Revoking a Proclamation.

A PROCLAMATION.

IN pursuance and in exercise of the powers conferred by
section six of "The Land Act, 1892" (hereinafter
termed "the said Act"), I, David, Earl of Glasgow, the
Governor of the Colony of New Zealand, do by this notice
hereby revoke a Proclamation issued under section thirteen
of the said Act, dated the eleventh day of March, one thou-
sand eight hundred and ninety-six, and published in the
New Zealand Gazette, No. 19, dated the nineteenth day of
March, one thousand eight hundred and ninety-six, taking
land for a road through Section Two hundred and seventy-
six, Block Seven, Opihi Survey District, in the Land Dis-
trict of Canterbury.

Given under the hand of His Excellency the Right

Proclaiming the Taking of a Road through an Endowment
Reserve.

A PROCLAMATION.

IN pursuance and in exercise of the powers conferred by
section thirteen of "The Land Act, 1892," I, David,
Earl of Glasgow, Governor of the Colony of New Zealand,
with the consent of the tenant of the land hereinafter men-
tioned, and with the consent of the Christchurch City
Council, being the local authority in whose district the said
land is situated, do by this notice hereby proclaim as a road
the land in the endowment reserve of the Christchurch
City Council, Opihi Survey District, mentioned in the Sche-
dule hereto.

Regulations under "The Family Homes Protection Act, 1895."

GLASGOW, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-
fifth day of April, 1896.

Present:
The Honourable R. J. Seddon presiding in Council.

WHEREAS by "The Family Homes Protection Act,
1895," it is provided that the Governor in Council
may make regulations for carrying into effect the provisions
of the said Act, and for prescribing the forms, modes, and
times of applications, notices, certificates, memorials, entries,
and all other proceedings required for carrying out the in-
tention of the said Act; and also that there shall be payable
in respect of the various matters provided for in the said
Act such fees as the Governor in Council from time to time
prescribes: Now, therefore, His Excellency the Governor
of New Zealand, in pursuance and exercise of the power
and authority conferred upon him by the said Act, and by
and with the advice and consent of the Executive Council
of the colony, doth hereby make the regulations and pre-
scribe the forms and proceedings hereinafter respectively
set forth, and doth also declare that the fees prescribed in
the Second Schedule shall be payable as therein provided.

REGULATIONS.

  1. Every application under section 5 of the Act shall be in
    the Form A in the First Schedule, and shall be accompanied
    by a statutory declaration by the applicant in Form B, and
    shall have indorsed thereon a certificate of value under the
    hand of the Commissioner of Taxes in Form C.
    Every such application shall be made to the District Land
    Registrar of the Land Registration District in which the
    land to be settled is situated.

  2. The Registrar shall keep a register of all such appli-
    cations and of all proceedings thereon. Each application
    shall be numbered consecutively in the order of reception,
    and shall be referred to by such number in all subsequent
    proceedings relating thereto.

  3. Unless the land the subject of such application com-
    prise the whole of the land in any Crown grant or certificate
    of title a diagram thereof shall accompany the written
    description. If such description or diagram shall, in the
    opinion of the Registrar, be insufficient, the Registrar may
    require an amended description or diagram.

  4. As soon as may be after the receipt of such application,
    the Registrar shall cause the same to be notified in the
    Gazette, and shall require the applicant, at his own cost, to
    insert the like notice in such newspapers published in the
    district or districts within which the applicant has during
    the twelve months immediately preceding such application
    resided or carried on business as the Registrar shall direct.
    Such notice may be in the Form D.

  5. A caveat under section 7 of the Act shall be in the
    Form E, and shall be entered by noting the same in the
    register of applications. No caveat or withdrawal of caveat
    shall be received unless the signature of the caveator is at-
    tested by a Justice of the Peace or solicitor, or by an officer
    of the Land Transfer Department.

  6. Notices under sections 8 and 9 of the Act may be in
    Forms F and G respectively.

  7. The certificate under section 15 of the Act shall be in
    Form H. All such certificates issued in each district shall
    be numbered consecutively, and shall be referred to by such
    number in all proceedings relating thereto.

  8. The Registrar shall not be required to issue any cer-
    tificate until all fees payable by the applicant under these
    regulations have been paid, and all notices required to be
    given by the applicant have been given to the satisfaction
    of the Registrar.

  9. A memorial under section 26 of the Act shall be in
    Form J: Provided that before entering such memorial the
    Registrar shall give to the settlor or to the persons entitled
    in distribution at least one month's previous notice of his
    intention to enter the same.

  10. A notice under section 27 of the Act may be in form K,
    and shall be attested to the satisfaction of the Registrar.
