Rectification of the Register of Trade-marks.

IT is hereby notified that the Register of Trade-marks was, on the 18th February, 1896, rectified in pursuance of an order of the Supreme Court of New Zealand, of which a copy is inserted hereunder.

IN THE SUPREME COURT OF NEW ZEALAND,
WELLINGTON DISTRICT.
In the matter of “The Patents, Designs, and Trade-marks Act, 1889”; and in the matter of an application by Price’s Patent Candle Company (Limited).
Upon reading the notice of motion for an order to rectify the Register of Trade-marks filed herein, and the affidavits of William Henry Withall and Herbert Blandy Chapman filed in support thereof; and upon hearing Mr. Izard, of counsel in support of the said motion, and Mr. Skerrett, of counsel for the New Zealand Candle Company (Limited); and by consent, this Court doth order that the Register of Trade-marks kept under the authority of the above-mentioned Act be rectified by the removal therefrom of and by expunging the entries relating to the trade-mark for candles registered in the same register in the names of J. Kitchen and Sons and Apollo Company (Limited), on or about the 25th day of May, 1887, the essential particulars of which trade-mark are that it contains a representation of a ship under sail and steam, with the words “British Sperm Candles” above and below such representation, and of which trade-mark the New Zealand Candle Company is now the registered proprietor by assignment from the said J. Kitchen and Sons and Apollo Company (Limited).
