Vesting a Reserve in the Springs Road Board.

GLASGOW, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this sixth day of July, 1896.

Present:

His Excellency the Governor in Council.

WHEREAS the land mentioned in the Schedule hereto was permanently reserved for a gravel-pit on the second day of March, one thousand eight hundred and eighty-seven:

And whereas, in the opinion of the Governor, it is expedient that the said land should be vested in the Springs Road Board:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” doth hereby declare that, from and after the day of the date hereof, the reserve mentioned in the Schedule hereto shall become vested in “The Inhabitants of the Springs Road District,” in trust, for a gravel-pit.

SCHEDULE.

All that piece or parcel of land in the Land District of Canterbury, containing by admeasurement 2 acres 1 rood, more or less, being Section No. 2732 (in red), situate in the Leeston Survey District. Bounded towards the north by a road-line, 750 links; towards the south-east by a road-line, 900 links; and towards the west by Section No. 3886, 570 links: be all the aforesaid linkages more or less; as the same is delineated on the plan deposited in the District Survey Office, Christchurch.

Native Land proposed to be taken for the Construction of a Police Station in Hawke’s Bay County.

GLASGOW, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this nineteenth day of June, 1896.

Present:

His Excellency the Governor in Council.

WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work, to wit, the construction of a police station in Hawke’s Bay County:

And whereas the said land is held or occupied by Native owners under a title which is not derived from the Crown:

And whereas a map has been prepared in duplicate showing accurately the position and extent of the said land, as required by the eighty-eighth section of “The Public Works Act, 1894”:

Now, therefore, in pursuance and exercise of the powers vested in him by the eighty-eighth section of the said Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby declare that the land shown upon such map, and described in the Schedule hereto, shall be deemed to be taken for the purposes of the said police station as from the first day of August, one thousand eight hundred and ninety-six.

Excepting Land from Operation of Section 117 of “The Native Land Court Act, 1894.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this sixth day of July, 1896.

Present:

His Excellency the Governor in Council.

WHEREAS by section four of “The Native Land Laws Amendment Act, 1895,” it is enacted that the Governor may, by Order in Council, except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894” (hereinafter called “the said Act”), for a limited period or otherwise, and either generally or for such purposes and subject to such restrictions as shall be in such Order specified, any land, wheresoever situate, which is for the time being subject to the operation of the said section, or any interest therein or right over the same; or may in like manner make such exception in favour exclusively of any lessee or other person who has been bonâ fide in occupation of, and has made improvements on, such land, or has paid money to Native owners for lease or purchase thereof, prior to the passing of the said Act: Provided that no Order in Council under the provisions of this section shall take effect until after the expiration of two months from the date of the publication thereof in the Gazette: Provided also that every alienation under the provisions of this section shall be confirmed by the Court in terms of section fifty-three of the said Act:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities conferred by the Acts aforesaid, or any of them, and by and with the advice and consent of the Executive Council of the said colony, doth hereby except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of mortgage to the Public Trustee of the Colony of New Zealand, the blocks or parcels of land mentioned and particularised in the Schedule hereto.
