Terms and Conditions of Lease of Village Allotments in the Momahaki Village Settlement.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this seventeenth day of January, 1894.

WHEREAS by the one hundred and sixty-ninth section of “The Land Act, 1892,” it is enacted that the Governor in Council may fix the terms and conditions upon which the lands in any village settlement shall be disposed of, subject as in the said section is provided: And whereas by a Proclamation made under the said Act of like date herewith, and published in the New Zealand Gazette on the twenty-seventh day of February, one thousand eight hundred and ninety-four, the lands described in the First Schedule hereto have been set apart under the said Act and declared open for lease as a village settlement, and it is expedient to fix the terms and conditions upon which the said lands shall be disposed of:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities conferred by the said Act, and by and with the advice and consent of the Executive Council of the said colony, doth hereby fix the terms and conditions on which the lands mentioned in the First Schedule hereto shall be disposed of, at the option of the applicant, either for cash, for occupation with right of purchase, or on lease in perpetuity, and which said terms and conditions are set forth in the Second Schedule hereto.

SECOND SCHEDULE.

  1. THE lands enumerated in the First Schedule hereto are first-class lands.

  2. The lands in the First Schedule are divided into village allotments, open on lease in perpetuity, under the provisions of “The Land Act, 1892” (hereinafter referred to as “the said Act”).

  3. The day on which the said lands shall be open for application shall be Tuesday, the 27th day of February, 1894.

  4. The rental stated in the First Schedule hereto shall be the price at which the lands shall be open for application.

  5. Applications shall be made in manner as provided in Part I. of the said Act; and all such applications shall be made to the Commissioner of Crown Lands, Wellington and Waverley.

  6. Each applicant shall state his or her residence, occupation, and condition in life (namely, whether married or single), and will be required to make the declaration prescribed in the said Act, according to the tenure under which the land is applied for.

  7. All rents must be paid half-yearly, in advance, on the 1st days of January and July in each year, as provided in section 157 of the said Act; and the first half-year’s rent is payable as before provided. The next half-year’s rent will become due on the 1st day of January, 1895.

  8. Improvements and residence on the land comprised in each lease shall be as provided in Part III. of the said Act. The provisions of section 144, and all other provisions of the said Act with respect to substantial improvements, shall apply accordingly to lessees under these regulations. The provisions of section 141, and all other provisions of the said Act in respect of compulsory residence, shall apply accordingly to lessees under these regulations.

  9. No lessee shall subdivide, sublet, or transfer the land held by him under these regulations, except under and subject to the provisions of Part I. of the said Act.

  10. No person shall hold more than one section of the lands enumerated in the First Schedule.

  11. All the provisions of the said Act, so far as applicable, shall extend and apply to the lands affected by these regulations, and to the applications and leases to be made and issued thereunder, and generally to the interests created, and the persons whose rights, liabilities, or interests are thereby affected; and the mention of any particular provision of the said Act shall not be deemed to exclude any other provision of the said Act applicable to the particular case.

Pukaka River Land Drainage District constituted.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this seventeenth day of January, 1894.

Present:

THE HONOURABLE SIR P. A. BUCKLEY, K.C.M.G.,
PRESIDING IN COUNCIL.

WHEREAS, in accordance with the provisions of the fifth section of “The Land Drainage Act, 1893,” a majority of the ratepayers in the district described in the Schedule hereto, situated in the County of Marlborough, have presented a petition to His Excellency the Governor of the Colony of New Zealand praying that the land comprised in the said district be constituted a drainage district under the provisions of the said Act: Now, therefore, in pursuance and exercise of the power and authority contained in the fifth section of “The Land Drainage Act, 1893,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby constitute and declare the block of land described in the said petition, and in the Schedule hereto, to be a district for the purposes of Part I. of the said Act, and to be called by the name of “The Pukaka River Drainage District”; and also, in pursuance and exercise of the power and authority contained in the ninth section of the said Act, doth hereby declare that the Board of Trustees for the said district shall consist of five members, to be elected under and in accordance with the said Act.


SCHEDULE.

BOUNDED towards the north by part of the southern boundary of Section No. 40, Picton Suburban, and the south-eastern boundary of Section No. 41, Picton Suburban; thence by part of the northern boundary of the same section to a point in transit with the eastern boundary of Section No. 7, Tuamarina Run, and by that boundary extended to the north-eastern corner of Section No. 7 aforesaid; thence by Crown land to the north-western corner of Section No. 9, Tuamarina Run, and by the western and part of the south-eastern boundary of that section to the north-western corner of Section No. 11, Marshland Run: towards the east by Sections Nos. 11, 10, and 7, Marshland Run, and Nos. 44 and 45, Picton Suburban, and north-east by Section No. 45 aforesaid; thence by Crown land until it reaches the north-western boundary of Section No. 4, north bank of Wairau; thence by that section to its most southerly point; and thence by a reserve for a village and a Native reserve to a small creek: towards the south-west by a Native reserve to the Wairau River; thence towards the west by that river to a point in transit with the eastern boundary of a road-line numbered 116, and by that boundary extended and produced to the Wairau River aforesaid; thence by that river to a point in transit with the eastern boundary of Section No. 52,
