  1. Each applicant shall also deposit the first half-year’s rent, together with the lease and registration fee, as provided in the 63rd section of the said Act.

  2. All rents must be paid half-yearly, in advance, on the first days of January and July in each year, as provided in section 157 of the said Act; and the first half-year’s rent is payable as before provided.

  3. Improvements and residence on the land comprised in each lease shall be as provided in Part III. of the said Act. The provisions of section 144, and all other provisions of the said Act with respect to substantial improvements, shall apply accordingly to lessees under these regulations. The provisions of section 141, and all other provisions of the said Act in respect of compulsory residence, shall apply accordingly to lessees under these regulations.

  4. No lessee shall subdivide, sublet, or transfer the land held by him under these regulations, except under and subject to the provisions of Part I. of the said Act.

  5. No lessee shall hold more than one allotment, including that already held, and such allotment shall be held for his sole use and benefit, and not for the use or benefit of any other person whomsoever. No married woman shall be eligible as a selector; but this provision shall not apply to any married woman who may become a transferee under a will or by virtue of an intestacy.

  6. All the provisions of the said Act, so far as applicable, shall extend and apply to the lands affected by these regulations, and to the applications and leases to be made and issued thereunder, and generally to the interests created, and the persons whose rights, liabilities, or interests are thereby affected; and the mention of any particular provision of the said Act shall not be deemed to exclude any other provision of the said Act applicable to the particular case.

Timaru Harbour Board subject to “The Public Bodies’ Powers Act, 1887.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-ninth day of August, 1893.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Timaru Harbour Board, being a leasing authority within the meaning of “The Public Bodies’ Powers Act, 1887” (hereinafter termed “the said Act”), has requested that these presents should issue, and it appears expedient to make the order hereinafter contained:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the powers conferred upon him by the said Act, and by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the Timaru Harbour Board shall, as from the date of publication hereof in the New Zealand Gazette, be subject to the provisions of the said Act.

The Westland Agricultural and Pastoral Association incorporated.—Notice No. 376.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-ninth day of August, 1893.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance of the powers and authorities vested in him by “The Agricultural and Pastoral Societies Act, 1877,” His Excellency the Governor of the Colony of New Zealand, by and with the advice of the Executive Council of the said colony, doth hereby incorporate the members of the Westland Agricultural and Pastoral Association, and such persons as shall hereafter be admitted members of the said association agreeably to the rules of the said association and the provisions of the said Act, into a body corporate under the said Act, under the style and title of “The Westland Agricultural and Pastoral Association.”

Arowhenua Recreation-ground brought under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-ninth day of August, 1893.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

BY virtue of the powers and authorities vested in me by the twenty-fourth section of “The Public Reserves Act, 1881,” I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, do hereby order and declare that the reserve made for public gardens in the Land District of Canterbury, and known as the Arowhenua Recreation-ground, and described in the Schedule hereto, shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of “The Public Domains Act, 1881,” and such domain shall hereafter be managed, administered, and dealt with in manner directed by the said Act.

SCHEDULE.

TOWN OF AROWHENUA.—Reserve 3003, 2 roods 23 perches; Reserve 3004, 2 acres 2 roods 24 perches; Reserve 3005, 3 roods 22 perches; Reserve 3006, 1 rood 32 perches; Reserve 3007, 2 roods 7 perches; Reserve 3008, 1 acre and 26 perches; Reserve 3009, 3 roods 8 perches; Reserve 3010, 1 acre 2 roods; Reserve 3011, 1 rood 20 perches; Reserve 3012, 1 acre; Reserve 3013, 20 perches.

Powers delegated to the Arowhenua Town Board under “The Public Domains Act, 1881.”

GLASGOW, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-ninth day of August, 1893.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the twelfth section of “The Public Domains Act, 1881,” it is, inter alia, enacted that the Governor, by Order in Council, may from time to time delegate all or any of the powers by the said Act conferred, save as is therein mentioned, to any person or persons for any period, and subject to such stipulations as may be specified in such order, and that every such delegation may from time to time in like manner be altered or revoked: And whereas, pursuant to “The Public Reserves Act, 1881,” by an Order in Council of even date herewith, the land described in the Schedule thereto is declared to be brought under the operation of and to be subject to the provisions of the said “Public Domains Act, 1881”:

Now, therefore, His Excellency the Governor, by and with the advice and consent of the Executive Council of the Colony of New Zealand, doth by this present order delegate all the powers conferred by the Act first above mentioned, except the powers under or conferred by sections five and twelve thereof, to

THE AROWHENUA TOWN BOARD,

who shall be known as the Arowhenua Domain Board (hereinafter referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the third Monday in each month, at seven o’clock p.m., at the Town Board Office, Arowhenua, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Monday, the eighteenth day of September, one thousand eight hundred and ninety-three.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting, and no other business than that so specified shall be transacted at such meeting.

  3. Any three of the said Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the third Monday in January in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.
