Vesting the Mokihinui Railway in the Queen.

A PROCLAMATION.

WHEREAS, for the purpose of vesting in Her Majesty
the railway constructed near the Mokihinui River
by the Mokihinui Coal Company (Limited) (as such railway
is more particularly described in the Schedule hereto) the
Governor is empowered by section 4 of "The Westport-
Ngakawau Railway Extension Act 1890 Amendment Act,
1894" (hereinafter referred to as "the said Act"), to issue a
Proclamation formally taking such railway under the provi-
sions of "The Public Works Act, 1882," but without
complying with the provisions of that Act as to defining the
middle line thereof, or as to the deposit of maps and plans:
And whereas it is expedient that a Proclamation shall be
issued as aforesaid formally taking such railway:
Now, therefore, I, David, Earl of Glasgow, the Governor of
the Colony of New Zealand, in exercise of the powers and
authorities conferred on me by the said Act, and by "The
Public Works Act, 1894," and of every other power and
authority in any wise enabling me in this behalf, do hereby
proclaim and declare that the said railway, as more par-
ticularly described in the Schedule hereto, is hereby taken
and vested in Her Majesty.

SCHEDULE.

The railway constructed by the Mokihinui Coal Company
(Limited) upon the lands hereinafter mentioned, commencing
at the present terminal point of the Westport-Ngakawau
Railway, and extending from the shipping-place near the
mouth of the Mokihinui River to the said company's mine,
for a distance of 3 miles 68 chains or thereabouts, and which
said railway is worked in connection with the company's
coal-mining lease, granted on or about the 30th day of June,
1888, under the provisions of "The Westland and Nelson
Coalfields Administration Act, 1877," and including all those
lands reserved for the use of the said railway, and more par-
ticularly described in Orders made by the Governor in Council
on the 29th day of June, 1886, and the 27th day of March,
1888, and delineated on the plans marked P.W.D. 13783 and
15037 respectively, deposited in the office of the Minister for
Public Works, at Wellington, and thereon coloured red,
purple, and green, together with all other lands reserved to
or held by the company for the use of the said railway,
together with all rights, easements, and appurtenances
thereto belonging or appertaining.

Given under the hand of His Excellency the Right
Honourable David, Earl of Glasgow; Knight
Grand Cross of the Most Distinguished Order of
Saint Michael and Saint George; Governor and
Commander-in-Chief in and over Her Majesty's
Colony of New Zealand and its Dependencies,
and Vice-Admiral of the same; and issued under
the Seal of the said Colony, at the Government
House, at Wellington, this second day of May, in
the year of our Lord one thousand eight hundred
and ninety-five.

Native Land proposed to be taken for Construction of
Drainage-works in Aorangi Drainage District.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this eighth
day of April, 1895.

Present:

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

WHEREAS the lands mentioned in the Schedule hereto
are required to be taken for a public work, to wit,
the construction of drainage-works in Aorangi Drainage
District:
And whereas the said lands are held or occupied by Native
owners under a title which is not derived from the Crown:
And whereas a map in duplicate has been prepared of the
said lands by the Aorangi Drainage Board, as required by
the eighty-eighth section of "The Public Works Act, 1894":
Now, therefore, in pursuance and exercise of the powers
vested in him by the eighty-eighth section of the said Act,
and of "The Land Drainage Act, 1893," and of all other
powers in anywise enabling him in this behalf, His Excel-
lency the Governor of the Colony of New Zealand, by and
with the advice and consent of the Executive Council of the
said colony, doth hereby declare that the land shown upon
such map, and described in the Schedule hereto, shall be
deemed to be taken for the purpose of the said drainage-
works, and the said land shall vest in the Aorangi Drainage
Board, as from the first day of June, one thousand eight hun-
dred and ninety-five.

above mentioned, deposited in the Head Office of the Depart-
ment of Lands and Survey, at Wellington, in the Wellington
Land District, and thereon coloured blue.

Regulations under "The Government Advances to Settlers
Act, 1894."

GLASGOW, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-
fifth day of April, 1895.

Present:

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authority
vested in him in and by "The Government Advances
to Settlers Act, 1894," and of all other powers and authorities
enabling him in this behalf, His Excellency the Governor of
the Colony of New Zealand, by and with the advice and
consent of the Executive Council of the said colony, doth
hereby make the several regulations set forth in the Schedule
hereto, and doth declare that such regulations shall come
into force and take effect on the date of the publication
thereof in the New Zealand Gazette.

SCHEDULE.

  1. A DECLARATION in the following form shall be made and
    subscribed by every person heretofore or hereafter appointed
    or employed under "The Government Advances to Settlers
    Act, 1894," or in the Government Advances to Settlers Office;
    and every such declaration shall be made and subscribed
    before the Superintendent, or the Deputy Superintendent, or
    before any Justice of the Peace:—

I, , of , do hereby declare that I will truly
and faithfully, according to the best of my skill and know-
ledge, perform the duties imposed upon me in respect of any
employment by or under "The Government Advances to
Settlers Act, 1894," or any regulations for the time being in
force thereunder, and that I will not divulge or communicate
to any person whomsoever, except as may be authorised by
law for the purpose of carrying into effect the provisions of
the said Act or any regulations as aforesaid, any matter or
thing coming to my knowledge in the performance of my
said duties in respect of the business of the Government
Advances to Settlers Office, or otherwise in relation thereto.

This declaration was made before me at , on this
day of , 18 :

  1. The following proviso is added to clause 23 of the regu-
    lations made under "The Government Advances to Settlers
    Act, 1894," by Order in Council of the 3rd day of December,
    1894:—

"Provided that, when the application for an advance has
been refused without a valuation of the security offered
having been made, the Superintendent may refund to the
applicant the whole, or such proportion as he may think just,
of the valuation-fee paid as aforesaid."
