Application to the Validation Court under “The Native Land (Validation of Titles) Act, 1893.”
IN THE VALIDATION COURT.
In the matter of “The Native Land (Validation of Titles) Act, 1893”; and in the matter of the Waihingahinga Block.
a. HENRY WILLIAM BRIGGS, of Pahiatua, in the Provincial District of Wellington, land and estate agent, applies under the above-mentioned Act for the validation of the transfers of the above-named block by the several owners thereof.
b. The applicant desires to appear before the Validation Court at Hastings on the 18th day of August, 1896, at the hour of 10 o’clock in the forenoon, or as soon thereafter as the applicant, by himself or his counsel, can be heard, to ask for relief.
c. The transactions proposed for validation are,—
(1.) Memorandum of transfer, dated 3rd November, 1883, from Hineipakatia and Te Waihiku to Herbert Thomas Halsley Knight, of Waipukurau, Hawke’s Bay, accountant, in consideration of £50 paid to transferors.
(2.) Memorandum of transfer, dated 3rd November, 1883, from Nikaore te Wharepouri and Pera Wheraro, her husband, to the aforesaid Herbert Thomas Halsley Knight, in consideration of £40 paid.
(3.) Memorandum of transfer, dated 29th April, 1884, from Te Ruihi to Herbert Thomas Halsley Knight, in consideration of £40 paid.
(4.) Memorandum of transfer, dated 6th May, 1884, from Hokomata and William Cannon, her husband, to Herbert Thomas Halsley Knight, in consideration of £100 paid.
(5.) Memorandum of transfer, dated 17th May, 1884, from Manuera to Herbert Thomas Halsley Knight, in consideration of £40 paid.
(6.) Memorandum of transfer, dated 10th December, 1888, from Ekenarangi Nepia Hapuku, Arapata Hapuku, Tangata ke Hapuku, Pohuka Hapuku, and Hapuku te Nehu, to James Alfred Turner and James Irvine, both of Napier.
d. The land intended to be alienated is the Waihingahinga Block, granted to Te Hapuku, Hikomata te Ruihi, Hineipakatia, Nikaore te Wharepouri, Te Waihiku, and Manuera, by Crown grant, dated 7th December, 1871, registered at Napier, Vol. i., folio 63.
e. The applicant seeks to obtain an estate in fee-simple or absolute freehold title to the said block.
f. The applicant became invested with his title under the following instruments:—
(1.) Memorandum of transfer, dated 3rd November, 1883, from Hineipakatia and Te Waihiku to said Herbert Thomas Halsley Knight, of all their interests in Waihingahinga Block.
(2.) Memorandum of transfer, dated 3rd November, 1883, from Nikaore te Wharepouri and Pera Wheraro, her husband, to said Herbert Thomas Halsley Knight, of all their interest in Waihingahinga Block.
(3.) Memorandum of transfer, dated 29th April, 1884, from Te Ruihi to Herbert Thomas Halsley Knight, of all his interest in Waihingahinga Block.
(4.) Memorandum of transfer, dated 6th May, 1884, from Hokomata and William Cannon, her husband, to Herbert Thomas Halsley Knight, of all their interests in Waihingahinga Block.
(5.) Memorandum of transfer, dated 17th May, 1884, from Manuera to Herbert Thomas Halsley Knight, of all his interest in the Waihingahinga Block.
(6.) Memorandum of transfer, dated 10th December, 1888, from Ekenarangi, Nepia Hapuku, Arapata Hapuku, Tangata ke Hapuku, Pohuka Hapuku, and Hapuku te Nehu, to the said James Alfred Turner and James Irvine.
(7.) Memorandum of transfer, dated 3rd August, 1888, the said Herbert Thomas Halsley Knight to James Alfred Turner and James Irvine, of all his interest in the Waihingahinga Block.
(8.) Memorandum of mortgage, dated 20th May, 1890, James Irvine and James Alfred Turner to the National Bank of New Zealand (Limited), of the whole of the Waihingahinga Block.
(9.) Memorandum of transfer, dated 13th November, 1893, the National Bank of New Zealand, in exercise of power of sale as mortgagee, to Henry William Briggs, of the whole of the Waihingahinga Block.
g. All notices and other documents may be served upon the applicant by leaving the same at the offices of Messrs. Brown and Dean, solicitors, 5, Lambton Quay, in the City of Wellington.
h. The applicant requires that copies of the application shall be served upon the said grantees and Native transferors or their representatives, who are as follows, so far as the applicant is able to ascertain:—
Ekengarangi Arapata, of Te Aute,\nTe Pohuka Tangata, of Te Aute,\nTe Hapuku te Nahu, of Te Aute,\n} As representatives of Te Hapuku, deceased;
Arihi te Nahu, of Te Aute,\nMepara Maku, of Te Aute,\nHapuku te Nahu, of Te Aute,\n} As representatives of Nepia Hawene, deceased, who is a successor to Te Hapuku;
Te Ruihi, of Waipawa, as representative of Hikomata, deceased; Te Ruihi, as grantee; Nikaore te Wharepouri, of Te Aute; Manuera, of Te Aute.
