Land declared to be Crown Land subject to "The Land for Settlements Act, 1894."

A PROCLAMATION.
WHEREAS the land described in the Schedule hereto has been acquired under the provisions of "The Land for Settlements Act, 1894" (hereinafter termed "the said Act"), and the purchase thereof has been concluded as by the said Act is provided: And whereas it is enacted by the said Act that all land, so acquired shall be proclaimed as Crown land subject to the provisions of the said Act:
Now, therefore, I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, in exercise and pursuance of the power and authority conferred by the said Act, do hereby proclaim and declare that the land described in the Schedule hereto shall, on the date of the publication hereof in the New Zealand Gazette, be and be deemed to be Crown land subject to the provisions of "The Land for Settlements Act, 1894."
SCHEDULE.
OPOURIAO ESTATE.
All that area in the Auckland Land District, containing by admeasurement 7,491 acres, more or less, situated in Blocks V., IX., and XIII., Whakatane Survey District, and Block II., Waimana Survey District. Bounded towards the north by the southern boundary-line of Small Grazing-run No. 4 and its production to the Whakatane River; towards the east generally by Crown lands, by portion of Waimana Road, by Section No. 237 (N.L.) of Waimana Parish, by a line across the Waimana River, and by Sections Nos. 70 (N.L.), and 26 and 27, all of the same parish, by the Waimana River, by Section No. 323 of said parish, by Crown lands, and again by the Waimana River; towards the south generally by the Waimana No. 1a Block and the Tuhua or Ruatoki Block; and towards the west by the Whakatane River: excluding from the above-described area Sections Nos. 32, 104, 100, and 106, all of Waimana Parish: as the said area is delineated upon the plan marked S.G. 18937, deposited in the Head Office of the Department of Lands and Survey, at Wellington, in the Wellington Land District, and thereon coloured red.
Given under the hand of His Excellency the Right Honourable David, Earl of Glasgow; Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over Her Majesty's Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this thirteenth day of January, in the year of our Lord one thousand eight hundred and ninety-six.

Removal of Restrictions on Alienation of Native Land.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-first day of December, 1895.

THE HONOURABLE R. J. SEDDON PRESIDING IN COUNCIL.
WHEREAS application has been made to the Governor in Council by Hare Parata and Ani Enoka (by her Trustee, Enoka Hohepa), the native owners of the land described in the second column of the Schedule hereto, praying that the restrictions on the alienation of such land contained in the Crown grant bearing date the sixth day of November, one thousand eight hundred and sixty-seven, described in the first column of the said Schedule, may be removed: And whereas inquiry has been duly made by the Native Land Court, and the said Court has reported that the provisions of the law in that behalf have been complied with: And whereas it appears expedient to grant such application:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred on him by "The Native Land Act, 1865," and acting with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that all restrictions imposed by the said Crown grant on the alienation of the said land are hereby removed.

Crown grant, Registered No. 7830, Wellington District, dated the 6th day of November, 1867, in favour of Hare Parata, Ani Parata, and Mere Pawa, and containing the following restrictions: "Inalienable by sale, or by lease for a longer period than twenty-one years, or by mortgage, without the consent of the Governor being previously obtained to every such sale, lease, or mortgage." | All that parcel of land, situate in the City of Wellington, being Lot 3, Pipitea Pa, containing 30 perches.

Conditions under which a University Reserve in Westland shall be leased under the Provisions of "The University Endowment Act, 1868."

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this tenth day of January, 1896.

THE HONOURABLE R. J. SEDDON PRESIDING IN COUNCIL.
BY virtue and in exercise of the power and authority vested in me by the eighth section of "The University Endowment Act, 1868," and of every other power and authority enabling me in that behalf, and acting by and with the advice and consent of the Executive Council of the Colony of New Zealand, I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, do hereby declare that the land described in the First Schedule hereto shall be leased upon the terms and conditions mentioned in the Second Schedule hereto, and for that purpose I do hereby authorise the Land Board of Westland to deal with the land in the manner set forth in the said Second Schedule.
FIRST SCHEDULE.
All that parcel of land, situate at Hokitika South, in the Provincial District of Westland, containing by admeasurement 5 acres, more or less, bounded on the north by Railway Reserve No. 25, and on the east, south, and west by Section 1605; being University Reserve No. 27, situate in Block IV., Mahinapua Survey District.
SECOND SCHEDULE:

The Land Board shall cause the said land to be surveyed into ten allotments and a tunnel reserve, as shown on the plan deposited in the office of the Chief Surveyor at Hokitika.

The Land Board shall offer the lease for a term of three years of each of the said allotments to a party of not less than three bona fide miners for mining purposes. At the end of such term the interest of the lessees shall cease and determine.

The lease shall be in such form, and subject to such conditions (not inconsistent with these presents), as the Land Board may think fit; but the lease shall provide that the lessees shall bona fide carry on mining operations, and shall hold the land subject to the provisions herein contained, and that they will be bound thereby. The lease shall be signed by the Governor as lessor, and shall be prepared by the Board at the cost of the lessee, but such cost shall not exceed £2 2s.

The rental of each allotment shall be £6 for the term of three years, payable in advance, and shall be paid by each party immediately on being notified that their application has been granted, or immediately after the ballot has been declared as hereinafter mentioned.

Each party of miners shall apply to the Land Board in writing under the hands of the members thereof for not more than one allotment, and no person shall be a member of more than one party.

In case there is only one applicant for any allotment, such allotment shall be leased to the party applying therefor, and the applicant shall be notified accordingly.

In case there are more applications than one for any allotment, the successful applicant shall be selected by ballot in such manner as the Board thinks fit.
