Land available for Selection by the Midland Railway Company set apart for Mining Purposes.

A PROCLAMATION.
WHEREAS in the contract bearing date the third day of August, one thousand eight hundred and eighty-eight, made between Her Majesty the Queen and the New Zealand Midland Railway Company (Limited), it is, among other things, provided that, subject to the conditions therein contained, all lands within the limits of the authorised area defined in the said contract shall be available for selection by the company, with certain exceptions: And whereas among such exceptions are included all lands which from time to time, in the opinion of the Governor, are or may be required for bonâ fide mining purposes and the several purposes connected therewith or incidental or conducive thereto, and which lands shall from time to time be set apart and defined by Proclamation to be issued in that behalf; but no more than ten thousand acres shall be so set apart or proclaimed in one block at any one time, and the lands so set apart and proclaimed from time to time shall not, in the aggregate, exceed seven hundred and fifty thousand acres: And whereas, in the opinion of the Governor, the lands described in the Schedule hereto are required for bonâ fide mining purposes and the several purposes connected therewith, and the said lands are comprised in one block, containing one thousand five hundred acres: And whereas it is expedient the said land should be set apart and defined by this Proclamation:
Now, therefore, I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, in pursuance and exercise of all powers and authorities enabling me in this behalf under the hereinbefore-mentioned contract or otherwise, do hereby proclaim and declare that the block of land defined and described in the Schedule hereto is set apart under the provisions of the said contract for bonâ fide mining purposes and the several purposes connected therewith.
SCHEDULE.
ALL that area in the Westland Land District, containing by admeasurement 1,500 acres, more or less, comprising the Acre Creek Diggings, situated in the Waimea Survey District. Bounded towards the north-east by Chesterfield Road; towards the south-east generally by Chesterfield Township and the road from Stafford to Chesterfield; towards the south-west by Mining Reserve, Block II., as described in the New Zealand Gazette No. 62, 27th August, 1891, and the north-eastern boundary-line of that reserve produced to Road and Railway Reserve No. 7; and towards the north-west by Road and Railway Reserve No. 7: exclusive of sold land and reserves.
Given under the hand of His Excellency the Right Honourable David, Earl of Glasgow; Knight Grand Cross of the Most Distinguished Order of
Saint Michael and Saint George; Governor and Commander-in-Chief in and over Her Majesty's Colony of New Zealand and its Dependencies, and Vice-Admiral of the same; and issued under the Seal of the said Colony, at the Government House, at Auckland, this sixth day of April, in the year of our Lord one thousand eight hundred and ninety-three.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this eighteenth day of April, 1893.

THE HONOURABLE W. P. REEVES PRESIDING IN COUNCIL.
WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work authorised to be constructed by the Government, to wit, the construction of beacons on which leading-lights for the Port of Gisborne are to be erected:
And whereas the said land is held or occupied by Native owners under a title which is not derived from the Crown:
Now, therefore, in pursuance and exercise of the powers vested in him by “The Public Works Act, 1882,” and the thirteenth section of “The Public Works Acts Amendment Act, 1887,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby order that the public work above mentioned shall be constructed on the land described in general terms in the Schedule hereto.
SCHEDULE.
BEACON-SITE AT POVERTY BAY.
ALL that area in the Hawke’s Bay Land District, situated in Block VII., Turanganui Survey District, containing by admeasurement 3 roods 1 perch, more or less, being a strip of land 50 links wide, the centre-line of which commences at a point in Wai-o-hi-harore No. 1 Block distant 9691 links north and 5541 links west of Trig. Station No. 108 (Kaiti); and proceeds on a bearing of S. 19° 6' 35" E., over two beacon-pegs, to the high-water mark of Poverty Bay, the above strip of land being intersected by a public road 1 chain wide: as the same is more particularly delineated on the plan marked S.G. 18212, deposited in the Head Office, Department of Lands and Survey, at Wellington, in the Land District of Wellington, and thereon coloured green.
