(4.) Memorandum of transfer, dated the 10th July, 1891,
by the Registrar of the Supreme Court at Gisborne
to the said Bank of New Zealand Estates Company
(Limited).
(5.) Memorandum of agreement, dated the 17th February,
1892, made between the said Bank of New Zealand
Estates Company (Limited), William Lee Rees, and
the applicants, for transfer of all interests herein to
the said applicants.
a. The address for service of the applicants in the Town of
Gisborne is at the offices of Messrs. Rees and Day, Gladstone
Road.
n. The applicants desire the estates and interests of the
said Natives mentioned in paragraph c hereof bound by
the decrees of this Court, and for that purpose require that
copies of their application may be served on them or their
representatives according to the list herewith. The appli-
cants desire that all other persons who claim to be interested
in this land should be treated as parties to these proceed-
ings.

Application to the Validation Court under “The Native Land
(Validation of Titles) Act, 1893.”
IN THE VALIDATION COURT,
HELDEN AT GISBORNE.
In the matter of “The Native Land (Validation of Titles)
Act, 1893”; and in the matter of the Maraetaha No. 2
Block.
a. WE, James Carroll and Wiremu Pere, both of Gis-
borne, members of the House of Representatives
of New Zealand, apply under the above-named Act for the
validation of a contract made between the whole of the
Native owners of the Maraetaha No. 2 Block (which said
block of land is situated in the Native Land Court District
of Gisborne, and contains 23,705 acres, more or less) and the
New Zealand Native Land Settlement Company (Limited).
b. We desire to appear before the Validation Court on
Wednesday, the 28th day of August, 1895, at the hour of 10
o’clock in the forenoon, or so soon thereafter as counsel can
be heard in that behalf.
c. The nature of the transaction proposed for validation is
a contract made on or about the 17th day of May, 1882,
between the whole of the owners of the Maraetaha No. 2
Block and the New Zealand Native Land Settlement Com-
pany (Limited) for the transfer to the said company by the
whole of the owners of the said land of the said block of
land in trust for the Native owners thereof, in accordance
with the articles of association of the said company. The
said company on its part carried out the said contract, and
expended large sums of money in paying for the surveys of
the said land and on account of other matters in connection
with the said land.
d. The land which was intended to be alienated by the
above-mentioned contract was the block of land, called Marae-
taha No. 2, above described, the original title to which is a
certificate of title under “The Native Land Court Act, 1880,”
bearing date the 16th day of May, 1882.
e. The manner in which and the persons through whom
the applicants came to be invested with the title to the said
land which they now hold is as follows:—
(1.) Contract as above set out between the Native
owners of the said Maraetaha No. 2 Block and
the New Zealand Native Land Settlement Company
(Limited).
(2.) Memorandum of mortgage, dated the 3rd day of July,
1888, by the said New Zealand Native Land Settle-
ment Company (Limited) to the Bank of New
Zealand.
(3.) Memorandum of transfer, dated the 5th day
of August, 1890, by the said Bank of New Zea-
land to the Bank of New Zealand Estates Company
(Limited).
(4.) Memorandum of transfer, dated the 10th day of July,
1891, by the Registrar of the Supreme Court of
New Zealand at Gisborne to the said Bank of New
Zealand Estates Company (Limited).
(5.) Memorandum of agreement, dated the 17th day of
February, 1892, between the said Bank of New
Zealand Estates Company (Limited) of the first
part, William Lee Rees, of Gisborne, solicitor, of
the second part, and the said applicants of the third
part.
f. The estate in the said land which the said applicants
seek to obtain is an estate in fee-simple.
g. The address for service of the applicants in the Town of
Gisborne is at the office of Messrs. Rees and Day, solicitors,
in Gladstone Road.
h. The applicants desire the estates and interests of the
whole of the Native owners of the said land, and the estates
and interests of all the several parties mentioned in para-
graph r of this application, through whom the said applicants
claim, bound by the decrees of this Court, and for that pur-
pose require that copies of this application be served on them
or their representatives, according to the list herewith; and
the applicants desire that all others who may claim to be
interested in this matter shall be treated as parties to these
proceedings.
