending
thence north-easterly along the said boundary a distance
of 5 chains, and extending backward therefrom north-westerly in a rectangular block 3 chains. The registered
owner is Charles Miles Davies, of Glamorgan, gentleman.
There is a rumour this land was transferred to William
Vaughan, of Sefton, merchant, but no conveyance is
registered. Mr. Miles Leonard Davis, of 31, Lancaster
Gate, London, W., claims the land, stating that Charles
Miles Davis was his father, and died in 1865; but he takes
no steps to establish his alleged title although fully
written to thereon eleven months since, the receipt of
which letter he has acknowledged.

WHEREAS the Public Trustee has instituted inquiries,
and has not thereby ascertained who the owner or
owners of the above-described land is or are, and believes
that such owner is, or owners are, not in the colony :

Now, this notice calls upon such owner or owners, within
six months of the date of the publication of this notice in
this Gazette, to establish to the satisfaction of the Public
Trustee his or their title to the land specified in this notice;
and, if such owner does or owners do not, within the time
limited, so establish his or their title, the Public Trustee will
exercise the powers and authorities granted to him in and by
“The Unclaimed Lands Act, 1894.”
