THE following special order, made by the Te Horo Road Board, is published in accordance with the provisions of "The Road Boards Act, 1882."

TE HORO ROAD BOARD.

Special Order.—By-law.—Heavy Traffic.

THAT, relating to heavy traffic and other traffic of a special nature on roads subject to the control of the Te Horo Road Board:—

First, The words "heavy traffic" in these by-laws shall have the meaning assigned to them in section 130, sub-sections (a), (b), (c), of "The Public Works Act, 1894."

Second, Every vehicle which shall be used for heavy traffic on the roads in the Te Horo Road District shall have a width of tire in conformity with the following table, and no vehicle with a less width of tire than that specified for vehicles of the particular description shall be used for heavy traffic on such roads.

Description of Vehicle.—On two wheels, on four wheels : Vehicles carrying 1½ tons, three-inch tires ; 3 tons, five-inch tires. No heavy traffic in timber, stone, sand, ballast, or minerals shall be carried in vehicles with two wheels in greater loads, including the weight of the vehicle, than 1½ tons to each pair of wheels.

Any person engaged in heavy traffic on the Te Horo Road shall, if required so to do by the Te Horo Road Board, give security to the satisfaction of the Road Board that no special damage shall be caused to any road, bridge, ferry, or ford by reason of any heavy traffic carried on by such person, and for the payment of compensation to the Road Board for such damage. Any person engaged in heavy traffic in the carriage of timber, stone, sand, ballast, or minerals upon specified roads shall, in lieu of giving such security, if the Road Board shall so require, pay to the Road Board a sum of money per annum, by way of liquidated compensation, for any damage likely to occur to any road, bridge, ferry, or ford by reason of any heavy traffic carried on by such person. Such sum shall be computed in a manner following, that is to say : For every such vehicle with two wheels, £25 per annum ; and for every such vehicle with four wheels, at the rate of £50 per annum. No person shall conduct or drive any vehicle for heavy traffic over any of the following roads—all district roads in the Te Horo Road District—who has not given such security as aforesaid or such annual payment as aforesaid.

Every person who shall commit a breach or act in contravention of any of the aforesaid by-laws shall be guilty of an offence. Every person guilty of an offence against this by-law shall be liable to a penalty not exceeding £5 for every such offence.

I hereby certify that the above by-law was duly made at an ordinary meeting of the Te Horo Road Board held on Saturday, 27th June, 1896, and confirmed at a special meeting held on Saturday, 22nd August, 1896, in accordance with the provisions of "The Road Boards Act, 1882," and "The Public Works Act, 1894."

WAIRARAPA NORTH COUNTY.

By-law regulating Wheel Traffic, and prohibiting "Heavy Traffic" during certain Months in the Year.

In pursuance and exercise of the powers vested in it by "The Counties Act, 1886," and by "The Public Works Act, 1894," and of every other power and authority it in this behalf enabling, the Council of the Wairarapa North County doth hereby, in respect of all roads, bridges, ferries, and fords under the care, control, or management of the said Council, make the following by-laws:—

I. The width of the tires of vehicles passing over any such road, bridge, ferry, or ford shall be regulated with regard to the number of wheels and the number of animals drawing the same in the proportions specified in the Schedule to this by-law.

II. The owner and driver of any vehicle which shall be driven or taken or used upon or over any such road, bridge, ferry, or ford shall be deemed to have committed a breach of the foregoing by-law if the width of tire of the wheels or any of them of such vehicle be less than is required by the said by-law, and the said owner and driver shall severally be liable to a penalty not exceeding five pounds (£5) for every such breach.

III. Any person acting under the authority of the said Council may at all times examine and measure the tires of the wheels of any vehicle, and for that purpose may enter upon the premises of any person having the custody of such vehicle; and any person who shall obstruct or interfere with the person acting under any such authority, or refuse to permit such examination and measurement, or to give access to the said vehicle as aforesaid, shall be liable to a penalty not exceeding five pounds (£5) for every breach of this by-law.

IV. The transportation or traction on any such road, bridge, ferry, or ford of any vehicle, engine, machine, or thing coming under the definition of "heavy traffic" within the meaning of clauses (a) or (b) of subsection 1 of section 130 of "The Public Works Act, 1894," during the months of May, June, July, August, and September in any year shall cease. If any person shall commit a breach of any of the provisions of this by-law he shall be liable to a penalty not exceeding five pounds (£5) for every such breach.

V. In the construction of these by-laws the term "heavy traffic" shall mean heavy traffic as defined by section 130 of "The Public Works Act, 1894"; and the term "owner" shall include all persons having any interest, temporary or otherwise, in any vehicle or machine, but shall not include mortgagee, unless such mortgagee have the possession or control thereof.

Passed at a special meeting of the Council this 16th day of July, 1896.

In accordance with "The Masterton Trust Lands Trust Empowering Act, 1895," section 10, I hereby give public notice of the number of votes recorded for and against the proposal to raise a loan of £2,000 for the purpose of erecting a Town Hall within the Borough of Masterton, viz:—

For the proposal, 742; against, 33; informal, 11.

The number of votes given in favour of the proposal exceeds one-half of the total number of voters on the voters' list; I therefore declare the proposal to be carried.
