Allocating Lands reserved and taken for a Railway to the Purposes of a Road in the Borough of Oamaru.

A PROCLAMATION.
WHEREAS the lands mentioned in the Schedule hereto form part of land taken for the purposes of the Waitaki-Bluff Railway, and it is considered desirable to allocate such lands to the purposes of a road:
And whereas it has been certified by the Minister for Railways that such lands are not required for railway purposes: And whereas such lands are situated in the Borough of Oamaru, and the Oamaru Harbour Board have consented to the issue of this Proclamation:
And whereas His Excellency the Governor is of opinion that the said Oamaru Harbour Board can conveniently construct and maintain the said road:
Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities in me vested by section one hundred and seventy-seven of “The Public Works Act, 1894,” and of every other power and authority in anywise enabling me in that behalf, do hereby proclaim and declare that the lands described in the Schedule hereto shall, upon the publication hereof in the New Zealand Gazette, become a road, and that the said road shall be under the control of the Oamaru Harbour Board, and shall be maintained as a roadway by the said Board.
SCHEDULE.
All that area in the Borough of Oamaru, containing 3 roods 9·6 perches, more or less, being a portion of railway land situate between Arun Street and Test Street, and being bounded as follows: Commencing at the junction of the south-western boundary of the railway land with the southern side of Arun Street; then easterly along the southern side of Arun Street a distance of 309·6 links; thence south-easterly, on a line bearing 147° 41′, a distance of 821·6 links; thence westerly, on a line bearing 263° 47′, a distance of 96·4 links to the south-western boundary of the railway land; thence north-westerly along the south-western boundary of the railway land a distance of 604 links; and thence again north-westerly along the said south-western boundary of the railway land, a distance of 423·3 links, to the commencing-point.
Also, all that area in the Borough of Oamaru, containing 31·9 perches, more or less, being a portion of railway land situate between Test Street and the harbour, and being bounded as follows: Commencing at a point on the north-eastern boundary of the railway land distant 688·9 links from its junction with the southern side of Arun Street, measuring along the said north-eastern boundary; thence south-easterly along the north-eastern boundary of the railway land a distance of 614·5 links; and thence north-westerly, on lines bearing 297° 59′, 306° 34′ 30″, 314° 33′, and 327° 2′, distances of 184·3 links, 145·5 links, 151·7 links, and 144·1 links respectively, to the commencing-point.
Also, all that area in the Borough of Oamaru, containing 4·6 perches, more or less, situate near the eastern end of Test Street, and being bounded as follows: Commencing at a point on the north-eastern boundary of the railway land distant 2048·3 links from its junction with the southern side of Arun Street measuring along the said north-eastern boundary; thence south-easterly along the north-eastern boundary of the railway land a distance of 402·5 links; thence westerly, on a line bearing 280° 51′, a distance of 59·4 links; and thence north-westerly, on a line bearing 292° 19′, a distance of 344·1 links, to the commencing-point.
As the said three parcels of land are more particularly delineated on the plan marked 7358, deposited in the office of the Minister for Railways, at Wellington, and thereon coloured green.
Given under the hand of His Excellency the Right Honourable Uchter John Mark, Earl of Ranfurly; Knight Commander of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this sixth day of December, in the year of our Lord one thousand eight hundred and ninety-seven.

IN pursuance and in exercise of the powers conferred by section thirteen of “The Land Act, 1892,” I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, do by this notice hereby proclaim as closed the road in the Wairau Parish, Otamatea County, hereinafter described.
