Native Land proposed to be taken for Construction of Beacons and Leading-lights near Gisborne.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this eighteenth day of April, 1893.

WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work authorised to be constructed by the Government, to wit, the construction of beacons on which leading-lights for the Port of Gisborne are to be erected:
And whereas the said land is held or occupied by Native owners under a title which is not derived from the Crown:
Now, therefore, in pursuance and exercise of the powers vested in him by “The Public Works Act, 1882,” and the thirteenth section of “The Public Works Acts Amendment Act, 1887,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby order that the public work above mentioned shall be constructed on the land described in general terms in the Schedule hereto.
SCHEDULE.
BEACON-SITE AT POVERTY BAY.
ALL that area in the Hawke’s Bay Land District, situated in Block VII., Turanganui Survey District, containing by admeasurement 3 roods 1 perch, more or less, being a strip of land 50 links wide, the centre line of which commences at a point in Wai-o-hi-harore No. 1 Block distant 9691 links north and 5541 links west of Trig. Station No. 108 (Kaiti); and proceeds on a bearing of S. 19° 6′ 35″ E., over two beacon-pegs, to the high-water mark of Poverty Bay, the above strip of land being intersected by a public road 1 chain wide: as the same is more particularly delineated on the plan marked S.G. 18212, deposited in the Head Office, Department of Lands and Survey, at Wellington, in the Land District of Wellington, and thereon coloured green.

Rural Lands in the Southland Land District open for Sale or Selection.

IN pursuance and exercise of the powers and authorities conferred upon me by the one hundred and thirty-sixth section of “The Land Act, 1892,” I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, having received the report of the Surveyor-General in this behalf, as in the said section is provided, do hereby declare that the rural lands enumerated in the Schedule hereto shall be open for sale or selection on and after the twenty-ninth day of June, one thousand eight hundred and ninety-three; and also that the lands mentioned in the said Schedule may, at the option of the applicant, be purchased for cash, or be selected for occupation with right of purchase or on lease in perpetuity, or, in respect of any lands containing or supposed to contain any metal, mineral, or valuable stone, be selected on lease in perpetuity only; and I do hereby also fix the prices at which the said lands shall be sold, occupied, or leased, as mentioned in the said Schedule hereto, and do declare that the said lands shall be sold, occupied, or leased under and subject to the provisions of “The Land Act, 1892.”

Section 790, open hilly land, fair grazing country with small areas of ploughable land in valleys, vegetation silver tussock with tutu and fern in places, well watered; height above sea-level from 500ft. to 1,400ft. Section 791, open and bush country, about 289 acres of the latter consisting of timber of rather a scrubby nature with a little black-pine and kowhai, fair grazing land with a little ploughable in valleys, vegetation silver tussock and fern with tutu and fern, well watered; height above sea-level from 520ft. to 1,400ft.; this section is to be burdened with £68 5s., being value of black-pine and kowhai growing on this section, also £23 14s., being half the value of boundary-fences. Section 792, about 10 acres scrubby bush, balance open land; well watered, hilly, vegetation silver tussock with fern and tutu; height above sea-level from 500ft. to 900ft.; small area ploughable. Section 793, about 40 acres bush, the rest open land, hilly, well watered, vegetation silver tussock, fern, and tutu; large outcrop of conglomerate rock; height above sea-level from 500ft. to 1,300ft. These sections are accessible by road from Caroline Railway-station; and distant therefrom two to two and three-quarter miles.

Section 794, about 116 acres mixed bush, balance open broken land, well watered, vegetation silver tussock with fern and tutu, good pastoral land with small parts ploughable; height above sea-level from 500ft. to 1,600ft. This section will be burdened with £28 4s., being the value of black-pine and kowhai growing on the section. Section 795, open hilly country, good pastoral land with small areas ploughable, vegetation silver tussock with fern and tutu; height above sea-level from 600ft. to 1890ft.; 129 chains of standard and wire fence, but, not being boundary-fence, will not be of use to incoming tenant. Section 796, about 24 acres white-birch bush, balance open land, broken country, about one-third of area comprised of ferny faces with tutu mixed, balance tussock land, very small area ploughable; height above sea-level from 550ft. to 1,926ft.; this section will be burdened with £8 8s., being half the value of boundary-fence; there are 194 chains of standard and wire fence, which will not be of any value to incoming tenant as it is not a boundary-fence. Sections 794 and 795 are accessible by road from Dipton Railway-station, and distant therefrom two and a quarter to three miles. Section 796, accessible by road from Benmore Railway-station, and distant therefrom about six miles.
