Application to the Validation Court under “The Native Land (Validation of Titles) Act, 1893.”

IN THE VALIDATION COURT,
AT GISBORNE.

In the matter of “The Native Land (Validation of Titles) Act, 1893”; and in the matter of the Manukawhitikitiki No. 2 Block.

a. THE ASSETS COMPANY (LIMITED), of Edinburgh, Scotland, and New Zealand, applies under the above-mentioned Act for the validation of its interests in the Manukawhitikitiki No. 2 Block, containing 3,187 acres, more or less, being five contracts of sale made by the Native vendors mentioned under paragraph c.

b. The applicant desires to appear before the Validation Court at Gisborne on Monday, the 8th day of February, 1897, at the hour of 10 a.m., or at such date, time, or place as counsel may be heard.

c. The nature of the transactions proposed for validation is,—

(1.) Conveyance of undivided interests, dated 18th May, 1878, Pera te Uatuku, Rewi Tamanui, Heni Paritaranga, and Hori Puru, to John Gibson Kinross and Andrew Graham, for the consideration of £150.

(2.) Conveyance of an undivided interest, dated 16th May, 1887, Te Ao Pakurangi to the Assets Company (Limited).

d. The land or the estate and interests in which were intended to be alienated is all that block known as Manukawhitikitiki No. 2. The title of the Native alienors at the time of the several alienations was memorial of ownership.

e. The estate and interest which the applicant seeks to obtain through the aid of the Court in the several estates and interests claimed is a freehold.

f. The applicant for validation became invested with the title it now holds by direct alienation set out in paragraph c, and as to others by conveyance, Kinross and Graham to the applicant, dated 13th June, 1894.

g. The address for service of the applicant company in the Town of Gisborne is at the office of Cecil Albert de Lautour, solicitor.

h. The applicant desires that the estates and interests of the Native persons aforesaid, who executed the deeds of conveyance aforesaid, set out under the letter c of this application, shall be bound by the decree of this Court, and for that purpose requires that copies of this application shall be served upon them or their representatives, according to the list lodged herewith.

i. The applicant desires that all other persons who may claim to be interested in the validation applied for shall be treated as parties to these proceedings, but the applicant is unable, except as hereinafter, to specify any names as those of persons entitled to object to the validation applied for.

The applicant is not aware of any aboriginal native nor of any European who may properly claim to be an objector.

Application to the Validation Court under “The Native Land (Validation of Titles) Act, 1893.”

In the matter of “The Native Land (Validation of Titles) Act, 1893”; and in the matter of the Manukawhitikitiki No. 1 Block.

a. THE ASSETS COMPANY (LIMITED), of Edinburgh, Scotland, and New Zealand, applies under the above-mentioned Act for the validation of its interests in the Manukawhitikitiki No. 1 Block, containing 949 acres, more or less, being eleven contracts of sale made by the Native vendors mentioned under paragraph c.

b. The applicant desires to appear before the Validation Court at Gisborne on Monday, the 8th day of February, 1897, at the hour of 10 a.m., or at such date, time, or place as counsel may be heard.

c. The nature of the transactions proposed for validation is,—

(1.) Conveyance of undivided interests, dated 20th April, 1878, Hemi Whakarau, Hori Mokai, Tipene Tutaaki, Heni Paretaranga, Tapita Iretoro, Erina Ranganui, Wi Mahuika, Eruera te Awahaku, Hine Wehi, Wikitoria Kanu, to John Gibson Kinross and Andrew Graham, for the consideration of £190.

(2.) Transfer of an undivided interest, dated 4th June, 1884, Mereana Paraone to the Assets Company (Limited), for the consideration of £45.

d. The land or estates and interests in which were intended to be alienated is all that block known as Manukawhitikitiki No. 1, but now subdivided into Manukawhitikitiki Nos. 1A. and 1B. The title of the Native alienors at the time of the several alienations comprised in the conveyance of 20th April, 1878, was memorial of ownership, and that of the alienor Mereana Paraone, comprised in the transfer, dated 4th June, 1884, subdivision order of the Native Land Court.

e. The estate and interest which the applicant seeks to obtain through the aid of the Court in the several estates and interests claimed is a freehold.
