Native Land proposed to be taken for Construction of
Drainage-works in Aorangi Drainage District.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this eighth
day of April, 1895.
Present:
THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.
WHEREAS the lands mentioned in the Schedule hereto
are required to be taken for a public work, to wit,
the construction of drainage-works in Aorangi Drainage
District:
And whereas the said lands are held or occupied by Native
owners under a title which is not derived from the Crown:
And whereas a map in duplicate has been prepared of the
said lands by the Aorangi Drainage Board, as required by
the eighty-eighth section of "The Public Works Act, 1894":
Now, therefore, in pursuance and exercise of the powers
vested in him by the eighty-eighth section of the said Act,
and of "The Land Drainage Act, 1893," and of all other
powers in anywise enabling him in this behalf, His Excel-
lency the Governor of the Colony of New Zealand, by and
with the advice and consent of the Executive Council of the
said colony, doth hereby declare that the land shown upon
such map, and described in the Schedule hereto, shall be
deemed to be taken for the purpose of the said drainage-
works, and the said land shall vest in the Aorangi Drainage
Board, as from the first day of June, one thousand eight hun-
dred and ninety-five.

land is more particularly delineated on the plans marked as
above mentioned, deposited in the Head Office of the Depart-
ment of Lands and Survey, at Wellington, in the Wellington
Land District, and thereon coloured blue.

Prescribing Minimum Size or Weight at which Fish may
be taken.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this seven-
teenth day of April, 1895.

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.
WHEREAS by Order in Council dated on the tenth
day of January, one thousand eight hundred
and eighty-eight, His Excellency the then Governor, pur-
suant to power in that behalf conferred by "The Fisheries
Conservation Act, 1884," made certain regulations there-
under, and amongst them a regulation, numbered ten,
providing, inter alia, that no person should take, buy, sell,
expose for sale, or have in possession any fish of the
species enumerated in the Schedule thereto of a less
weight or size than that set opposite the name of such fish:
And whereas the aforesaid Act is repealed, but the said
regulations are continued in force by virtue of the repealing
Act, to wit, "The Sea Fisheries Act, 1894" (hereinafter
called "the said Act"): And whereas by the said Act it is
provided that the Governor in Council may make regulations
prescribing, inter alia, the minimum size or weight of any
fish that may be taken: And whereas the aforesaid regula-
tion, numbered ten, has been found to work hardship in
certain cases:
Now, therefore, His Excellency the Governor, in pursuance
and exercise of the powers conferred upon him by the said
Act, and of all other the powers and authorities him enabling
in that behalf, and by and with the advice and consent of
the Executive Council of the said colony, doth hereby
revoke the aforesaid regulation numbered ten, and also the
aforesaid Schedule, and in lieu thereof doth hereby make
the following regulation, that is to say:—
REGULATION.
Any person who takes, buys, sells, exposes for sale, or has
in possession any fish of any of the species enumerated in the
Schedule hereto of a less weight or size than that set oppo-
site the name of such fish in the said Schedule, is liable to
a penalty not exceeding twenty pounds:
Provided that for the purposes of this regulation, and dur-
ing a period of three months from the date hereof (but no
longer), a person shall not be deemed to take or have in
possession any fish if, having unintentionally caught the
same in a net or seine of lawful mesh whilst lawfully fishing
therewith, he returns all such fish to the water when sorting
out the haul.
