Proclaiming Borough of Mataura, County of Southland.

A PROCLAMATION.

WHEREAS by “The Municipal Corporations Act,
1886,” the Governor is empowered, by Proclamation,
to declare any portion of the Colony of New Zealand to be a
borough under the said Act from and after a day to be named
in such Proclamation :

Now, therefore, I, David, Earl of Glasgow, the Governor
of the said Colony of New Zealand, in pursuance and exercise
of the powers and authorities vested in me by the said Act,
do hereby proclaim and declare that the district described in
the Schedule hereto shall be, and the same is hereby con-
stituted, as from the first day of November, one thousand
eight hundred and ninety-five, a borough under the said Act ;
and I do further proclaim and declare that the name of such
borough shall be the Borough of Mataura ; and that the
boundaries thereof shall be those described in the said
Schedule hereto.

SCHEDULE.

All that area in the Provincial District of Otago, in the
Colony of New Zealand. Bounded towards the south and
west by the left bank of the Waimumu Stream, from its
outflow into the Mataura River to the north-west angle of
Section No. 34, Block VII., Township of Mataura ; thence
toward the north by a line due east to the Mataura River ;
thence towards the south-east by the right bank of the
Mataura River aforesaid to a point in line with the north-
eastern boundary-line of Section No. 74, Block XVII.,
Town of Mataura Bridge ; thence towards the north-east
by a right line across the Mataura River aforesaid to
and along the said north-eastern boundary-line of said
Section No. 74, and that boundary-line produced to the east
boundary of the said Town of Mataura Bridge ; thence again
towards the east and towards the south by the eastern and
southern boundary-lines of said Town of Mataura Bridge to
the Mataura River ; thence by a right line to the place of
commencement.

Given under the hand of His Excellency the Right
Honourable David, Earl of Glasgow ; Knight
Grand Cross of the Most Distinguished Order of
Saint Michael and Saint George ; Governor and
Commander-in-Chief in and over Her Majesty's
Colony of New Zealand and its Dependencies ;
and issued under the Seal of the said Colony,
at the Government House, at Wellington, this
thirtieth day of October, in the year of our Lord
one thousand eight hundred and ninety-five.

Regulations for Trout- and Perch-fishing, Auckland Accli-
matisation District.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-
eighth day of October, 1895.

Present :

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance of the powers and authorities vested in him
by “The Fisheries Conservation Act, 1884,” His Excel-
lency the Governor of the Colony of New Zealand, acting by
and with the advice and consent of the Executive Council
of the said colony, doth hereby make the following regula-
tions for all that part of the colony known as “The Auck-
land Acclimatisation District,” as the same is defined in the
said regulations, and the waters thereof, except as herein-
after mentioned ; and doth hereby declare that these regula-
tions shall, as from the date of the publication thereof in the
New Zealand Gazette, supersede all regulations at variance
therewith.

REGULATIONS.

  1. Licenses to fish for trout and perch in all waters within
    that district or part of the North Island known as “The
    Auckland Acclimatisation District,” which includes the
    Provincial District of Auckland, with the exception of the
    Counties of Tauranga, Whakatane, Waiapu, and Cook, may be
    issued under the hand of the Secretary of the Auckland Accli-
    matisation Society (hereinafter termed “the said society”),
    or any one authorised by the said Secretary in that behalf :
    Provided, however, that all fishing is prohibited in that por-
    tion of the Waimakariri River, near Oxford, extending from
    the bridge over the said river on the Oxford-Rotorua Road
    for a distance of half a mile below the said bridge.

  2. For every license to fish for trout and perch in the
    waters in the Auckland Acclimatisation District, issued
    to men under the hand of the Secretary of the Auckland
    Acclimatisation Society, or any one authorised by the said
    Secretary in that behalf, a fee of one pound will be charged.

  3. The Secretary of the said society or his deputy may
    issue licenses for the whole season to ladies for the sum of
    five shillings each ; and to boys under the age of sixteen
    years for the whole season for the sum of ten shillings each ;
    and to men, on and after the fifteenth day of January in any
    year, and until the thirty-first day of March in the same
    year, for the sum of twelve shillings and sixpence each.

  4. Any holder of a license may fish with one rod and line
    for trout and perch, and may use a landing-net or gaff to
    secure any trout or perch caught with such rod and line, in
    all waters (except in that portion of the Waimakariri River
    mentioned in regulation one) within “The Auckland Accli-
    matisation District,” from the fifteenth day of November in
    any one year to the thirty-first day of March in the year
    following, both inclusive.

  5. No license shall authorise any person other than the
    person named therein to fish, and that with natural or arti-
    ficial fly, insect, worm, or fish only.

  6. No person shall have in his possession any of the
    salmonidæ or trout between the third day of April and the
    fourteenth day of November, which period is hereby appointed
    a close season for all such fish : Provided always that this
    regulation shall not apply to fish caught by the officers of
    the said society for purposes of acclimatisation.

  7. No person shall put, throw, or place, or allow to be put,
    thrown, or placed, into any river or stream, or at the mouth
    or entrance of any such river or stream, any dynamite or
    other explosive substance, or any sawdust or sawmill refuse,
    or anything of any kind or description whatever poisonous,
    deleterious, or noxious to fish.

  8. No person shall take, fish for, catch, or kill, in any
    manner whatever, or have in his possession, any salmon,
    salmon-parr, or smolts, or the ova, young, or fry of any
    salmon in any stage whatever ; and any of the above-named
    taken by accident or otherwise shall immediately be returned
    to the water from whence it was taken.

  9. No person shall fish for trout or perch without a
    license, and every person fishing shall, on demand of any
    ranger, constable, member of the said society, or person
    producing a license, produce and show to such ranger, mem-
    ber, constable, or person his license, and the contents of his
    creel or bag, and the bait used by him for taking, catching,
    or killing such trout or perch.

  10. Every trout not exceeding nine inches in length from
    nose to tip of tail, taken or caught by any person, shall
    immediately be returned alive into the water from which
    the same is taken.

  11. No person shall take, catch, or kill any perch under
    six inches in length, nor shall perch be taken, caught, or
    killed at all, or had in possession of any person, between the
    third day of April and the fourteenth day of November in
    any year.

  12. No cross-line fishing, stroke-hauling, or any other
    unsportsmanlike device shall be used for the purpose of
    taking, catching, or killing trout or perch ; nor shall any of
    the above-mentioned baits be used with any medicated or
    chemical preparation whatever.

  13. Except as aforesaid, no person shall fish with or use
    any net or other engine, instrument, or device for taking
    fish in any river or stream within the district aforesaid, or
    at the mouth or entrance of any such river or stream.

  14. For the purposes of these regulations the mouth of
    every such river or stream shall be deemed to include every
    outlet of the same and the sea-shore between such outlets,
    and shall extend over a radius of one-quarter of a mile from
    the point or line where the waters of such river or stream
    meet those of the sea or of any harbour at low-water.

  15. No person shall buy, sell, or expose or offer for sale, or
    shall fish for the purpose of obtaining for sale, any salmon,
    trout, or perch, or any part thereof.

  16. The penalty for the breach of any of these regulations
    shall not be less than forty shillings or more than fifty
    pounds.

  17. If any person shall be convicted of any offence against
    these regulations the license (if any) held by the offender
    shall thereupon become void.
