Allocating Land reserved and taken for a Railway to the Purposes of a Road in Ashburton County.

A PROCLAMATION.

WHEREAS the land mentioned in the Schedule hereto forms part of land taken for the purposes of the Lyttelton to Bluff Railway, and it is considered desirable to allocate such land to the purposes of a road:

And whereas it has been certified by the New Zealand Railway Commissioners that such land is not required for railway purposes: And whereas such land is situated in Ashburton County, the local authority of which has consented to the issue of this Proclamation:

And whereas His Excellency the Governor, by his Deputy, is of opinion that the said local authority can conveniently construct and maintain the said road:

Now, therefore, I, James Prendergast, in the name and on behalf of His Excellency the Governor of the Colony of New Zealand, and as his duly-appointed Deputy, in exercise and pursuance of the powers and authorities in me vested by section five of “The Public Works Acts Amendment Act, 1889,” and of every other power and authority in anywise enabling me in that behalf, do hereby proclaim and declare that the land described in the Schedule hereto shall, upon the publication hereof in the New Zealand Gazette, become a road, and that the said road shall be under the control of the Ashburton County Council, and shall be maintained by the said Council in like manner as other public highways are controlled and maintained by the said Council.

SCHEDULE.

ALL that parcel of land in Rangitata Survey District, containing by admeasurement 7 acres 3 roods, more or less, situate at Ealing, on the Lyttelton-Bluff Railway, being a portion of the 12-chains-wide Railway Reserve in the Township Reserve there. Bounded by a line commencing at the junction of the south-east boundary-line of the Railway Reserve with the north bank of the north branch of the Rangitata River, and proceeding thence north-easterly along the south-east boundary-line of the said Railway Reserve to the south-west side of the road which crosses the railway at 78 miles 16¾ chains on the railway mileage; thence north-westerly along the south-west side of the said road a distance of 106⁴/₁₀ links; thence south-westerly along a line parallel to, and 100 links distant from, the south-east boundary-line of the said Railway Reserve a distance of 3450 links; thence north-westerly along a line at a right angle to the last-described boundary a distance of 300 links; thence south-westerly along a line parallel to, and 400 links dis-

tant from, the south-east boundary-line of the Railway Reserve aforesaid to the north bank of the north branch of the Rangitata River; and thence south-easterly along that bank to the commencing-point; as the said parcel of land is more particularly delineated on the plan marked S.G. 21041, deposited in the Head Office of the Department of Lands and Survey, at Wellington, in the Land District of Wellington, and thereon coloured green.

Given under the hand of the Honourable Sir James Prendergast, Knight, Chief Justice, for and on behalf of His Excellency the Governor, and as his duly-appointed Deputy in and over Her Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this thirty-first day of October, in the year of our Lord one thousand eight hundred and ninety-three.

Land declared to be Crown Lands subject to “The Land for Settlements Act, 1892.”

A PROCLAMATION.

WHEREAS the land described in the Schedule hereto has been acquired under the provisions of “The Land for Settlements Act, 1892,” hereinafter termed “the said Act,” and the purchase thereof has been concluded as by the said Act is provided: And whereas it is enacted by the said Act that all land so acquired shall be proclaimed as Crown land subject to the provisions of the said Act:

Now, therefore, I, James Prendergast, Knight, Chief Justice, in the name and on behalf of His Excellency the Governor of the Colony of New Zealand, and as his duly-appointed Deputy, in exercise and pursuance of the power and authority conferred by the said Act, do hereby proclaim and declare that the land described in the Schedule hereto shall, on the date of the publication hereof in the New Zealand Gazette, be and be deemed to be Crown land subject to the provisions of “The Land for Settlements Act, 1892.”

SCHEDULE.

ALL that parcel of land, containing by admeasurement 107 acres 2 roods 17 perches, more or less, being Sections 27534, 27535, and the northern portion of 27536, intersected

ERRATUM.—In the New Zealand Gazette, No. 82, page 1559, of the 2nd November, 1893, the commission of Sub-Lieutenant George John Watson (Ponsonby Naval Artillery Volunteers) in the New Zealand Volunteer Force was erroneously given as dating from 4th January, 1892, instead of from 4th January, 1893.
