A PROCLAMATION.

BY virtue and in exercise of the powers and authorities vested in me by the one hundred and seventy-second section of “The Land Act, 1892,” and of every other power and authority enabling me in that behalf, I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, do hereby declare that the land mentioned in the Schedule hereto shall be subject to the provisions of sections one hundred and seventy-two to one hundred and eighty-six of Part V. of “The Land Act, 1892,” relating to small grazing-runs.

OTAGO LAND DISTRICT.

SECTIONS 3 and 9, Block XII., Strath Taieri Survey District; 2,302 acres 1 rood 16 perches.

Given under the hand of His Excellency the Right Honourable David, Earl of Glasgow; Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this twenty-second day of January, in the year of our Lord one thousand eight hundred and ninety-seven.

Regulations under “The Tobacco Act Amendment Act, 1896.”

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this eleventh day of January, 1897.

Present:

THE HONOURABLE R. J. SEDDON PRESIDING IN COUNCIL.

IN pursuance and exercise of the power and authority conferred upon him by section fourteen of “The Tobacco Act Amendment Act, 1896” (hereinafter called “the said Act”), and of all other powers and authorities him enabling in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby make the following regulations for the purposes specified in the aforesaid section fourteen:—

REGULATIONS.

  1. Applications for warrants under section 8 of the said Act shall be made to a Collector of Customs, and shall contain a precise description of the premises in which the applicant proposes to keep and use a cutting-machine, or (as the case may be) to make cigarettes by hand from duty-paid manufactured tobacco.

  2. The warrants shall be in the form set forth in Schedule A hereto.

  3. An application for a warrant to make cigarettes under subsection (1), (b), of the aforesaid section 8 shall be accompanied by a statutory declaration to be made by the applicant in the form set forth in Schedule B hereto.

  4. All warrants under the subsection aforesaid shall terminate on the 31st December following the date of issue.

  5. The scale of fees payable for warrants under the subsection aforesaid shall be as follows:—

For any quantity of cigarettes expected to be made, as stated in the aforesaid declaration—

Not exceeding 100,000 .. .. .. £1
Exceeding 100,000, but not exceeding 500,000 .. 5
Exceeding 500,000 .. .. .. 10

  1. Every holder of a warrant under the subsection aforesaid shall keep a book in which shall be entered day by day and every day the number of persons actually employed in making cigarettes, and the number of cigarettes made. This book shall be open to inspection at any time by any officer of Customs, and, if required by the Collector, shall be produced in verification of the aforesaid declaration.

  2. In any of the following cases, that is to say,—
    (1.) If the aforesaid declaration is false in any material particular; or
    (2.) If the aforesaid book is not kept, or is not kept as prescribed, or if any false entry is made therein,—
    the person who makes such declaration, or whose duty it is to keep such book, is liable to a penalty of not less than five nor more than fifty pounds.

  3. In the event of any warrant being lost, the Collector of Customs may issue a duplicate thereof to the person to whom it was issued, on being satisfied by a statutory declaration, or such other or further evidence as he requires, that the original has been lost and cannot, after full search, be found. There shall be payable for each duplicate the fee of 2s. 6d.

  4. All fees for warrants or duplicates shall be paid to the Collector of Customs, to whom application therefor is made, and no warrant or duplicate shall be issued until the proper fee in respect thereof has been paid.

WARRANT FOR TOBACCO-CUTTING MACHINE.

I, , Collector of Customs at , do hereby authorise , whose business premises are situated at , to keep and use a tobacco-cutting machine on the said premises, but not elsewhere, for cutting duty-paid manufactured tobacco for sale, or to be used in making cigarettes by hand under a warrant in that behalf, if such warrant is duly issued.

WARRANT FOR MAKING CIGARETTES BY HAND.

I, , Collector of Customs at , do hereby authorise , whose business premises are situated at , to make a quantity not exceeding cigarettes by hand on the said premises, but not elsewhere, from duty-paid manufactured tobacco, for sale at such premises but not elsewhere. This warrant shall remain in force until the 31st December, 18 .

SCHEDULE B.
FORM OF DECLARATION TO ACCOMPANY APPLICATION FOR WARRANT TO MAKE CIGARETTES BY HAND FROM DUTY-PAID MANUFACTURED TOBACCO.

I, , of , having made application to the Collector of Customs at for a warrant to make cigarettes by hand from duty-paid manufactured tobacco, do hereby solemnly and sincerely declare as follows:—

  1. The quantity of cigarettes made by me during the year ended the 31st day of December, 18 , was thousand.*

  2. The quantity of cigarettes which will be made by me during the year ending the 31st day of December, 18 , will, to the best of my knowledge and belief, not exceed thousand; and on that scale I have duly forwarded with my application the prescribed fee of £ .

And I make this solemn declaration conscientiously believing the same to be true, and by virtue of the provisions of an Act of the General Assembly of New Zealand intituled “The Justices of the Peace Act, 1882.”

  • This paragraph should be struck out in the case of an applicant who is not making cigarettes at the date of his application.
