His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the nineteenth day of September, one thousand eight hundred and ninety, making delegation of certain powers in manner as therein appears; and doth, with the like advice and consent, by this present Order, delegate, but only with respect to the piece or parcel of land described in the Schedule hereto, all the powers conferred by the Act aforesaid, except the powers under or conferred by sections five and twelve thereof, to the under-mentioned persons, who shall be known as the Moa Flat and Ettrick Public Domain Board, namely,—

EDWARD TUBMAN,
WILLIAM WESTCOTT,
ROBERT McLEOD,
JAMES McINTOSH, and
JAMES ALLEN

(hereinafter referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the first Monday in each month, at seven o'clock p.m., at the office of the Chairman, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Monday, the second day of April, one thousand eight hundred and ninety-four.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days' notice of such meeting be given to each member, specifying the business to be transacted at such special meeting, and no other business than that so specified shall be transacted at such meeting.

  3. Any three of the said Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the first Monday in January in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  5. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.

  6. If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.

  7. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

SCHEDULE.

ALL that parcel of land in the Provincial District of Otago, containing by estimation 420 acres, more or less, being Section No. 44, Block I., situate in the Benger District. Bounded towards the west by Block I., 9743 links; towards the north-east by the Clutha River, 12000 links; towards the south by a line commencing at the Clutha River, and proceeding due west across Trigonometrical Station B; and thence by a road-line extending in the same direction to Block I., 6000 links: be all the aforesaid linkages more or less; excepting out of the above description Cemetery Reserve and road-line thereto.

Reserve in Hawke's Bay appropriated as a Site for a Public School.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this second day of March, 1894.

Present:

THE HONOURABLE THE COLONIAL SECRETARY PRESIDING IN COUNCIL.

WHEREAS the land mentioned in the first column of the Schedule hereto was reserved, under section two hundred and twenty-seven of “The Land Act, 1885,” for metal:

And whereas the said reserve is one comprised within the purposes mentioned in Class I. of the Schedule to “The Public Reserves Act, 1881,” and has not been vested in trust in any society, body corporate, or trustees; and it is expedient that such reserve shall be appropriated for the purpose of a reserve, under Class III. of the said Act, as hereinafter mentioned:

Now, therefore, I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, in exercise of the powers and authorities vested in me by section two of “The Public Reserves Act Amendment Act, 1889,” do by this notification declare that from the twelfth day of March, one thousand eight hundred and ninety-four, the land comprised and described in the first column of the Schedule hereto shall be appropriated for the purpose mentioned in the second column of the said Schedule, the same being a purpose for which a reserve may be made under that part of Class III. of “The Public Reserves Act, 1881,” which relates to reserves for education, charitable purposes, or recreation.

Description of Reserve. Purpose to which Reserve is to be appropriated.
All that parcel of land in the Land District of Hawke's Bay, containing by admeasurement 4 acres, more or less, being Section No. 22, Block II., Woodville Survey District. Bounded towards the north-east by a public road, 457 links; towards the east by Section No. 21, 1286 links; towards the south by a public road, 215 links; and towards the west by a public road, 1590 links: be all the aforesaid linkages more or less. A site for a public school.

Removal of Restrictions on Alienation of Native Land.

GLASGOW, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this second day of March, 1894.

Present:

THE HONOURABLE THE COLONIAL SECRETARY PRESIDING IN COUNCIL.

WHEREAS application has been made to the Governor in Council by Roera and Wiremu Rakatau, being a majority in number of the Native owners of the land described in the second column of the Schedule hereto, praying that the restrictions on the alienation of such land contained in the Crown grant bearing date the second day of February, one thousand eight hundred and eighty-five, described in the first column of the said Schedule, may be removed: And whereas inquiry has been duly made by the Native Land Court, and the said Court has reported that the provisions of the law in that behalf have been complied with: And whereas it appears expedient to grant such application:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred on him by “The Native Land Act, 1888,” and acting with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that all restrictions imposed by the said Crown grant on the alienation of the said land are hereby removed.

Crown grant, Registered No. 17237, dated the 2nd February, 1885, in favour of Te Rakatau, and containing the following restrictions: “Inalienable by sale, or by lease for a longer period than twenty-one years, or by mortgage, except with the consent of the Governor being previously obtained to every such sale, lease, or mortgage.” All that parcel of land, containing 150 acres, being Section No. 35, Block XI., Waitara Survey District.
