Removal of Restrictions on Alienation of Native Land.

GLASGOW, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this first day of August, 1893.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS application has been made to the Governor in Council by Kingi Ngatuere, Akenehi Tutere, Apikara Whakahunga, Ani te Toatoa, Ihai'a Koko, Manuera Ngatuere, Paranihia Ngatuere, Wirihita Pinea, Reiri Pakaiahi, Pane Pakaiahi, Hoani Ngatuere, and Haneta Pakaiahi, being a majority of the Native owners of the land described in the second column of the Schedule hereto, praying that the restrictions on the alienation of such land, contained in the Crown grant bearing date the ninth day of May, one thousand eight hundred and seventy, described in the first column of the said Schedule, may be removed: And whereas inquiry has been duly made by the Native Land Court, and the said Court has reported that the provisions of the law in that behalf have been complied with: And whereas it appears expedient to grant such application: Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred on him by “The Native Land Act, 1888,” and acting with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that all restrictions imposed by the said Crown grant on the alienation of the said land are hereby removed.

Particulars of Grant or Instrument containing Restrictions. Description of Land.
Crown grant dated the 9th May, 1870, in favour of Ngatuere Tawhao and nine others, and containing the following restrictions : “Inalienable, except with the consent of the Governor, by sale or mortgage, or by lease for a longer period than twenty-one years.” All that parcel of land containing 1,177 acres, situate at Taueru, in the District of Wairarapa, known as Te Whiti North, and numbered 107N.

Validating Burgess Roll, Borough of Ross.

GLASGOW, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this first day of August, 1893.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS it has been made to appear that the burgess-roll of the Borough of Ross for the year commencing on the first day of June, one thousand eight hundred and ninety-three, was prepared and completed after the times required by “The Municipal Corporations Act, 1886,” and it is expedient to validate the same: Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in exercise and pursuance of the powers and authorities vested in him by the said “Municipal Corporations Act, 1886,” doth hereby declare that the burgess-roll of the said Borough of Ross, for the year commencing from the first day of June, one thousand eight hundred and ninety-three, so made as aforesaid, shall be as valid to all intents and purposes as though the same had been made within the times required by the said Act.

Rural Lands in the Auckland Land District open for Sale or Selection.

GLASGOW, Governor.

IN pursuance and exercise of the powers and authorities conferred upon me by the one hundred and thirty-sixth section of “The Land Act, 1892,” I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, having received the report of the Surveyor-General in this behalf, as in the said section is provided, do hereby declare that the rural land described in the Schedule hereto shall be open for sale or selection on and after the twenty-seventh day of September, one thousand eight hundred and ninety-three; and also that the lands mentioned in the said Schedule may, at the option of the applicant, be purchased for cash, or be selected for occupation with right of purchase or on lease in perpetuity, or, in respect of any lands containing or supposed to contain any metal, mineral, or valuable stone, be selected on lease in perpetuity only; and I do hereby also fix the prices at which the said lands shall be sold, occupied, or leased, as mentioned in the said Schedule hereto, and do declare that the said lands shall be sold, occupied, or leased under and subject to the provisions of “The Land Act, 1892.”
