A PROCLAMATION.

BY virtue and in exercise of the powers and authorities vested in me by the one hundred and seventy-second section of “The Land Act, 1892,” and of every other power and authority enabling me in that behalf, I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, do hereby declare that the lands mentioned in the Schedule hereto shall be subject to the provisions of sections one hundred and seventy-two to one hundred and eighty-six of Part V. of “The Land Act, 1892,” relating to small grazing-runs.

Given under the hand of His Excellency the Right Honourable David, Earl of Glasgow; Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies, and Vice-Admiral of the same; and issued under the Seal of the said Colony, at Wellington, this sixth day of April, in the year of our Lord one thousand eight hundred and ninety-three.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this tenth day of April, 1893.

Present:

THE HONOURABLE W. P. REEVES PRESIDING IN COUNCIL.

WHEREAS in the year one thousand eight hundred and seventy-eight the Native Land Court, sitting at Wanganui, investigated the title to a block of land, containing three thousand two hundred and fifty acres, more or less, called in the application for investigation the Okirae Block: And whereas the Native Land Court, upon the investigation of such title, notified its intention to exclude from the memorial of ownership to be issued for the said block a piece of land situated in the south-west corner of the said Okirae Block, containing one hundred and twenty-five acres, more or less, and known as Te Kiato, the boundaries of the said land not being completely defined by water and bounds, but being marked on a plan then produced to the Court: And whereas through an error of the said Court a memorial of ownership was subsequently issued for the whole block, therein called the Okirae Block, containing three thousand two hundred and fifty acres, more or less: And whereas the block described on such memorial of ownership, excluding certain reserves, but including the said piece of land consisting of one hundred and twenty-five acres, known as Te Kiato, became subsequently vested in purchasers for value, claiming under the persons named in the said memorial of ownership, with an indefeasible title under the Land Transfer Acts, notwithstanding that the ownership according to Native custom of the said piece of land called Te Kiato had never been ascertained: And whereas the Supreme Court of New Zealand in the case of the Okirae Block (10 N.Z. L.R. 677) expressed an opinion that the Natives entitled according to Native custom have a valid claim upon the Assurance Fund under “The Land Transfer Act, 1885,” and the Acts amending the same in respect of the deprivation of their interests in the said land: And whereas it is desirable, for the purpose of ascertaining the persons entitled to make such claim, that the matters and questions hereinafter specified should be within the jurisdiction of the Native Land Court:
