Validating Election of Native Assessor under Licensing Acts.

GLASGOW, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this sixth day of June, 1893.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section two hundred and twenty-seven of "The Licensing Act, 1881" (herein termed "the said Act"), it is provided that, if, through any accidental or unavoidable impediment, misfeasance, or omission, anything required by the said Act to be done is omitted to be done, or is not done within the time fixed, the Governor in Council may take all such measures as may be necessary for removing such impediment or rectifying such misfeasance or omission, and may validate anything which may have been irregularly done in matter of form, so that the intent and purpose of the Act may have effect:

And whereas in the month of February last the Returning Officer omitted to hold an election of an Assessor for the Native Licensing District of Taupo, but such election was held on the twenty-sixth day of May last, and Rawiri Kahia was then duly elected: And whereas it is expedient to validate such election:

Now, therefore, His Excellency the Earl of Glasgow, the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities conferred by the said Act, and of all other powers enabling him in this behalf, and by and with the consent of the Executive Council of the said colony, doth hereby validate the said election of Rawiri Kahia as the Assessor for the Native Licensing District of Taupo.

Validating Burgess-roll of Borough of Ashburton.

ORDER IN COUNCIL.

At the Government House, at Wellington, this sixth day of June, 1893.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS it has been made to appear that the burgess-roll of the Borough of Ashburton for the year commencing on the first day of June, one thousand eight hundred and ninety-three, was completed after the time required by "The Municipal Corporations Act, 1886," and it is expedient to validate the same:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in exercise and pursuance of the powers and authorities vested in him by the said "Municipal Corporations Act, 1886," doth hereby declare that the burgess-roll of the said Borough of Ashburton for the year commencing from the first day of June, one thousand eight hundred and ninety-three, so made as aforesaid, shall be as valid to all intents and purposes as though the same had been made within the times required by the said Act.

Regulations in reference to the Assessment of Mortgages.

ORDER IN COUNCIL.

At the Government House, at Wellington, this sixth day of June, 1893.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of all powers and authorities vested in him by "The Land and Income Assessment Act, 1891," His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby make the regulations following for determining the mode in which the actual value of any mortgage liable to taxation under the said Act shall be decided by the Commissioner of Taxes in cases where any difference arises as to such value for the purposes of the said Act.

REGULATIONS.

"The said Act" means "The Land and Income Assessment Act, 1891," and includes any amendment thereof.

  1. If any person or company being the mortgagee of land is dissatisfied with the amount at which the actual value of any mortgage to the mortgagee is assessed by the Commissioner of Taxes under the provisions of the said Act, such mortgagee shall send written notice of objection and of the grounds thereof to the Commissioner.

  2. The Commissioner shall thereupon appoint a day, time, and place for the hearing of such objection, and shall give to the mortgagee at least seven days' notice thereof.

Upon the day so appointed the Commissioner shall hear, peruse, and consider any evidence, whether verbal or documentary, which the mortgagee may adduce in support of his objection; and the Commissioner, after taking such further evidence of value as he may require, shall thereupon decide what, in his opinion, is the actual value of the mortgage or mortgages under consideration, and shall notify the mortgagee accordingly.

Any such inquiry or hearing may be adjourned from time to time or from place to place, as the Commissioner may determine.

Rural Lands in the Auckland Land District open for Sale or Selection.

GLASGOW, Governor.

IN pursuance and exercise of the powers and authorities conferred upon me by the one hundred and thirty-sixth section of "The Land Act, 1892," I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, having received the report of the Surveyor-General in this behalf, as in the said section is provided, do hereby declare that the rural lands described in the Schedule hereto shall be open for sale or selection on and after the ninth day of August, one thousand eight hundred and ninety-three; and also that the lands mentioned in the said Schedule may, at the option of the applicant, be purchased for cash, or be selected for occupation with right of purchase or on lease in perpetuity, or, in respect of any lands containing or supposed to contain any metal, mineral, or valuable stone, be selected on lease in perpetuity only; and I do hereby also fix the prices at which the said lands shall be sold, occupied, or leased, as mentioned in the said Schedule hereto, and do declare that the said lands shall be sold, occupied, or leased under and subject to the provisions of "The Land Act, 1892."

SCHEDULE.

AUCKLAND LAND DISTRICT.

WAIKATO COUNTY.—Unsurveyed Second-class Land.

All that parcel of land in the Auckland Land District, situate in the Parish of Taupiri, and containing approximately 9,200 acres. Bounded towards the east generally by the confiscation boundary-line; towards the south-east generally by Sections Nos. 474 and 405 of the Parish of Taupiri, by a public road, by Section No. 403 of the same parish, by a public road, and by Sections Nos. 315, 316, 310, 309, 308, and 307 of the Parish of Taupiri aforesaid; towards the west generally by a public road, by Sections Nos. 232, 231, 230, and 229 of the said Parish of Taupiri, and by a public road; and towards the north-west generally by Sections Nos. 302, 301, 300, 299, 298, 297, 296, and 294 of the same parish, by a public road, by Sections Nos. 295 and 480 of the same parish, and by Sections Nos. 473, 461, 460, 459, 458, 457, and 456 of the Parish of Whangamarino, to the point of commencement.

Rather more than one-half mixed forest, on the slopes of the hills land being of good quality right to the summit and very suitable for sheep, remainder open fern and tea-tree land; most of it will take grass. Land is well watered, and accessible by partially-formed dray-road from Huntly and Ohinewai, right up to the block; total distance, about 12 miles. Cash price, 9s. to 12s. an acre; occupation with right of purchase, 5·4d. to 7·2d. an acre; lease in perpetuity, 4·32d. to 5·76d. an acre.
