(2.) The Appellate Court, in dealing with such appeal,
shall not be bound by the terms of the said grant,
nor by any decision of the Supreme Court or of
the Court of Appeal thereon, so far as the terms
of such grant appear to the Appellate Court to be
inconsistent with the equity of the case and the
true rights of the parties:
(3.) The Appellate Court may annul any proceeding in
or order of the Court subsequent to the said deci-
sion so far as may be necessary to give effect to
the judgment of the Appellate Court in the matter
aforesaid:
Provided that nothing herein contained shall prejudicially
affect the right of any lessee of the said land, or of any
person claiming through or under such lessee; but the
Appellate Court may direct to what persons and in what
proportions the rent reserved under any lease shall thence-
forth be payable:
Provided also that any appeal under the provisions of
this section shall be lodged with the Registrar of the Court
within three months from the date of the publication of
notice of the foregoing provisions in the Gazette and Kahiti.

REFERRING to Notice to Mariners No. 45 of 1895,
published by this department on the 8th ultimo, the
following Notice, received from the Marine Board, Port
Adelaide, South Australia, is published for general infor-
mation.

SPENCER GULF, SOUTH AUSTRALIA.—MIDDLE BANK.
Referring to Notice to Mariners dated 17th October, 1895,
notice is now hereby given that on the 15th January, 1896,
it is intended to place a lightship near the western edge of
the Middle Bank, Spencer Gulf.
The vessel, painted red, has one mast (with ball at the
masthead), from which a fixed white light will be exhibited,
visible in ordinary weather at a distance of, say, ten miles.
The vessel will be moored in 4 fathoms water L.W.S., with
Webling Point on with Barn Hill bearing N. 85° 50′ E.
(true), and Plank Point bearing N. 41° 35′ W. (true).
Approximate position—latitude, 33° 37′ 20″ S.; longitude,
137° 33′ E.
This notice affects Admiralty Chart No. 2339b.

Formation of Volunteer Mounted Rifle Battalion.

HIS Excellency the Governor has been pleased to ap-
prove, under paragraphs 211 and 213, Volunteer
Regulations, 1895, of the formation of the under-mentioned
Volunteer corps into a mounted rifle battalion, under the
designation of “The Wellington Mounted Rifle Volunteers,”
with head-quarters at Wanganui, and with effect from the
7th November, 1895—
(A Company) Alexandra Cavalry Volunteers,
(B Company) Wairoa Mounted Rifle Volunteers,
(C Company) Heretaunga Mounted Rifle Volunteers,

Bonus for Destruction of Rabbits.—Notice No. 436.
Department of Agriculture (Live-stock Branch),
Wellington, N.Z., 14th December, 1895.
A BONUS of £1,000 is offered for a practical scheme for
the destruction of rabbits.
The following are the conditions:—
-
All applications for the bonus must be sent addressed
to the Hon. the Minister for Agriculture, Wellington, New
Zealand, and must reach him not later than 31st May, 1896.
Each application must be accompanied by a full description
of the means proposed to be adopted. -
The Government shall appoint a committee of three or
more experts, to whom all applications shall be submitted.
Such committee shall, after perusal, state what schemes
they deem worthy of further consideration, and are satisfied
may be used with absolute safety.
On completion of the committee’s preliminary investiga-
tions each applicant will be notified of the decision arrived
at, and whether or not his individual scheme will be further
inquired into.
The committee may afterwards inspect the whole or any
of the schemes at any place or places within the colony, or
may direct that the whole or any of them be submitted for
trial at such time and place as they may think fit.
The following shall be a basis of the trial:—

A suitable piece of rabbit-infested land shall be allowed
to each applicant (of whose scheme the committee have
approved), and on which he will have full power to carry out
a trial of his scheme for a period not exceeding two years. -
Each applicant on expiry of the period named shall
submit a detailed and accurate statement of the actual
cost incurred in testing his scheme.
On the expiry of the period named the committee shall as
soon as convenient thereafter (should they deem it neces-
sary) make a personal inspection of each applicant’s allot-
ment, and shall take into consideration—
-
The actual cost incurred by each applicant in test-
ing his scheme for the period above mentioned. -
The result of the work done on each allotment.
On completion of the tests the committee shall furnish a
report to the Minister on all the schemes which they have
examined or tested, and shall state—
-
The scheme which they consider on the whole the
most practical, efficient, and economic; and if they consider
such scheme worthy of the bonus. -
Whether, in the event of no one scheme being entitled
to the whole bonus, they deem any one worthy of a part,
and, if so, how much.
The committee has power to withhold all awards if they
think none of the schemes submitted of sufficient import-
ance to merit a bonus.
A sum not exceeding 6d. per acre may be paid to each
competitor whose scheme is accepted for test by the com-
mittee, and who, in the opinion of the committee, has done
work deserving of recognition.

Bonus for the Manufacture of Potassium Cyanide.
Department of Industries and Commerce,
Wellington, 17th January, 1895.
NOTICE is hereby given that a bonus of £1,000 will be
paid for the erection of a plant and the manufacture
in New Zealand of the first 200 tons of crude cyanide of
potassium from colonial produce.
-
The plant must be capable of producing at least 70
tons of crude cyanide of potassium annually. -
The crude cyanide of potassium so manufactured shall
contain at least 70 per cent. of potassium cyanide. -
The bonus will be paid in two equal instalments, the
first instalment being payable on the production of the first
100 tons, and the second instalment on the production of
the second 100 tons, of crude cyanide of potassium contain-
ing the required percentage of potassium cyanide.
