Empowering Native Appellate Court to deal with certain Applications for Relief.
GLASGOW, Governor.
ORDER IN COUNCIL.
At Dunedin, this third day of February, 1896.
Present:
His Excellency the Governor in Council.
WHEREAS by section sixty-two of “The Native Land Laws Amendment Act, 1895,” it is provided that in any case in which application has been or shall be made to the Chief Judge of the Native Land Court under section thirty-nine of “The Native Land Court Act, 1894,” in respect of any order of the Court determining the succession to the estate of any Native deceased, the Governor, on being certified by the Chief Judge as in the said section is provided, may by Order in Council empower the Native Appellate Court to deal with such application as a valid appeal under the said “Native Land Court Act, 1894”: And whereas the Chief Judge has in respect of the application of Rahera te Aika under section thirty-nine aforesaid, which application bears date the sixteenth day of November, one thousand eight hundred and ninety-four, certified as by the said section is required: And whereas the said application in all other respects complies with the requirements of the said section:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority enabling him in that behalf as aforesaid, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby empower the said Appellate Court to deal with the said application as an appeal, under the provisions of “The Native Land Court Act, 1894,” from the several orders of Court hereinafter specified, that is to say,—
- The two several orders of the Court dated respectively the twenty-fourth day of October, one thousand eight hundred and ninety-three, dismissing the application of Rahera te Aika and others to succeed to interest of Aperahama te Aika, deceased, in Kaiata No. 33 and Arahura No. 30.
- The order of the Court dated the twenty-fifth day of October, one thousand eight hundred and ninety-three, appointing Eruera te Aika and Ruiha Uru to succeed to interest of above-named deceased in Greymouth Native Reserve No. 31.

Notifying Lands in Auckland for Sale by Public Auction.
GLASGOW, Governor.
IN pursuance of the powers and authorities conferred upon me by the one hundred and thirteenth section of “The Land Act, 1892,” I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, do hereby appoint Friday, the twenty-seventh day of March, one thousand eight hundred and ninety-six, as the time at which the lands enumerated in the Schedule hereto shall be sold by public auction; and I do hereby fix the prices at which the said lands shall be sold as those mentioned in the said Schedule hereto opposite the description of such lands respectively.

Otamatea County, Parish of Omaru.
Undulating forest land of good quality, containing about 600,000ft. green kauri and 350,000ft. scorched kauri. The timber is situated near east boundary, about half a mile from Mangonui River. The land is about twelve miles from Tokatoka Post-office.
As witness the hand of His Excellency the Governor, this twenty-fourth day of January, one thousand eight hundred and ninety-six.

Rural Lands in the Hawke’s Bay Land District open for Sale or Selection.
GLASGOW, Governor.
IN pursuance and exercise of the powers and authorities conferred upon me by the one hundred and thirty-sixth section of “The Land Act, 1892,” I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, having received the report of the Surveyor-General in this behalf, as in the said section is provided, do hereby declare that the rural lands described in the Schedule hereto shall be open for sale or selection on and after the twenty-fifth day of March, one thousand eight hundred and ninety-six; and also that the lands mentioned in the said Schedule may, at the option of the applicant, be purchased for cash, or be selected for occupation with right of purchase or on lease in perpetuity, or, in respect of any lands containing or supposed to contain any metal, mineral, or valuable stone, be selected on lease in perpetuity only; and I do hereby also fix the prices at which the said lands shall be sold, occupied, or leased, as mentioned in the said Schedule hereto, and do declare that the said lands shall be sold, occupied, or leased under and subject to the provisions of “The Land Act, 1892.”

Bounded towards the north-west by the Motu No. 3 Block; towards the east by the Gisborne–Opotiki Road; towards the south by Section 3, Block VII.; and towards the west by Sections 6, 7, 8, 9, and 5, Block VII., and Section 1, Block VI., all in the Motu Survey District.
Forest country, undulating and hilly. Elevation, from 1,600ft. to 2,000ft. above sea-level; well watered; soil medium to good. Adjoining the main road from Gisborne to Opotiki, about forty-five miles distant from the former place, and three miles from the accommodation-house at Motu Village.

Section 29, Block XI.: 306 acres; total upset price, £153. Broken forest land, containing about 300,000ft. of kauri timber (dry).
Section 28, Block XI., and Section 23, Block XII. (together): 209 acres 1 rood 14 perches; total upset price, £104 15s.
Section 24, Block XII.: 4 acres; upset price, £5, subject to £6 10s. for clearing and grassing.
Sections 23 and 28, broken forest land, containing about 150,000ft. kauri timber, one-half of which is dry. Section 24, undulating land, cleared and grassed by A. W. Drever.
The above lands are about seven miles by road from Hikurangi Railway-station.
