Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the powers conferred upon him by the said Act, and by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the Patea Borough Council shall, as from the date of publication hereof in the New Zealand Gazette, be subject to the provisions of the said Act.

The Tauranga Agricultural and Pastoral Association incorporated.—Notice No. 454.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twelfth day of October, 1896.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
IN pursuance of the powers and authorities vested in him by “The Agricultural and Pastoral Societies Act, 1877,” His Excellency the Governor of the Colony of New Zealand, by and with the advice of the Executive Council of the said colony, doth hereby incorporate the members of the Tauranga Agricultural and Pastoral Association, and such persons as shall hereafter be admitted members of the said association agreeably to the rules of the said association and the provisions of the said Act, into a body corporate under the said Act, under the style and title of “The Tauranga Agricultural and Pastoral Association.”

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
IN pursuance of the powers and authorities vested in him by “The Agricultural and Pastoral Statistics Act, 1895” (hereinafter termed “the said Act”), His Excellency the Governor of the Colony of New Zealand, acting with the consent of the Executive Council of the said colony, doth hereby order and direct that the account described in section two of the said Act shall be taken on the tenth day of November, one thousand eight hundred and ninety-six, and continue to be taken from day to day until the nineteenth day of December, one thousand eight hundred and ninety-six; and doth hereby declare that this Order in Council shall take effect on and after the tenth day of November, one thousand eight hundred and ninety-six.

Vesting Wharf at Motueka in the Waimea County Council.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twelfth day of October, 1896.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by section fourteen of “The Harbours Act, 1878,” it is enacted that the Governor in Council may vest the management of any wharf, the property of Her Majesty, in any local governing body or person, upon such terms and conditions as the Governor in Council thinks fit:
Now, therefore, I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the colony, and in exercise of the power and authority vested in me by the said fourteenth section of “The Harbours Act, 1878,” do hereby vest the management of the “Motueka Wharf,” as shown on plan marked M.D. 2094, in the Waimea County Council; subject, however, to the conditions set forth in the Schedule hereto: Provided always that the aforesaid conditions, and other rights and privileges hereby conferred, may from time to time be altered, revoked, or modified by the Governor in Council.
SCHEDULE.

THAT all Her Majesty’s subjects shall, at all reasonable times, and upon payment of the proper dues, have free and full liberty to use the above-mentioned wharf, and of ingress and egress thereon.

That Her Majesty or the Governor, and all officers of the Marine Department or Customs acting in the execution of their duty, shall at all times have free ingress, passage, and egress into, through, and out of the wharf without payment.

That the said County Council shall maintain and keep the above-mentioned wharf and all erections thereon in good order and repair, and shall at all times permit to be erected and exhibited therefrom any lights for the guidance of vessels, and shall maintain at its own cost any such lights; and shall also maintain leading-lights into the Port of Motueka, all the said lights to be maintained to the satisfaction of the Minister having charge of the Marine Department: Provided that no new light shall be exhibited until after it has been approved of by the Minister having charge of the Marine Department.

That any person authorised by the Minister having charge of the Marine Department, or any officer acting with his approval, may at all reasonable times enter upon the said wharf and any buildings erected thereon, and view the state of repair thereof, and may leave at the last known office of the Council a notice in writing of any defect, requiring the Council, within a reasonable time, to be therein prescribed, to repair the same.

That the Council will not erect or suffer to be erected on the said wharf any building or structure whatever except with the consent of the Minister having charge of the Marine Department.

That nothing herein contained shall authorise the Council to do or cause to be done anything repugnant to or inconsistent with any law relating to the Customs, or any regulation of the Commissioner of Customs.

That the said Council shall keep a separate account of the revenue derived from, and expenditure on, the said wharf, and shall devote any profits made therefrom to the improvement of the wharfage accommodation of the Port of Motueka.

That the rights, powers, and privileges conferred by this Order in Council shall continue in force for fourteen years, computed from the date of this Order in Council, unless in the meantime altered, modified, or revoked.

That the rights, powers, and privileges conferred under or by virtue of this Order in Council may be at any time resumed by the Governor on giving to the Waimea County Council six calendar months’ notice in writing. Any such notice shall be sufficient if given by the Governor, or the Minister having charge of the Marine Department, or any person acting under his or their instructions, and delivered at the last known office of the said Council, their successors or assigns. No compensation or allowance shall be payable in such case.

Vesting Reserves in the Ashburton County Council.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twelfth day of October, 1896.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS the lands described in the Schedule hereto were permanently reserved for purposes of internal communication on the twenty-fifth day of August, one thousand eight hundred and ninety-six:
And whereas, in the opinion of the Governor, it is expedient to vest the said lands in the Ashburton County Council:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” doth hereby declare that, from and after the day of the date hereof, the reserves described in the Schedule hereto shall become vested in “The Chairman, Councillors, and Inhabitants of Ashburton County,” in trust, for purposes of internal communication.
