Lands set apart for Settlement.

A PROCLAMATION.

WHEREAS by the second section of "The Government Loans to Local Bodies Act Amendment Act, 1891" (herein termed "the said Act"), it is, amongst other things, enacted that, before certain moneys therein mentioned shall be expended upon any block of land, it shall be necessary that the same be proclaimed as set apart for settlement:

Now, therefore, in pursuance and exercise of every power and authority enabling me in this behalf, and for the purposes of the said Act, I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, do hereby proclaim the block of land described in the Schedule hereto as set apart for settlement.

SCHEDULE.

TE NGAIRE BLOCK:

All that area in the Taranaki Land District, containing by admeasurement 7,500 acres, more or less, situated in Ngaire Survey District, and bounded towards the north-east by Subdivision 1 of the Pukengahu Block; towards the south-east by Sections Nos. 17, 12, and 11 of Block XII., by Sections Nos. 7, 6, and 5 of Block XI., and Sections Nos. 32 and 31 of Block XV.; towards the south-west by Section No. 9 of said Block XV., by Sections Nos. 4, 3, 2, and 1 of Block XI., by Sections Nos. 55, 54, 53, 34, and 33 of Block X.; and towards the north-west by Sections Nos. 33, 26, and 25 of said Block X., and by Sections Nos. 48, 49, and 73 of Block VI., and by Section No. 13 of Block VII.

Given under the hand of His Excellency the Right Honourable David, Earl of Glasgow; Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over Her Majesty's Colony of New Zealand and its Dependencies, and Vice-Admiral of the same; and issued under the Seal of the said Colony, this fifth day of March, in the year of our Lord one thousand eight hundred and ninety-four.

Prescribing Dues and Rates and making Regulations for the Kaikoura Wharf and Goods-shed.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-third day of February, 1894.

Present:

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

WHEREAS it is provided by "The Harbours Act, 1878" (hereinafter termed "the said Act"), that in harbours where there is no Harbour Board the Governor in Council shall have all the powers, functions, duties, and authorities by such Act conferred upon Harbour Boards, and may exercise the same under regulations to be made in manner provided in section two hundred and twelve of the said Act: And whereas there is no Harbour Board having jurisdiction in the Harbour of Kaikoura: And whereas it is provided by section four of "The Harbours Act Amendment Act, 1879," that the power granted to the Governor in Council by the seventeenth section of "The Harbours Act, 1878," in respect of prescribing what dues and rates may be charged on wharves vested in local bodies, may be exercised from time to time as occasion may require, and shall not be limited as in the said section is provided: And whereas dues and rates to be charged for the use of the Kaikoura wharf and goods-shed (the management of which was by Order in Council dated the second day of July, one thousand eight hundred and eighty-three, vested in the Kaikoura County Council) were prescribed by Orders in Council dated the fifteenth day of January, one thousand eight hundred and eighty-nine, the seventeenth day of February, one thousand eight hundred and ninety, and the thirtieth day of December, one thousand eight hundred and ninety-three: And whereas it is expedient to revoke such three last-named Orders in Council, and the dues, rates, and regulations thereby fixed and made, and to prescribe and make other dues, rates, and regulations in lieu thereof:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in pursuance and exercise of the powers and authority granted to him by the said Act, "The Harbours Act Amendment Act, 1879," and of all other powers and authorities enabling him in that behalf, doth hereby revoke the Orders in Council of the fif-

teenth day of January, one thousand eight hundred and eighty-nine, of the seventeenth day of February, one thousand eight hundred and ninety, and of the thirtieth day of December, one thousand eight hundred and ninety-three, prescribing dues and rates to be charged for the use of the Kaikoura wharf and goods-shed, and making regulations for the same, and doth hereby prescribe that the dues and rates specified in the First Schedule hereto shall be charged and taken, on and after the date of this Order in Council, for the use of the said wharf and goods-shed; and such dues and rates shall be applied to keeping the above-mentioned wharf and goods-shed, and all erections on the wharf, in good order and repair, as provided in the said Order in Council of the second day of July, one thousand eight hundred and eighty-three.

And His Excellency the Governor of the said colony, with the like advice and consent, and in pursuance and exercise of the power and authority granted to him by the said Act, and of all other powers and authorities enabling him in that behalf, doth hereby make the regulations contained in the Second Schedule hereto, and doth order that the same shall, on and after the date of this Order in Council, apply to the Port or Harbour of Kaikoura and to the wharf aforesaid.

FIRST SCHEDULE.

On all goods or merchandise not otherwise specified, s. d. weight or measurement, per ton, with labour 2 0 Ditto, without labour 1 0 Grass-seed, bran, pollard, and grain (wheat, oats, &c.), per bag, with labour 0 2 Ditto, without labour 0 1 Timber, inwards or outwards, per 100ft. superficial, with labour 0 3 Horses and great cattle, each 2 6 Calves, goats, and pigs, each 0 3 Sheep and lambs, each, inwards 0 3 Ditto, outwards 0 1 Vehicles, each 4 0 Wool, per bale, with labour 0 3 Hay and chaff, per ton weight, with labour 2 0 Ditto, without labour 1 0 Coal and tallow, per ton weight, with labour 1 6 Potatoes, per ton of 12 bags 0 9 Beer, in casks or cases, 4 or 8 dozen (8 to be the ton as casks), per ton, with labour 4 0 Casks (hogsheads 4 to the ton, quarters and barrels 6 to the ton, octaves 12 to the ton, kegs 20 to the ton), per ton, with labour 4 0 Empty casks to be charged half rates.
