Regulations under “The Mining Act Amendment Act, 1892.”

GLASGOW, Governor.

IN pursuance and exercise of the powers and authorities conferred upon me by section two hundred and thirty of “The Mining Act, 1891,” and subsection six of section three of “The Mining Act Amendment Act, 1892,” I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, do hereby make the following regulations, prescribing the form of declaration to be made by applicants for occupation licenses under the said Acts and the penalty for any false statements made in any such declaration:—

  1. Every application for an occupation license, in accordance with the provisions of “The Mining Act, 1891,” and its amendments, and the regulations thereunder, shall be accompanied by a statutory declaration made and signed by the applicant, and forwarded to or deposited with the Warden of the district in which the land applied for is situate.

  2. Such declaration shall be in the form in the Schedule hereto, or to the effect thereof.

  3. The penalty for any false statement contained in any declaration made in terms of these regulations shall be £25.

SCHEDULE.

I, A.B., of [Here insert place of abode and occupation], do solemnly and sincerely declare as follows:—

  1. I am the person who, subject to the provisions of “The Mining Act, 1891,” and its amendments, and to any regulations made thereunder, am applying for an occupation license for Section , Block , District.

  2. Including the said land I am not the owner in freehold, or the lessee or licensee under either “The Mining Act, 1891,” or under any Act for the sale and disposal of lands of the Crown in New Zealand, or under any person, company, or corporation, of land in New Zealand to the extent of one hundred acres in area, or exceeding that area.

And I make this solemn declaration conscientiously believing the same to be true, and by virtue of an Act of the General Assembly of New Zealand intituled “The Justices of the Peace Act, 1882.”

Changing the Purpose of Reserves at Havelock, Marlborough.

GLASGOW, Governor.

WHEREAS the lands described in the Schedule hereto were heretofore duly reserved for the accommodation of travellers, and as a reserve for public utility, and are reserves in Class II. of “The Public Reserves Act, 1881,” and such land has not been vested in trust in any society, body corporate, or trustees: And whereas, in the opinion of the Governor, it is expedient that the purposes of such reserves shall be appropriated to recreation:

Now, therefore, I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, in exercise of the powers and authorities vested in me by the second section of “The Public Reserves Act Amendment Act, 1889,” do by this notification hereby declare that the said reserves shall, from and after the day of the date of the publication hereof in the New Zealand Gazette, be appropriated for the purposes of recreation under Class III. of “The Public Reserves Act, 1881.”

SCHEDULE.

ALL that parcel of land in the Land District of Marlborough, situate in the District of Upper Pelorus Valley, being Section No. 25 on the plan of the said district, containing by admeasurement 13 acres, more or less. Bounded towards the north by a public road 1 chain wide; towards the east by a public road along the right bank of the Rai River; towards the south by a public road 1 chain wide along the left bank of the Pelorus River; and towards the south-west, 1110 links, by Section No. 26 on the said plan.

Also, all that island in the Pelorus River known as Te Hau Island, being Section No. 66, Pelorus Valley, Wakamarina District, Land District of Marlborough, and estimated to contain about 9 acres, more or less.

As witness the hand of His Excellency the Governor, this fourth day of March, one thousand eight hundred and ninety-three.
