the Government to any land purchased by it. Where land subject to this Act is also subject to a lease for an unexpired term of years, any order made as aforesaid shall not prejudice the estate or term of the lessee, but the lessee after notice of such order shall pay any rent to accrue due under his lease to the Public Trustee, whose receipt shall be a good discharge for the same.

Such rent shall be paid out to and among the parties beneficially entitled in accordance with any partition or determination of interest as aforesaid.

Third Schedule.

The Native Trusts and Claims Definition and Registration Act, 1893” (Section 2).

  1. To enable cestuis que trustent to become the certificated owners of the lands to which they are entitled, the provisions of sections two to five of “The Native Equitable Owners Act, 1886” (herein referred to as “the said Act”), shall apply to the lands in the Bay of Plenty District more particularly referred to in “The Whakatane Grants Validation Act, 1878,” and which have been granted to persons who were selected to be trustees thereof for themselves and others, but who have been placed by such grants in the position of absolute owners of such lands.

Notwithstanding anything contained in section eighteen of “The Native Land Court Acts Amendment Act, 1889,” any application for the purposes of this section may be made under section two of the said Act to the Native Land Court (herein referred to as “the Court”) before the expiration of three years from the date of the commencement of this Act, but not afterwards.

Notice of the passing and of the effect of this Act shall immediately be given to the Natives affected, in such manner as the Governor in Council shall determine.

IN pursuance and exercise of the powers conferred upon me by the sixth section of “The Land Act, 1892,” I, James Prendergast, Knight, Chief Justice, in the name and on behalf of His Excellency the Governor of the Colony of New Zealand, and as his duly-appointed Deputy, do hereby declare that from and after the day of the date hereof the notification issued on the eighteenth day of March, one thousand eight hundred and ninety-three, opening land for sale or selection under the provisions of Part III. of “The Land Act, 1892,” shall be and the same is hereby revoked in so far as it relates to the sections of land mentioned in the Schedule hereto.

Rural Lands in the Canterbury Land District open for Selection on Lease in Perpetuity.

IN pursuance and exercise of the powers and authorities conferred upon me by “The Land for Settlements Act, 1892,” and the one hundred and thirty-sixth section of “The Land Act, 1892,” I, Sir James Prendergast, Knight, Chief Justice, in the name and on behalf of His Excellency the Governor of the Colony of New Zealand, and as his duly-appointed Deputy, having received the report of the Surveyor-General in this behalf, as in the said one hundred and thirty-sixth section is provided, do hereby declare that the rural lands enumerated in the Schedule hereto shall be open for selection on and after the twenty-seventh day of December, one thousand eight hundred and ninety-three; and that the said lands may be selected on lease in perpetuity, subject to the provisions of “The Land Act, 1892”; and I do hereby declare that the rentals at which the said lands shall be leased shall be those mentioned in the said Schedule hereto opposite the description of such lands respectively.

These sections are situated adjacent to the main line of railway, about two miles south of the Studholme Junction Railway-station, from which there is good access by the Main South Road and Meikle’s Road, both of which are formed but not metalled. The road along the northern boundary of the block is only formed in front of Lots 2 and 3. The block comprises, for the most part, flat agricultural land of good quality, at present laid down in English grasses, and surrounded by sod and gorse fences which are overgrown and require trimming. There are numerous waterholes on the sections, but the deepest of these are generally dry in summer. On Section 4 there is a four-roomed wooden cottage, a nine-stalled stable with carthouse and loft combined, a good artesian well, a plantation of blue-gums, containing about nine hundred trees of moderate size and a number of saplings, also gorse subdivision fences.

Notifying Lands in Auckland for Sale by Public Auction.

IN pursuance of the powers and authorities conferred upon me by the one hundred and thirteenth section of “The Land Act, 1892,” I, James Prendergast, Knight, Chief Justice, in the name and on behalf of His Excellency the Governor of the Colony of New Zealand, and as his duly-appointed Deputy, do hereby appoint Wednesday, the twenty-seventh day of December, one thousand eight hundred and ninety-three, as the time at which the lands enumerated in the Schedule hereto shall be sold by public auction at Auckland, and I do hereby fix the prices at which the said lands shall be sold as those mentioned in the said Schedule hereto opposite the description of such lands respectively.
